A BILL

TO AMEND SECTION 445540, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO WATER, SEWAGE, WASTE DISPOSAL, AND THE LIKE SO AS TO PROVIDE THAT CERTAIN PROVISIONS RELATING TO THE PROTECTION AND MAINTENANCE OF WATER SYSTEMS DO NOT APPLY TO A PROFESSIONALLY INSTALLED LAWN SPRINKLER SYSTEM OR LAWN IRRIGATION SYSTEM CONNECTED TO A PUBLIC WATER SYSTEM.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION1.The Department of Health and Environmental Control is instructed to establish a statewide task force to study inconsistencies in the State’s crossconnection program applicable to public water systems. At a minimum, the task force must be representative of large and small, urban and rural, water providers. The task force must include experts in the cross connection field, representatives of public health, and other public interest groups. The task force is charged with examining inconsistencies in the state program and offering viable recommendations for regulatory change to the General Assembly no later than January 15, 2003. The task force is not eligible for mileage, per diem or subsistence and must be dissolved upon submittal of the recommendations to the department.

SECTION2.No public water system shall require the testing of any backflow prevention device installed on a residential irrigation system until regulations proposed by the task force are approved by the General Assembly or until July 1, 2003, whichever is sooner.

SECTION3.This act takes effect upon approval by the Governor.
