FACTUAL STATEMENTS REGARDING AERIAL SPRAYING & PESTICIDES *CONTINUE WITH WHATEVER NUMBER YOU ARE AT AND LIST FACTS’

·  On the evening of November 8, 2007, my home and person in Santa Cruz County were subjected to aerial spraying of unapproved pesticides in the form of untested microencapsulated synthetic-pheromone chemical admixtures.

·  I witnessed airplanes, e.g. the number of times, the time of day.

·  Any noxious odors or tastes that you noted.

·  Any additional facts about the times that you were subjected to spraying.

·  Although I live in (zone number or location, e.g. Santa Cruz County, City of Santa Cruz), I did not/have not received mailers or emails regarding the aerial spraying.

FACTUAL STATEMENTS REGARDING ACTUAL EFFECTS OF THE SPRAYING ON YOU AND YOUR FREEDOMS AND RIGHTS

·  Any and all changes in your lifestyle that you have made as result of the spraying, e.g. leaving the area, being anxious about whether the spray would or would not happen, curtailed activities, i.e. not going out at certain times, harvesting food from gardens, covering areas, etc.

EXAMPLE

With the planes passing over my house from 8 p.m. on November until 5 a.m. for several nights in Sept. and again for several nights in Oct., I was deprived of sleep, freedom of assembly, and was powerless to protect my person and property and my environment – the air I breathe, the animals, the plants, the vegetables - from an untested pesticide said to last at least 30 days.

I was caused to vacate my property and leave town on DATE to protect my person from further exposure, assault, trespass, and nuisance for the duration of the spraying in zone (#) in Santa Cruz or Monterey.

We have been told by public officials to expect many more years of this cycle of aerial pesticide application, without definite end, consisting of six (6) consecutive nights of spraying each month, for nine (9) months of every year each month.

I do not have a problem with “Light Brown Apple Moths” in and around my home (or property). I have no knowledge of the existence of any “Light Brown Apple Months” in my community (or name the place, e.g. city or county)

I believe that the “Light Brown Apple Moth” threat, claimed by the USDA and the CDFA and the CDPR is a false threat; moreover, the real threat is to my person and the citizens, environment and all life forms of the Central Coast of California known as Monterey County and Santa Cruz County.

As a result of the so-called ‘emergency’ of the “Light Brown Apple Moth,” in the absence of any evidence to support that false notion of emergency, I have been told that defendants are also allowing other restrictive and highly toxic pesticides that threaten to expose the public to ongoing toxic pesticides for the duration of the unfounded emergency status.

I believe that I, and my family/community/visitors to my home (or Property), are suffering physical and psychological damage by CDFA’s and USDA’s trespass.

I have, without my consent, been assaulted and deprived of the security of my person and property during the aerial spraying of pesticides which supposedly target the “Light Brown Apple Moth.”

I believe that the aerial applications of microencapsulated pheromone chemical admixtures constitute human experimentation under California Health and Safety Cody section 24170-24179.5 and are a violation of the expressed policy of the United States Environmental Protection Agency on both human experimentation with pesticides and on approved emergency uses of microencapsulated pheromone admixtures.

I do not believe that there is an emergency, urgency or even substantial concern about the “Light Brown Apple Moth” in Santa Cruz or Monterey Counties of the State of California.

I have been a resident of Santa Cruz County for over 20 years. I am terrified that the security of my person and property are threatened for endless years to come and I am deeply aggrieved by the defilement of my beloved home and country.
