Public sector bodies with 250 or more employees in England have a statutory duty to have regard to and report on progress against the public sector apprenticeships target. This was introduced in April 2017 to ensure the public sector delivers its fair share of apprenticeships. It is planned to remain in place until 31 March 2021. The target and duty to report against it was legislated for by the Enterprise Act 2016 and the Public Sector Apprenticeship Targets Regulations 2017. The duty to “have regard” to the target means that, in practice, public bodies in scope should actively consider apprenticeships in recruitment decisions and embed apprenticeships within workforce planning. The target is set at 2.3% of public bodies’ headcount in England. This means that public bodies in scope are expected to employ at least 2.3% of its staff as new apprentices between April 2017 and March 2021. Both new apprentice hires and existing staff that begin on an apprenticeship can be counted towards the target. Public bodies are required to report on their progress towards the target annually; however, whether a public body has met the target will be assessed as an average over the period April 2017-March 2021 to allow for peaks and troughs in recruitment. As such, the target period is split into four annual reporting periods: • 1 April 2017 – 31 March 2018 • 1 April 2018 – 31 March 2019 • 1 April 2019 – 31 March 2020 • 1 April 2020 – 31 March 2021 Public bodies have a six month window within which to report on their progress against the target in the previous reporting year. This means the first reports (for progress between April 2017 and March 2018) will be due by 30 September 2018, with subsequent reports due on 30 September for the following three years. The final reports will be due by 30 September 2021. There are two parts to the reporting requirement: 1. Data Publication – publishing annual information on their progress towards meeting the target. This includes the following figures: a. The number of employees whose employment by the body began in the given reporting year; b. The number of apprentices whose employment by the body began in that reporting year; c. The number of employees that the body has at the end of that reporting year; d. The number of apprentices who work for the body at the end of that reporting year; e. Figure B expressed as a percentage of figure A; f. Figure D expressed as a percentage of figure C; g. The number of apprentices who worked for the body immediately before that reporting year; h. Headcount on the day before that reporting year; and i. Figure B expressed as a perentage of figure H. (N.B. this will be the figure that determines whether or not a public body has met the target) 2. Apprenticeship Activity Return – a report sent to the Department for Education setting out progress made towards meeting the target and details on actions taken towards meeting the target. This report will not need to be published. We expect this report will include: a. Action that the body has taken to meet an apprenticeship target set for it, especially through the recruitment and retention of apprenticeships; b. If the public body has failed to meet the target, and explanation of why the target has not been met; c. Information about action that the body proposes to take to meet future apprenticeship targets; and d. If the body considers that a future target is not likely to be met, and explanation of why that is so. Levy paying public bodies will submit all the information above through their digital Apprenticeship Service account (which they currently use to draw down funds for apprenticeship training). They will be able to do this from April 2018.

We have assumed that funning and quality assuring reports would take 2 hours annually. We have also assumed that 0.5 hours would be required for managers to clear reports before they are submitted. However, we have not included this in the final costings as we have assumed this would form part of a managers existing job remit.

The public sector apprenticeships duty requires public bodies to ‘have regard’ to the target. In practice this means that when a new post becomes available or if development of an existing employee is needed, that apprenticeships are considered. Recruiting apprenticeships and embedding them within workplace planning could bring a number of benefits to capacity and capability of the organisation. Employer case studies carried out by BIS in s2012 (Employer Investment in Apprenticeships and Workplace Learning: The Fifth Net Benefits of Training to Employers Study) suggested that employers which invested in apprenticeships derived many business benefits from doing so and that whilst employers met much of the cost of delivering each form of training, they can recoup their investment relatively quickly upon completion of the training if they are able to retain their former trainee.
