Solution: Abolish “The Feres Doctrine”

IN 1945:

Our U.S. Constitution says that NO Government will have Sovereign Immunity over its own people. As perfect as this was it all changed IN 1950 when Justice Robert Jackson changes our Constitutional Values by deciding common issues under the Tort Claims Act as to which Courts of Appeals are in conflict by making it appropriate to consider three case in one opinion. “The Feres Case” “The Jefferson Case” & “The Griggs Case” In summery ALL cases the government claimed Sovereign Amenity over ALL those that served in the Armed forces as a certain class of people in the United States the U.S. Constitution does not work for; “All those legally inducted into Armed Forces” as they ALL will be banned and bared from taken legal action against gross criminal negligence caused by the “Abuses of Federal Employees” Titled “The Feres Doctrine of 1950. General Smedley Buttler in 1936 knew what would happen to PFC Rustan December 2, 1969 once medical care was needed in Army Hospitals as he wrote the article WAR and MEMORY “Picking Up the Pieces of PTSD.” Over 150,000 Vietnam Veterans have committed Suicide since the end of the Vietnam War

January 28, 1968- Mr. Robin J. Rustan was drafted into the U.S. Army. Spending basic training from January to April 1968 at Fort Ord, California, PFC Rustan was then ordered in April of 1968 to report to Company A, 1st 66 Armor, 2nd Armored AD, Fort HoodTexas. MOS 6502 Tank Mechanic and would be his first and last duty station after basic training.

PFC Rustan volunteered to go to Vietnam while serving at FortHood. After 9 months at serving duty at FortHood, one day would be different from any other day in PFC Rustan’s life.

On December 2, 1969 while on training maneuver PFC Rustan suffered a major injury that came close to taking his life, after being crushed by the main gun while doing firing exercises PFC Rustan was denied medical care after being crushed inside a M-45 tank.

On December 7, 1969 while in traction at Fort Hood Darnell Army Hospital Company Commander FA Amerose T. Nathe ordered PFC Rustan to Vietnam from a Hospital Bed with orders to report to RVN training exercises to be deployed to Vietnam ASAP.

Released with no medical care and NO Neck Brace only a bottle of pain pills and orders to report to Vietnam PFC Rustan was expected to report to RVN Training Detachment Center on February 6, 1970. The RVN sign up was on February 14, 1970 with a training schedule that would last 6 days of intense training that would take a solider into classes starting with Jungle Survival, Military Intelligence and Handling of POW’s, Duties of a Sentry & Perimeter, Defense VC Techniques & Lessons learned, Communications Security, Roll Call, Mvt to RVN Village, Ambush & Immediate Action, Foot Ambush, Dinner, Helicopter Safety Air Assault and MEDEVAC Demonstration, Mobile Ambush, more of the same and so forth. PFC Rustan was ordered to do all this with a broken neck. On February 6, 1970 Captain Robert E. Porter RVN Training Detachment Center would hand over PFC Rustans last set of Direct Orders. From this point on PFC Rustan would refuse all orders to go to Vietnam and eventually went AWOL from all this madness before reporting to the Mental Health System at Fort Hood, Texas.

On March 9, 1970 more abuse’s would start with the Mental Health Care System after being sent to Psychiatry for Army to cover up medical abuses suffered again by ignoring PFC Rustans health care by covering up the malpractice regarding PFC Rustan’s broken neck. The Army

Doctors would label PFC Rustan with Psych disorders in first interview with Mr. Parvo, stated for the record PFC Rustan suffers form “Impression: Situational Stress Reaction Disorder” Darnel Army Hospital Mental Health covering up serious cervical spine injures with the Mental Health System leaving PFC Rustan no other choice but to go AWOL from Fort Hood, Texas.

Once leaving Fort Hood, Texas PFC Rustan was AWOL landing in his home State of California where he planned on obtaining real medical care for his serious injury. His Plan A: was to check in as a patient with one of the best neurosurgeon in Newport Beach. This meeting took place with Dr. Alverez confirming the fact that emergency medical care is needed however since PFC Rustan was Active Duty he was considered “Government Property” therefore Dr. Alverez advised PFC Rustan to seek more medical care in military hospitals? Again left with NO Neck Brace and NO Medical Care Possibly go to the VA Hospitals?

Plan B: PFC Rustan was to check into Veterans HospitalVALong Beach ER room for emergency treatment. Once there Long Beach VA refused to stabilize PFC Rustan by breaking their own VA guidelines by rejecting PFC Rustan’s request to take care of his medical needs at the VA Hospital the VA broke their own Human Rights Clause that allowed them to take care of any American that was in serious injury on a one time basiswhile in the ER Room was to stabilize any American before they let them go to a different outlet for follow up medical care. VA ER room told PFC Rustan in March of 1970 by ER doctors,” that we do not work on ACTIVE DUTY soldiers only veterans at this facilities” Again leaving a government hospital with no neck brace making this mistake stopped all hope of medical care. Whileat the same time In the California State Penitentiary Death Row inmates have more of a right to medical care than Armed Forces Personal as one inmate was given a Kidney transplant with California Taxpayers money $140,00 for emergency care so they could keep this murderer alive long enough to Execute him on said date ordered by the California Courts.

The Chilling Effects of the Feres Doctrine hit PFC Rustan where it hurts. NO Medical Care after the mistreatment and abuses the government then looked upon this injured and once dedicated American soldier as a criminal. Concerned for PFC Rustan’s mental health and welfare, his parents wrote members of the House of Representatives and Senate on his behalf, some responses came back came back but the truth of the matter, Congress during Vietnam and even today do not have to address injury or injustice arising out of the military due to the Feres Doctrine from the abuses of federal employees.

ON March 13,1970, PFC Rustan reported to a medical interview per Senator Murphy request to get a fair evaluation of medical conditions at Letterman’s Hospital. After arriving PFC Rustan had NO medical intervention was ordered by Orthopedic Doctor to hit the floor and put out 10 push-ups like in basic training. Unable to follow through with quack interview PFC Rustan was arrested and held at Oakland Detachment Center and eventually escorted by Medic and M.P. in HANDCUFFS to Vietnam, still with NO Neck Brace now a political prisoner of the FERES Doctrine.

Once in the air the Handcuffs were removed by M.P. and PFC Rustans conditions was noticed by Medic as very critical and once landed in Hawaii was released by M.P. for medical care at TripletHospital. Taken off plane with a gurney, while all others waited for airplane to refuel for Vietnam PFC Rustan stayed in medical care in Hawaii temporally and at this time PFC Rustan was given his first Neck Brace since December 2, 1969.3 months 11 days with NO Cervical Neck Brace abuses suffered by the hands of federal employees should be in Prison for those that are in violation of our human rights as Americans. No way should we be treated like a 2nd class citizen.

On March 20, 1970 PFC Rustan was at Schofield barracks and was seen one more time by an alleged mental health expert, Major MSC Robert J. Kozukil. Major Kozukil state that he saw no reason to retain him, however he stated that if PFC Rustan does not perform his duties in Vietnam effectively that he would be considered for a General Discharge. The M.P. and medic released him into the custody of TripletHospital only to be sent to Vietnam with more pain pills the only difference this time is that PFC Rustan had a neck brace.

Once in Vietnam, PFC Rustan ended up going AWOL to seek medical care and found 93rd Evacuation Hospital, Unlike the command and control officers who had no concern for PFC Rustan, the military doctors seen by PFC Rustan were angry at the fact that the U.S. Army was sending unfit soldiers to Vietnam. Finally PFC Rustan was medically separated where he has lived a life of pain like all other Vietnam veterans that were forgotten as we are Veterans truly without a Country.

PFC Rustan realized that he had to get rid of the hate to rehabilitate and found MWR Recreational Facilities to be a tranquil place to camp and enjoy 1970 to 1990. END

ONCE HOME AMERICAN VETERANS WERE SLAMMED AGAIN BY THE PETAGON AFTER HAVING 20 YEARS OF ACCESS WERE TOLD TO LEAVE MWR RECREATIONAL FACILITIES WHICH LED TO LEGISLATIVE BATTLE TO OPEN UP MWR LANDS WITH H.R.BILL 1917 WHICH IS NOT A SPONSORED BILL IN 2005. DROPED BY CONGRESSMAN BOB FILNER BECAUSE OF LACK OF INTEREST AFTER SPONSORING H.R.1917 2000 TO 2004 WITH NO VOTE FROM ARMED SERVICES COMMITTEE? MWR WAS A PERFECT PLACE TO WORK OUT PTSD.OERATION FIRING FOR EFFECT WANTS MADITROY FUNDING FOR H.R.1917 BECAUSE IT’S OUR LAND TO ENJOY ONCE WE RETURN HOME FROM ANY CONFLICT OF WAR.
