You may not be able to answer all the questions and we do not expect you to do so. It would be helpful if you could complete the first part of the questionnaire, providing us with information about your family. You need not complete the latter parts of the questionnaire if you do not wish to do so but you may find it helpful to read it through as these questions are ones that you should be thinking about when you prepare your Will. Executors

This matter we can discuss at your appointment but it is often an advantage to appoint ourselves as your Solicitors which reduces the likelihood of any family disagreements and you are assured of a professional administration of your estate. You should also bear in mind that no Solicitor can practise without professional indemnity insurance as a result of which the possibility of loss to your beneficiaries is minimised. Private individuals do not carry such insurance as a result of which there is always a risk.

Guardians

You may appoint guardians of those of your children who are under the age of 18. Generally speaking the appointment of the guardian will only take effect when you and the child’s other parent has died. If you are a single parent, or if you are divorced from the other parent of the child, other rules will apply. It is preferable for discussions to take place with the proposed guardian before making the Will to ensure that he or she appreciates and accepts their responsibilities. In view of the potential of disruption to the guardian’s own family and the costs of caring for an additional child or children you may wish to consider making the guardian an interest free loan to allow them to enlarge their own property or to buy a larger property to more comfortably accommodate your child or children.

b)  Living Will

A living will (also called an advance directive) is a document in which a person (whilst competent) gives directions as to what should happen as and when he becomes incapable of taking responsibility for his own health care. It is usually made with the object that, should a person find himself in a state of terminal illness and incapacity, no procedures designed to sustain or prolong life will be used and those already in place will be withdrawn. The use of a living will has not so far been tested in the English courts. Please provide a copy of the Living Will.
