Sadly, after speaking to the solicitor, Lloyds also cannot lend (see below email – I thought we had a winner!)

It seems that no banks can offer the mortgage under the circumstances (with many saying this has been the case for some years)

Could we meet up to discuss options?

We just obviously aren’t happy to walk away empty handed after paying in for such a long time towards a scheme that actually doesn’t seem possible……not a great start to our new year

I also hope you had a wonderful Christmas and New Year – it goes too quickly unfortunately!

As you know, I spoke to your solicitor who clarified how the deposit would be arranged and what his legal responsibilities would be when declaring the source of the deposit to us at Lloyds.

I then relayed this information and detail to our Policy Department to gain their agreement, as I did not want this to cause a problem later on in the process after a valuation and the purchase had been agreed.

Unfortunately, their response was not what we wanted and they answered as follows…..

“The minimum deposit of 10% must be the customer's personal deposit. This must be paidas well as any additional deposit paid by the builder.

Cash incentives (from the Builder) greater than 5% of the property value will only be acceptable where the customer is contributingmore than the minimum personal deposit and the above requirements are met.”

They said they have had similar enquires before whereby the developer/landlord had been up front in the documentation stating that some of the rent would be paid back should they buy and as such could consider this to be a way of building up ‘savings’.

However Policy treats this as an incentive, and not the customer’s own money unfortunately and the criteria is that they need a minimum of 10% personal deposit from you, the customer.

This means that in your case, the £19,900 would have to come from you and the additional amount from the builder would either need to be limited to 5% (£9,950) or if you wanted to use all of the £14,400, you would have to increase your deposit to be higher than 10%. I obviously understand that this is quite a big jump in deposit from what you have already saved.

I am really sorry that it took so long to get this definitive answer from the policy department but your scenario, although they seem to have come across it before, is not a common scenario as it is not a scheme widely offered by Builders. I know you must be disappointed but at least now you may have time to find another lender that can help you in time to meet the deadline you have to buy the property??

Just to keep you informed, I have spoken to your solicitor directly in order to get further clarity around how the purchase transaction will take place and how the rebate from your developer will be classed in the transaction.

He was a great help and I now have all the information I need to get a final answer from the Legal Team. I have e-mailed them today and asked them to confirm in writing that we can proceed in the new year.

I don’t expect to hear from anyone this side of Christmas but will be in touch as soon as I do hear from them.

Out of the 10% deposit (£19,900) - £14,400 will come from land securities, but this is money we have saved etc as part of the scheme. The remaining £5,500 will come from us

Is “Land Securities” your landlord at the moment? And will the whole of the 10% be coming from them or is some of the deposit your saved deposit?

Just clarifying again with head office that this is ok… We did call them on the day you came in but best to check all the details again I think to be safe now that the solicitor has clarified how the transaction will be processed.

I attach a revised fee sheet for you.

The rebate of rent will be dealt with by way of an allowance at completion. We will receive a statement from Hayes Solicitors prior to completion which will show the amount required to complete the purchase. less the rebate.

As I understand it, mortgage lenders normally treat monies coming from the seller as an incentive and don't generally like those sorts of arrangements. If Lloyds are willing to lend on the purchase I will need to confirm the arrangement and the amount of the rebate to them in writing as they are unlikely to refer to this in the mortgage offer.

Our deposit has been the main concern with us getting a mortgage, as many lenders weren’t happy that the deposit came from the developer.

The mortgage advisor at Lloyds called their underwriters who agreed the deposit wasn’t an issue because it was the solicitor then who deals with where the deposit is from. Ours will be £14,400 from Land Securities (paid to you by the Hayes solicitors) and £5,500 from us paid to you separately.

Is this what you were expecting with this scheme through the hayes?
