An Act to make Provision with respect to the Management of the William E. Dorling Scholarship Fund and for other purposes.

Preamble

WHEREAS William Elven Dorling who died on the 31st day of October, 1946 did by his will dated the 19th day of February, 1945 direct that the balance of his estate should be paid to the council or other governing body of the Prahran Technical School High Street Prahran and be known as "The William E. Dorling Scholarship Fund" and that the Fund and the net income from time to time earned by the Fund should be used and applied by the said Council or other governing body to provide scholarships to be known as "The William E. Dorling Scholarships":

AND WHEREAS the will did further provide that the scholarships should be tenable by each holder for a term not longer than three years such scholarships to be of such value and awarded by examination in such subjects and according to such Regulations as may be made from time to time by the said Council or other governing body for such purposes and that all candidates for such scholarships must be Sunday school scholars or be receiving religious instruction at a State school and must have a knowledge of the Ten Commandments in the Bible:

AND WHEREAS in the said will it was further declared that the receipt by the President and the Principal for the time being of the said Prahran Technical School should be a full and complete discharge to the Trustees of the estate for the balance of the estate:

AND WHEREAS the administration of the Estate was duly completed and the said balance paid to the Council of the said Prahran Technical School:

Preamble

AND WHEREAS the name of the Prahran Technical School has successively been changed to the Prahran College of Technology and to the Prahran College of Advanced Education:

AND WHEREAS the functions of the Prahran College of Advanced Education are not substantially different from the functions formerly carried out by the Prahran Technical School:

AND WHEREAS there has been established a school known as the Prahran Technical School which is situated in Hornby-street, Windsor and which carries out functions which are similar to the functions formerly carried out by the Prahran Technical School in High-street, Prahran:

AND WHEREAS the Council of the Prahran College of Advanced Education and the Council ofthe Prahran Technical School situated in Hornby-street, Windsor have agreed that The William E. Dorling Scholarship Fund should be administered by the Council of the said Prahran Technical School:

AND WHEREAS the moneys in the said Fund are held by or under the direction of the Council of the Prahran College of Advanced Education:

AND WHEREAS it is expedient to make provision for the transfer of the said moneys to the Council of the Prahran Technical School:

BE IT THEREFORE ENACTED by the Queen's Most Excellent Majesty by and with the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say):

1.Short title

s. 1

This Act may be cited as the William E. Dorling Scholarship Fund Act 1975.

2.Fund to be transferred to Council of Prahran Technical School

The Council of the Prahran College of Advanced Education and all persons holding moneys forming part of The William E. Dorling Scholarship Fund under the direction of the said Council are hereby authorized and required to pay all moneys forming part of The William E. Dorling Scholarship Fund to the Council of the Prahran Technical School in Hornby-street, Windsor.

3.Construction of will of William E. Dorling

The last will of William Elven Dorling of Raleigh Street, Windsor in the State of Victoria dated the nineteenth day of February One thousand nine hundred and forty-five shall have effect as if the references to the Council or other governing body of the Prahran Technical School High-street Prahran were references to the Council or other governing body of the Prahran Technical School in Hornby-street, Windsor and as if all references to the Prahran Technical School were references to the Prahran Technical School presently situate in Hornby-street, Windsor.
