VERSION FOR THE STATE (A)
I, the undersigned
ALEX SIBIYA
Hereby state under oath that:
1.
I am an adult male/female cashier residing at 24 Hislop Street in Humewood, Port Elizabeth.
2.
On 23/06/2013 I went to Greenacres Shopping Centre to do some shopping.
3.
The car park was very full so I drove around for a long time looking for parking.
4.
When I drove past the front of the mall for the third time I saw a lady packing her shopping into her car from her trolley so I knew that she was going to leave soon.
5.
I put my indicator on to the left and I waited for her to finish packing her shopping bags into her car and reverse.
6.
She then reversed out to her left which meant she was blocking me so I couldn’t drive in to the parking until she drove away.
7.
Just after she reversed another car came from the other side and drove straight into the parking bay I was waiting for.
8.
I immediately hooted at the other car but the driver just waved his hand at me.
9.
I got out of my car and walked up to his/her window. I knocked on the window. I just wanted to talk to him/her/her and ask him to get out of my parking bay.
10.
The other driver then also got out of his/her car and told me that he/she is not going to reverse his/her car and that it was “finders keepers”.
11.
I then pointed my finger at him/her and told him/her that he/she was rude.
12.
The other driver then hit me in the fact so I picked up a stone and pretended I was going to throw it at him/her.I just wanted to scare him/her so he/she wouldn’t hit me again.
13.
When I pretended to throw the stone at him/her it accidently slipped out of my hand and hit him/her on the head.
14.
I tried to explain that it was an accident but he/she wouldn’t listen to me. He/she then ran into the shopping centre.
15.
I know and understand the contents of this declaration.
I do not have an objection to taking the prescribed oath.
I consider the prescribed oath to be binding on my conscience.
