Statement by Presiding Officer: Adequate notice of this meeting was posted on January 20, 2008 on the Township bulletin board, sent to the Township Clerk, Echoes Sentinel and Courier News per the Open Public Meetings Act of New Jersey. All Board Members are duly appointed volunteers working for the good and welfare of Warren Township. We plan to adjourn no later than 10:00 p.m.

Work Session Report:
There being no concept plans or other Planning Board Business presented at the Work Session on July 14, 2008 the following items were acted upon:
· Adoption of Resolution: PB04-06PA – Owner-Applicant Sleepy Hollow of Warren LLC. Block 86.01, Lots 27.04 and 34.02 – Hillcrest Boulevard – Amendment to Resolution 05-23 approved with conditions.
· PB-08-02 – Owner/Applicant – John and Valerie Raymond, Block 59, Lots 17.03 and 17.04 – 5 Mason Hill Road – Minor Subdivision/Lot Line change. Case was carried to September 8, 2008 at the request of the applicant. Further notice is required.
· PB-06-03F – Owner/Applicant – Stone Creek Realty, LLC, Block 76, Lot 4 – Winding Ridge Way. Final Major Subdivision - application approved with conditions.
· 08-01PF – Owner Applicant – Nicholas J. and Jennifer Netta, Block 25, Lots 32 and 33 – 56 Elm Avenue – Preliminary and Final Major Subdivision – application approved with conditions.

CITIZEN’S HEARING (Non-Agenda Items Only)
ADOPTION OF RESOLUTIONS:
PB06-03F – Owner/Applicant Stone Creek Realty, LLC, Block 76, Lot 4 also known as Arlington Estates. The matter was heard and considered at a public hearing held on July 14, 2008 at which time the Board rendered its decision to approve the Final Major Subdivision with conditions. This resolution is intended to memorialize the same in accordance with N.J.S.A.40:55D-10(g)(2).

Actionable
Applicant proposes to subdivide 5.4620 acres in R-65 zone into three (3) building lots with probability of construction of new homes prior to sale. Applicant is seeking variance relief for lot width – Minimum lot width required 150, proposed lot 33.01 = 141.21’; proposed lot 32.02 – 140’ and proposed lot 32.03 – 140’. Warren Township Sewerage Authority approval has been received by way of Resolution 07-126; Board of Health approval has been granted by way of Resolution 2008-14. Case was heard on April 14, 2008 and carried to May 12, 2008 with no further notice. Case heard on May 12, 2008 and carried to June 23, 2008 with no further notice. Letter from Erwin C. Schnitzer, Esq., dated June 18, 2008 requested case to be carried “indefinitely” to give the applicant time to determine what his plans are for the property. On June 23, 2008 the Board determined it would not grant an indefinite extension, and the case was carried to July 28, 2008 at which time the Board anticipated making a decision. Letter received from Erwin Schnitzer on July 18, 2008 requesting extension of one more month to allow the applicant “to complete his investigation and make his determination accordingly”. Mr. Schnitzer’s letter attached to Board packets as well as previous correspondence relative to this matter.

Applicant is proposing revised Phase II to be in compliance with Somerset County Planning Board approval as per Somerset County Planning Board letter dated January 8, 2008. Proposed Phase II consists of 10 new lots. Phase I and Phase III approvals are not being requested at this time. Revised Final Plat – Phase 2 dated February 13, 2008 has been re-reviewed by the Township Planner and Township Engineer. Updated reports are attached to Board packets, as well as letter from Somerset County dated January 8, 2008 and approved amended resolution 04-06PA memorialized on July 14, 2008 by the Planning Board. To date the applicant has not submitted an application to the Warren Township Sewerage Authority for needed final approval for Phase II.
