Contractor shall download, fill in Bid Capacity Assessment Form, Bid (Tender) documents and upload the same on the said web-site. Demand Drafts drawn on nationalized / scheduled bank in name of Executive Engineer, Gosikhurd Lift Irrigation Division, Ambadi,(Bhandara) for amount equivalent for cost of Bid Capacity Assessment Form, and Bid (Tender) documents (for this D.D. for EMD also) must physically reach to the offices of Executive Engineer and Superintending Engineer, respectively as mentioned at Sr. No. 5 & 8 as below. However, scanned copies ofrespective D.D’s. shall be uploaded on the web-site at time submission of Bid Capacity Assessment Form, and Bid (Tender) documents. Volumes of Bid Capacity Booklet or Bid Documents shall not be sold physically by the department.
Contractor shall bear whole required amount of Stamp Duty on Works Contract, as per Mumbai Stamp Duty Act 1958 Clause 34at the prevailing rates. No claim against this shall be considered and if the contractor fails to bear this amount acceptance of the tender shall be null and void..
The Bid Capacity of the contractors will be assessed by the Bid Capacity Assessment Committee on the basis of contents in Bid Capacity Assessment Form submitted on-line. Bid (Tender) documents shall be made available on the web-site to only contractors those have been short-listed as qualified for bidding. The qualified contractors will be informed on web-site. Sir,
e-tenders are invited on line for the work mentioned above. The blank tender forms will be made available on the Government of Maharashtra website ( through Sub-Portal of only to those contractors who satisfy bid capacity conditions as mentioned here after.
1)The contractor should be registered in class III and above with Govt. of Maharashtra in Public Works Department.
2)For the assessment of bid capacity, prospective bidders should submit by uploadingon line information about the works carried out by them in last five years as well as programme of balance work in the prescribed proforma (Proforma No.1) attached herewith duly signed by Executive Engineer-in-charge of work.
The bid capacity will be calculated in the following manner.
Bid Capacity = (A x N x 2) – B
Where, A = Maximum value of Civil Engineering works executed in any one year during the last five years. (Updated to the current C.S.R. level) which will take into account the completed and on going works.
Cost of completed works in earlier years shall be given additional weightage of 10% per year as illustrated below to bring it to current price level.

Bid Capacity Assessment Form, Bid (Tender)Document, Estimate of the workare available on the Government of Maharashtra website ( through Sub-Portal of The competent authority reserves all rights of rejecting any one or all tenders without assigning any reason.
- Bid Capacity documents will be available on Government of Maharashtra website ( through Sub Portal of from and within dates and time mentioned and the bidder has to submit the Bid Capacity Assessment Documents and Information online as per key dates and time mentioned below.
- For the cost of Bid Capacity Assessment Form it is necessary to draw the Demand Draft of in favour of "Executive Engineer, Gosikhurd Lift Irrigation Division, Ambadi (Bhandara),''The said DD must be scanned and uploaded while submitting the Bid Capacity assessment form, duly filled in. Hard copy of Bid Capacity Assessment Form, shall be physically (in form of bound volume) submittedalong with D.D. before last date and time of on-line Re-encryption of Bid Capacity Assessment Form, as mentioned in ‘Key Dates’.
Otherwise the documents loaded on site cannot be considered and shall be
treated as non-responsive.for evaluation.
- Only those contractors who are short listed in Bid Capacity-qualification stage are eligible for participating in main tendering process. - It is necessary to give the undertaking as follows " Contractors are not allowed to make any change in tender documents downloaded from website. If it is found so the tender of such contractors shall be rejected and the contractors who made such changes are liable for action as per Rules''. Tender documents published on Government website are considered as an authentic and legal documents in case of any complaint about the tender.
- It is necessary to give undertaking as follows "I have seen and studied detailed drawings of works on website. It is part of tender documents. I have filled in and submitted the tender by considering all these drawings. I am ready to sign on the all drawings before depositing initial security deposit and taking work order, if my tender be accepted.”

- For submitting the bids online, the contractors/bidders are required to make online payment using the electronic payments gateway service Bid Submission Fee Rs 1024/-. The different modes of electronic payments accepted on the ETMS is available and can be viewed online on the ETMS Website (httip://maharashtra.etenders.in).
- The activities of tender document purchase/Download, preparation of bid (submit Bid Hash online), submission of bids, submission of EMD and other documents shall be governed by the time schedules given under “Key Dates”.

Guidelines to Contractors Regarding Government of Maharashtra e-tendering system
- These conditions will overrule the conditions stated in the Tender Documents, wherever relevant and applicable. However, in case of dispute on any contradictory meaning of two or more clauses, decision of the Superintending Engineer shall be final and binding on both parties.
- Registration of the Contractors:
The Contractors registered with Government Of Maharashtra, Public Works Department, in appropriate class of contractors, are eligible to participate in Open Tenders process and are required to get enrolled on the Portal and get empanelled in relevant sub portal. After submitting their enrollment request online, the enrollment shall be required to be approved by the Representative of the Service Provider. After the approval of enrollment, the Contractors shall have to apply for empanelment online which shall be required to be approved by the Nominated Authority of the Department. Only after the approval in the relevant Class, the Contractor shall be able to participate in the Open Tenders online.
Maharashtra may process OPEN Tenders in which eligible Contractors may enroll on the Portal in OPEN category to participate in such Tenders. The online Enrollment of such Contractors shall be required to be approved by the Representative of the Service Provider.
The approval of enrollment of Contractors is done by the Representative of the Service Provider upon submission of mandatory documents by the Contractors. The Contractors may obtain the list and formats of required documents from the Nodal Officer of e-Tendering System for Government of Maharashtra / Service Provider.
- Obtaining a Class II – Digital Signature Certificate:
The Bids required to be submitted online should be signed electronically with a Class II –Digital Signature Certificate to establish the identity of the Bidder bidding online. These Digital Certificates are issued by an approved Certifying Authority, authorized by the Controller of Certifying Authorities, Government of India.
A Digital Signature Certificate may be used in the name of Authorised Representative of the Organisation. A Digital Certificate is issued upon receipt of mandatory identity proofs. Only upon the receipt of the required documents, a Digital Signature Certificate can be issued.
Bid for a particular Tender may be submitted only using the Digital Signature Certificate, which is used to encrypt the data and sign the hash during the stage of Bid Preparation and Hash Submission. In case, during the process of a particular Tender, the Authorised User loses his / her Digital Signature Certificate (i.e. due to virus attack, hardware problem, operating system problem etc.); he / she may not be able to submit the Bid online. Hence, the Authorised User is advised to back up his /
her Digital Signature Certificate and keep the copies at safe place under proper security to be used in case of emergencies.
