Inherent Risk/Assumption of Risks/ Liability Release

I, ______, acknowledge and accept that horseback riding and activities related to horses, involve the risk of personal injury. By my signature, (and, in cases of a minor, the parent’s or guardian’s signature), they and I, hereby waive all rights, if any, claims, causes of action and lawsuits against Meghan Bourque, her family, heirs, executors, legal representatives, administrators, successors, assigns, guests, employees, or agents affiliated with any of them in any manner (collectively, herein for “A Touch of Majic Equestrian or “Meghan Bourque”), for any injury, liability or damages which may occur while riding any horse, whether leased or owned by me or by any other person, or for any injury or damages which may occur while participating in any activity related to horseback riding. I agree to indemnify, defend and hold harmless Meghan Bourque, A Touch of Majic Equestrian Center, agent or representative, for any accident, injury, or loss that might occur, and free such persons from all liability for such injury or loss. I understand that horseback riding always involves the use of an unpredictable animal and I ride at my own risk.

MA State Law regarding Equine Participants:

Under Massachusetts law, an equine professional is not liable for an injury to, or the death of, a participant in equine activities resulting from the inherent risks of equine activities, pursuant to section 2D of chapter 128 of the General Laws.

I agree to take full responsibility for myself and the animal I am riding. I am aware that wearing a certified safety helmet and a boot or shoe with a heel is a requirement for A Touch of Majic Equestrian.

Cancellation Policy

Any lesson that is not cancelled 48 hours prior to scheduled time will be billed to client at the full lesson price. This is done to keep it fair as A Touch of Majic Equestrian now has a waiting list and, if given proper notice, the time slot may be filled. Any and all lessons cancelled by instructor are not subject to penalty and will be rescheduled at client’s convenience. Instructor will decide if lessons must be cancelled due to animal well-being, severe weather, or related instance. Lessons due to these conditions will be made up to the student or credited to their account.

Abuse and/or Mistreatment of Animals/Humans

A Touch of Majic Equestrian is an abuse - free zone for bothanimals and humans. Please understand your instructor is a MA STATE MANDATED REPORTERand if deemed necessary, is required by law to report any and all assumptions of child abuse, neglect, or “child in need of services.” Furthermore, any

person found abusing or mistreating an animal under the care of A Touch of Majic Equestrian will be fined $2,000 (Payable to A Touch of Majic Equestrian) and will be reported to the proper state agencies. He or she will then be dismissed from the program. Abuse of an animal is considered but not limited to : excessive use of force, purposely maiming or injuring an animal, and/or withholding food and or starving said animal, mistreatment of animal under saddle by means of excessive whip/ spur use, excessive shank use, tie downs, pushing an exhausted horse onward under saddle, tying a horse in his or her stall for long periods of time or overnight so as to keep an animal standing, tying a horses head “around” improperly, and any other actions that deem inappropriate of horseman – like conduct. Any participant found abusing an animal will also be held responsible for said animal’s medical bills stemming from such abuse should it so apply.

Safe Zone – A Touch of Majic Equestrian Center is a “safe place” for all riders regardless of sex, race, sexual orientation, ethnic background, and socio or economic status. Bullying, hazing, teasing, or “gossip” will not be tolerated around this stable. Should a student be found acting in a non-sportsmanship type manner or be caught bullying another individual, he or she will face consequences set fourth by the program and Meghan Bourque and may be asked to leave the facility at once. Students or boarders asked to vacate the premises will do so at their own risk and will forfeit any and all fees associated with their presence at A Touch of Majic Equestrian Center.

Medical Release Horse/Rider

I further agreeto allow and be financially responsible for any necessary emergency medical treatment by any available physician at any available medical institution in the event of my injury or illness. I likewise agree to allow and be financially responsibility for any necessary veterinary treatment for the horse that I ride*. (*Only applicable for horses ridden off premises or not under the supervision of handlers/instructor, this does not include while having a lesson unless animal is purposely mistreated by rider).
