Village Council Special Meeting

July 5, 2017 – 7:00 P.M.

NOTE: A tape recording of the session was attempted but the tape recorder failed to continue to operate and Trustee Sleva volunteered to scribe minutes.

President Wills called the meeting to order at 7:04 p.m. The Pledge of Allegiance followed.

Roll Call:

Trustees Present: Butzu, Dylus, Eschmann, Skornicka, Sleva, Wills Others Present: David Trent, Ortonville Village Manager

Absent: Brice (with notice)

Approval of Agenda:

Motion by TrusteeSkornicka seconded by TrusteeDylus to approve the agenda as amended to change Closed Session A. Village Manger Performance Concerns

All in favor, motion carried.

Public Comment: none, no public was present.

Closed Session

Motion by TrusteeButzu. seconded by TrusteeEschmannthat the Village Council go into Closed Session at 7:14 p.m. pursuant to MCL 15.268 (8)(a) for discussion of job performance concerns with Ortonville Village Manager, David Trent with his concurrence.

Roll Call:

Ayes: Butzu, Dylus, Eschmann, Sleva, Skornicka, Wills

Nays: none

Absent: Brice, absent with notice

The Special Village Council meeting adjourned the Open Session meeting at 7:14 p.m.

Motion by Trustee Butzu, seconded byTrustee Eschmann to reconvene to open session at 8:55 p.m.

All in favor, motion carried.

Motion by Trustee Butzu, secondedTrustee Eschmann, that Manager Trent submit his letter of resignation effective immediately to the Village Council tonight,

July 5, 2017.

President Wills and Trustee Dyluseach stated that Manager Trent should be given more time before being asked to resign. Trustee Dylus suggested 90 days and if drastic changes don’t occur then we can take action; also stated it is hard to find help. TrusteesButzu, Skornicka, Sleva and Eschmann disagreed. Manager Trent has known about most of the concerns since April and nothing has changed.

Ayes: Butzu, Eschmann, Sleva, Skornicka

Nays: Dylus, Wills

Absent: Brice, absent with notice

Motion carried; 4 Ayes, 2 Nays.

Manager Trent left the conference room to type his letter of resignation; however, he returned approximately 10 minutes later and requested to turn it in tomorrow morning, July 6, 2017. He stated that he was not expecting this and would like some time to mull it over; if there was severance available.

Motion withdrawn after Manager Trent refused to resign.

Motion by Trustee Butzu, seconded by Eschmann to terminate Manager Trent as Ortonville Village Manager effective immediately, July 5, 2017.

President Wills then stated that he would not be able to assume the duties of the Village Manager during the transition period for lack of time available as well as surgery scheduled for next week.

President ProTem Eschmann stated that he would assume the duties on the interim basis.

Ayes: Eschmann, Butzu, Skornicka, Sleva

Nays: Wills, Dylus

Absent: Brice, absent with notice

Motion carried; 4 Ayes, 2 Nays

President Wills asked Trustee Skornicka to secure computer and passwords as IT Committee.

Personnel committee member, Trustee Skornicka requestedDavid Trent to turn in his keys, computer and passwords and any other village property.

David Trent asked to return tomorrow July 6, 2017 to get his personal items from the office.
