1.0Scope: This policy implements applicable NYS Public Health Laws requiring immunizations for attendance at NSCA.
2.0NYS Education Law Section 914(1) requires that every child attending school submit proof of the immunizations required by Public Health Law Section 2164.
2.1.NYS Public Health Law Section 2164requires parents/guardians/custodians to ensure that children under their care are immunized for poliomyelitis, mumps, measles, diphtheria, rubella (German measles), varicella (Chicken Pox), Haemophilus influenza type B (Hib), pertussis (Whooping Cough), tetanus, and hepatitis B. The vaccinations required may change from year to year. Check with the Office for the most current requirements. Also see:
2.2.The New York State Center for School Health website, the applicable laws and timetable for the administration of the required immunizations.
3.0NYS Public Health Law Section 2164(7)(a) requires that no student is to be permitted to attend school in excess of fourteen calendar days without proof of required immunizations.
3.1.The only exception to the fourteen day requirement permitted by law is for students transferring in from out-of-state schools or from another country, in which case, they may remain in school for thirty calendar days, provided good faith efforts can be shown to obtain the necessary proof of immunization.
3.2.A parent, guardian or any other person in a parental relationship to a child denied school
entrance may appeal to the commissioner of education. See Section 310 of the state education
law.
3.3If a physician certifies that such immunization may be detrimental to the health of the child, the
requirements of this policy and NYS Public Health Law shall not apply until such immunization
is found to no longer be detrimental to the child's health.
3.4The NSCA Administrator shall file such reports as are required under the above cited section of the Public Health Law.
4.0This policy shall not apply to children whose parents hold sincere and genuine religious beliefs which are contrary to the practices herein. These parents must have an approved religious exemption in accordance with NYS requirements on file with NSCA.
4.1 The NYS Education Department provides a form to request a religious exemption to immunization. This form is to be available in the office.
4.1.1 The Administrator is responsible to review and approve or disapprove all requests for exemption.
4.1.2 Parents must be informed in writing regarding their request for religious exemption. If the request is denied, the parent/guardian notification letter must include the specific reason(s) for denial.
5.0Each student who is permitted to attend school in violation of the requirements of Section 2164(7)(a) constitutes the basis for a separate violation of the Public Health Law. Findings of violations of the Public Health Law can result in civil penalties of up to $2000 per violation.
6.0Student immunization records are to maintained IAW applicable NYS Education and Department of Health guidelines.
7.0A medical exemption form can be obtained from the Office.
8.0A sample religious exemption request can be obtained from the Office.
