WORKING TIME DIRECTIVE
In order to comply with the Working Time Directive (WTD) regulations all staff on Motorola sites are required to complete the following document relating to the 48 hours average working week requirement and the declaration of any secondary employment. This form allows employees to opt in or out of complying with the Directive. There are certain employees who are not covered by the Directive and are exempt. These are mostly senior staff (grade E09 or above) who are required to be flexible in their working hours and to a large extent are able to determine their own working hours or who have unmeasured time because of the nature of the roles they perform.
Employees cannot be forced to work more than 48 hours a week as long as they are covered by the working time directive.
Definition of Working Time
Working time is defined in the WTD as
- Any period during which the worker is working, at their employer’s disposal and carrying out their activities or duties
- Any period where relevant training is being received
- Any additional period which is to be treated as working time for the purposes of these regulations under a relevant agreement.
Secondary Employment
The WTD requires all employers to make reasonable efforts to ascertain the total number of hours that their employees work per week for the employer or for other employers.
Please complete one option from each of the 2 sections below:
SECTION 1- 48 hours per week over 17 week averaging period
Compliance with the WTD- I wish to comply with the WTD requirement of working no more than 48 hours on averageper week over the 17 week averaging period with immediate effect.
OR
Opt Out- I agree to work more than 48 hours on average per week over the 17 week averaging period if requested to do so, in line with business requirement with immediate effect.
OR
Exempt- I consider myself exempt from the WTD (i.e. I am an E09 or above)
SECTION 2- Secondary Employment
None- I declare that I have no other employment other than that with Motorola and I declare that I will notify HR in the event that this situation changes.

SECTION 3
Our business is extremely competitive and it is therefore necessary for all our employees to be flexible in their approach. In signing this agreement I understand that the company can request that I work over and above my normal working hours but that I can reasonably turn down any request for overtime which exceeds the WTD regulations
I confirm that this consent form, once signed will continue to be contractually binding on an indefinite basis whilst I remain an employee of Motorola or its successors in business. However it may be revoked by me, providing I give 12 weeks written notice by completing anew working time directive form, which is available from the UK HR Team.
