REGULAR BOARD OF DIRECTORS MEETING

April 14, 2016

MINUTES

I.  CALL TO ORDER

A meeting of the Board of Directors for Westchase Community Association, Inc. was held April 14, 2016 at the WCA Management Office, 10049 Parley Drive, Tampa, Florida 33626. Joaquin Arrillaga, President, called the meeting to order at 7:00 PM.

The Pledge of Allegiance was recited by those present at the meeting.

IV. SECRETARY’S REPORT

·  March 10, 2016 Board of Directors Meeting Minutes submitted.

Joe Odda motioned to approve the 03-10-16 board minutes. Keith Heinemann seconded the motion. A vote was taken and the motion carried 6-0

V.  TREASURER’S REPORT

Ruben Collazo motioned to suspend the use rights of the common facilities of Westchase Community Association for those units delinquent more than 90 days in their 2016 annual assessment (excluding those with a $10 or less balance-for the next 3 months only) until assessments and fees are paid in full; this suspension pertains to the owners, the owners renters, guests and invitees. Keith Heinemann seconded the motion. A vote was taken and the motion carried 6-0

VI.  COMMITTEE REPORTS

A.  Covenants Committee –Minutes Submitted

B.  Government Affairs Committee - Report Submitted

·  Task Force Group Update

Joe Odda motioned to for the WCA to encourage association members to communicate with the County in favor of the sales tax ordinance for the transportation options for the 3 noted in the GAC’s report. Ruben Collazo seconded the motion. A vote was taken and the motion carried 6-0

·  David Weekly WPV Townhomes – update provided by Joaquin Arrillaga

·  Thomas Ranch Project Update – update provided by Joaquin Arrillaga

Brian Ross motioned for the WCA to oppose any efforts to increase the number of units the developer and site is already entitled to for the proposed Thomas Ranch Project of 200+ apartments. Ruben Collazo seconded the motion. A vote was taken and the motion carried 6-0

C.  Modifications Committee - Minutes Submitted

Brian Ross motioned, at the request and authorization of the Modification Committee, to allow management staff to approve roof replacement modification requests for single family homes as long as they meet the requirements of the WCA Guidelines and any applicable INSG’s; any requests from sub-associations for neighborhood wide roof replacements would still go before the Mod Committee for review. Ruben Collazo seconded the motion. A vote was taken and the motion carried 6-0

D.  Document Review Committee

Ruben Collazo motioned to appoint John Oros to the Document Review Committee. Keith Heinemann seconded the motion. A vote was taken and the motion carried 6-0

VII.  COMMUNITY ASSOCIATION MANAGER’S REPORT- Report submitted – Debbie Sainz

VIII.  OLD BUSINESS

·  Seniors Group Court Reservations

·  Tabled from April Board meeting – no action was taken on maintaining the temporary standing reservations for this group

IX.  NEW BUSINESS

A.  Review “Second Notice of Violations with Proposed Fines” Files

Brian Ross motioned to levy a $1,000 fine and suspend use rights upon A-3, 5, 8, 14, 17, 19, 28, 30, 31, 32, 43, 54, 56, 57 and 62. Keith Heinemann seconded the amended motion. Vote was taken and the motion carried 6-0

Brian Ross motioned to levy a $1,000 fine and suspend use rights upon A-2, 27, 34, 35, 42, 50, 51, 55, 60 and 61; however, if owner is in compliance with the CCR’s by 5/16/2016, then no fine shall be levied. Keith Heinemann seconded the amended motion. Vote was taken and the motion carried 6-0

Brian Ross motioned to NOT levy a fine upon A-4, 6, 10 - 13, 15, 18, 21, 22, 24-26, 29, 33, 36, 37, 40, 44-48, 52, 53, 59, 64-68. Keith Heinemann seconded the amended motion. Vote was taken and the motion carried 6-0

Brian Ross motioned to move to continue A-1, 38, 39, 58 and 63 to the May board meeting for manager to advise resident how to obtain full compliance during the interim; if full compliance is attained by the board meeting then no further hearing is necessary. Keith Heinemann seconded the amended motion. Vote was taken and the motion carried 6-0

Joaquin Arrillaga motioned to levy a $1,000 fine and suspend use rights upon A-49. Ruben Collazo seconded the amended motion. Vote was taken and the motion carried 5-0-1 (Brian recused himself due to a conflict of interest)

B.  WOW Board Appointments -

·  Due to a vacancy occurring on the WOW Board, it was announced that Carolyn Reynolds would be appointed to the WOW Board to fill the vacant seat at their next meeting.

C.  Greenacre Properties Contract Addendum

Joaquin Arrillaga motioned that in the event a board member (Pres, VP or treasurer) disapproves an invoice during the accounts payable invoice/check approval process online, then the same board member has to be one of the approving signatures; if still in conflict then the Board will address the item and approve the expense (per recommendation made by the associations auditor). Brian Ross seconded the motion. A vote was taken and the motion passed 6-0

X.  OTHER BUSINESS

·  Google Fiber to Westchase

Joaquin informed members that an email was submitted by a representative for Google Fiber asking for Westchase’s approval/permission to install their fiber cables within the community. The association does not take any position on this since the streets are public access roads and any sub associations should be providing their own authorizations via their individual boards or via the CDD.
