(i)Restriction on the use of Hazardous Substances – Signed Declaration

Article 11(2)(a) of the Waste Management (End-of-Life Vehicles) Regulations 2006 (S.I. No. 282 of 2006) requires that the producer attach a signeddeclaration to the application for registration to confirm that the materials and components of specified vehicles put on the market in the State, of that producer’s brand or for which that producer has responsibility, do not contain lead, mercury, cadmium or hexavalent chromium other than in the cases specified in article 28 and the FourthSchedule of the aforesaid Regulations. It is recommended that the signatory of this declaration be either the Chief Executive or Chairperson of the company, or the owner of the business if not a company.

(ii) Implementation Plan (Template Attached)

A three-year implementation plan shall accompany the producer’s application for registration. The plan should specify the measures that the producer intends to take in order to comply with the requirements of the Waste Management (End-of-Life Vehicles) Regulations 2006 (S.I. No. 282 of 2006), including in particular the measures which the producer intends to take to ensure the appropriate treatment and recovery of end-of-life vehicles, of that producer’s brand or for which that producer has responsibility, in the functional area of Dublin City Council. The producer shall confirm that the plan will be made available free-of-charge to any person who so requests it in accordance with articles 17(3) and 17(4) of the aforesaid Regulations.

(iii)Competition Law – Signed Declaration

In accordance with article 11(2)(c), the producer shall provide a writtenundertaking that the producer, for the purposes of complying with the provisions of the Waste Management (End-of-Life Vehicles) Regulations 2006 (S.I. No. 282 of 2006), will not make arrangements or enter into agreements with any economic operator –

(a)which are prohibited by section 4(1) of the Competition Act 2002 (No. 14 of 2002), or as appropriate, by article 81 of the Treaty of Rome, or as appropriate,

(b) act in a manner prohibited by section 5(1) of the Competition Act 2002 (No. 14 of 2002), or as appropriate, or by article 82 of the Treaty of Rome.

It is recommended that the written undertaking be signed by either the Chief Executive or Chairperson of the company, or the owner of the business if not a company.

(iv)Capacity of Producer’s National Collection System – Signed Declaration

A producer shall submit a written declaration to confirm that the authorised treatment facilities that form a part of the producer’s national collection system in the functional area of Dublin City Council have sufficient capacity to treat the actual number of end-of-life vehicles that are likely to arise in the functional area of Dublin City Council over the period to which the application for registration applies. It is recommended that the signatory of this declaration be either the Chief Executive or Chairperson of the company, or the owner of the business if not a company.

(v)Registration Fee

Under article 11(2)(e) of the Waste Management (End-of-Life Vehicles) Regulations 2006 (S.I. No. 282 of 2006), a registration fee shall accompany the application for registration to Dublin City Council. The prescribed registration fee under the aforesaid Regulations is -

(a)€1,000 in respect of a producer whose annual turnover was less than or equal to €50,000,000, or as appropriate,

(b)€2,500 in respect of a producer whose annual turnover was greater than €50,000,000 but less than or equal to €100,000,000, or as appropriate,

(c)€6,000 in respect of producers whose annual turnover was greater than €100,000,000.

Auditor’s Certificate

A producer’s annual turnover is referenced to the preceding twelve-month period or to the projected turnover for the first twelve months of business if the producer is a new entrant to the market. A certificate from an independent person, who is qualified to be an auditor, shall accompany the application for registration to certify the annual turnover of the producer.

Under article 11(6)(d) of the Waste Management (End-of-Life Vehicles) Regulations 2006 (S.I. No. 282 of 2006), for the purpose of an application for registration, a registration fee of €1,000 shall apply to a producer –

(I)whose annual turnover was less than or equal to €1,000,000 and

(II)who placed less than 10 specified vehicles on the market in the State

in the preceding twelve month period and whose registered office if that producer is a company, or principal place of business if that producer is not a company, is situated in the functional area of Dublin City Council.

Please note that for a producer to avail of article 11(6)(d) of the aforesaid Regulations, that producer must demonstrate that he or she has entered into an agreement, or made arrangements, with another producer in order to collectively fulfil his or her obligations under the Waste Management (End-of-Life Vehicles) Regulations 2006 (S.I. No. 282 of 2006).

IN ACCORDANCE WITH ARTICLE 11(9) OF THE WASTE MANAGEMENT (END-OF-LIFE VEHICLES) REGULATIONS 2006 (S.I. NO. 282 OF 2006) DUBLIN CITY COUNCIL WILL BE NOTIFIED OF ANY CHANGES TO THE INFORMATION SUPPLIED IN THIS FORM WITHIN 10 WORKING DAYS OF ANY SUCH CHANGES.

[4] An application for registration shall have as attachments written declarations in respect of compliance with the restriction on the use of hazardous substances, adherence to competition law, capacity of the producer’s national collection system and annual turnover. In addition, a three-year implementation plan must accompany the application for registration in accordance with the requirements of article 11(2)(b) of the Waste Management (End-of-Life Vehicles) Regulations 2006 (S.I. No. 282 of 2006).
