Minimum Order: The Minimum Order Threshold under this IT 70 Schedule contract if set at $10,000.
Geographic Coverage:
The Geographic Scope of Contract will be domestic delivery only. Domestic delivery is delivery within the 48 contiguous states, Alaska, Hawaii, Puerto Rico, Washington, DC, and U.S. Territories. Domestic delivery also includes a port or consolidation point, within the aforementioned areas, for orders received from overseas activities.

Industrial Funding Fee (IFF):

Delivery Schedule:
- TIME OF DELIVERY: The Contractor shall make delivery as agreed to and specified in the individual task order issued by the customer.
- URGENT REQUIREMENTS: When the Federal Supply Schedule contract delivery period does not meet the bona fide urgent delivery requirements of an ordering agency, agencies are encouraged, if time permits, to contact the Contractor for the purpose of obtaining accelerated delivery. The Contractor shall reply to the inquiry within 3 workdays after receipt. (Telephonic replies shall be confirmed by the Contractor in writing). If the Contractor offers an accelerated delivery time acceptable to the ordering agency, any order(s) placed pursuant to the agreed upon accelerated delivery time frame shall be delivered within this shorter delivery time and in accordance with all other terms and conditions of the contract.

Guarantee/Warranty:
a. Unless specified otherwise in this contract, the Contractor’s standard commercial guarantee/warranty as stated in the contract’s commercial pricelist will apply to this contract.
Authorship – XSB warrants that it is and will be the sole author of the services provided, including any licensed software, enhancements and documentation; and to the best of it’s knowledge, information and belief, the services provided does not infringe on any patent, copyright, trademark, or other Intellectual Property right (including trade secrets) of any third party and that the use or making available of the same does not and will not violate any law or right.
Performance–XSB warrants thatthe services provided, including any licensed software (including enhancements) (a) shall be prepared and/or provided with professional diligence and skill according to the highest industry standards; (b) will be scalable to meet the users ongoing business needs; and (c) does not contain any viruses, “time bombs,” disabling code or instructions, copy protection mechanisms, or other such items that mayinterfere with or adversely affect use of the same.
b. The Contractor warrants and implies that the services delivered hereunder are merchantable and fit for use for the particular purpose described in this contract.
c. Limitation of Liability. Except as otherwise provided by an express or implied warranty, XSB will not be liable to the ordering activity for consequential damages resulting from any defect or deficiencies in accepted items.
