Notice of Matters before the Secretary of Environmental Affairs

This Environmental Monitor, the Fifthissue in Volume 57 of a series, is intended to provide notice of all submissions received by the Executive Office of Environmental Affairs (EOEA) under Massachusetts General Laws, Chapter 30, Sections 62 through 62H inclusive, in the period December 18, 2001 through December 31, 2001.

One of the major purposes of giving public notice is to provide an opportunity for public comments on matters before the Secretary. Such public comments are vital to an effective system of environmental review and planning. Comments should be sent directly to the Secretary with a copy to the submitting person or agency. Failure to notify the Secretary and the submitting agency may result in comments not being considered.

Copies of Environmental Notification Forms (ENFs) or Environmental Impact Reports (EIRs) noticed in the Monitor are required to be made available to the public by the person or agency which submitted them to this office. The name and address of the contact person for copies appear at the bottom of the page of each ENF appearing in the Monitor.

Pursuant to 301 CMR Section 11:05 (1) of the MEPA Regulations, persons and agencies filing with MEPA are required to submit copies of review documents to regional planning authorities and other agencies at the same time the reports are submitted to the MEPA Office.

Commenting on Documents

All comments on ENFs and EIRs must refer to the EOEA file number. This number appears on the upper right corner of the ENF or on the list of available Draft and Final EIRs (EOEA# 11000 for example). There may be other identifying numbers, but the EOEA file number is the one that must be used. Comments that do not refer to the EOEA file number may not be considered.

All comments must be received during the comment period, which for ENFs ends 20 days following the publication date of this Monitor. All mail concerning the environmental impact review process including filings, comments, and all associated materials must be addressed to:

NOTICE OF PROJECT CHANGE FORM

With assistance from state agencies and the proponent community, the MEPA Office has developed a form for Notices of Project Change. A copy of the form and directions for its use are available at the MEPA web site ( Notices of Project Change filed with the MEPA Office on or after August 1, 2001 must use the new form. Please contact the MEPA Office with questions about the form.

Submitting Notices to The Environmental Monitor

Miscellaneous notices to be published in the Environmental Monitor may be submitted in print or electronic format. They should be accompanied by a cover letter or email with the name and telephone number or email address of a contact person.

If submitted in print format, the notice must be in 12 point or larger type. If submitted via email attachment, the notice should be formatted as a Microsoft Word document.

We cannot accept notices via FAX, as the quality often is inadequate when reproduced in the Monitor.
