Mayor Moslowski called the meeting to order at 8:05 p.m. and requested the Clerk to call the roll. The following Committee Members were present: Mr. Alexander, Mr. Robert Faber, Dr. Robert A. Frascella, Ms. LoriSue H. Mount and Mayor Moslowski Jr. Also present at the dais: Dana L. Tyler, Municipal Clerk, Dianne Kelly, CFO/Administrator, Dennis A. Collins Esq. Township Attorney.
Following the Flag Salute, the Clerk announced that the Notice requirements of R.S. 10:4-18 for an "Annual Notice" had been satisfied by the publication of the required advertisement in the Asbury Park Press and the Messenger Press January 9, 2014 posting the notice on the Board in the Upper Freehold Township Municipal Building and filing a copy of said notice with the Municipal Clerk.

RESOLUTION 50 -15 A RESOLUTION APPOINTING A EMERGENCY MANAGEMENT COORDINATOR
The following Resolution was offered by Dr. Frascella, moved and seconded by Mr. Alexander.
WHEREAS, the Township advertised and posted a position for an Emergency Management Coordinator, and,
WHEREAS, the Administrator has recommended that James Rosenbauer, a qualified applicant to fill the part-time position, with an annual salary of $6,242 for three year with no health benefits, no paid sick days, vacation days and personal days effective January 1, 2015.
WHEREAS, funds for this purpose will be provided for in the first three (3) months of 2015 in the 2015 Temporary Budget and funds for the balance of 2015 will be provided for in the Budget for the year 2015 when finally adopted and the Upper Freehold Township Administrator/Chief Financial Officer has so certified in writing.
NOW THEREFORE BE IT RESOLVED that the Township Committee of Upper Freehold Township does hereby appoint James Rosenbauer to the part-time position of Emergency Management Coordinator, effective January 1, 2015 at an annual salary or $6,242 for three years.
BE IT FURTHER REESOLVED that a certified copy of this resolution be forwarded to the Upper Freehold Township Administrator/Chief Financial Officer and James Rosenbauer.

WHEREAS, the following resolutions having heretofore been placed on this agenda require no discussion and same having been previously reviewed by the members of the Township Committee be and are hereby adopted. resolution 51-15 a resolution hiring a substitute acting plumbing sub-code official
WHEREAS, there is occasion to need coverage for Plumbing Sub-Code Official throughout the year; and,
WHEREAS, funds are available to hire a Substitute Sub-Code Official to fill the position as needed through 2015, at a hourly rate of $25.00 in the Account known as UCC Plumbing Official Salaries & Wages, Number 15-01-22-195-014 and the Chief Financial Officer has so certified in writing.
NOW THEREFORE BE IT RESOLVED Michael Benson, a qualified Plumbing Sub-Code Official, NJ License # 4214 and Stephen L. Germann, NJ License #8475 be and are hereby appointed to the position of Acting Plumbing Sub-Code Official for coverage on an “as needed” basis throughout 2015.

WHEREAS, there is occasion to need coverage for Electrical Sub-Code Official throughout the year 2015; and,
WHEREAS, funds are available to hire a Substitute Sub-Code Official to fill the position as needed through 2015 at a hourly rate of $25.00 in the Account known as UCC Electrical Official Salaries & Wages, Number 15-01-22-195-015 and the Chief Financial Officer has so certified in writing.
NOW THEREFORE BE IT RESOLVED Richard Such, NJ License # 00944 and George Conley, NJ License #4510, is are qualified Electrical Sub-Code Officials, be and are hereby appointed to the position of Acting Electrical Sub-Code Official for the time that Alan Wilkins is on vacation and for coverage on an “as needed” basis throughout 2015.

RESOLUTION 53-15 A RESOLUTION HIRING A SUBSTITUTE ACTING CONSTRUCTION OFFICIAL, BUILDING SUB-CODE OFFICIAL AND FIRE SUB-CODE OFFICIAL
WHEREAS, there is on occasion to need coverage for Construction Official and Building Sub-Code Official throughout the year 2015; and,
WHEREAS, funds are available to hire a Substitute Sub-Code Official to fill the position as needed through 2015, at a hourly rate of $25.00 in the Account known as UCC Building Inspector Salaries & Wages, Number 15-01-22-195-013 and the Chief Financial Officer has so certified in writing.
NOW THEREFORE BE IT RESOLVED Glenn Riccardi, qualified Construction Official, Building Sub-Code Official, and Fire Sub-code Official with the required NJ Licenses be and is hereby appointed to the position of Acting Construction Official, Building Sub-Code Official and Fire Sub-Code Official for the time that Ronald Gafgen is on vacation and for coverage on an “as needed” basis throughout 2015 at a hourly rate of $25.00.

RESOLUTION 54–15A RESOLUTION RECERTIFYING FUNDS FOR INTERLOCAL AGREEMENT WITH MONMOUTH COUNTY FOR COMPUTER SERVICES FOR THE MOD IV SYSTEM
WHEREAS, the Township Committee of Upper Freehold Township entered into a ten (10) year Interlocal Agreement with Monmouth County for participation in the county's system of maintaining and reporting real estate tax information for municipalities and counties throughout the state, commonly known as the MOD IV Tax System, for the period 1/1/2012 through 12/31/2021; and,
NOW, THEREFORE, BE IT RESOLVED that funds for this purpose will be provided for in the first three months of 2015 in the 2015 Temporary Budget and funds for the balance of 2015 will be provided for in the Budget for the Year 2015 when finally adopted, and the Chief Financial Officer has so certified in writing.
BE IT FURTHER RESOLVED, that a copy of this resolution be forwarded to the Chief Financial Officer/Treasurer and Tax Assessor.
RESOLUTION 55-15 A RESOLUTION AUTHORIZING THE EXECUTION OF AN
AGREEMENT WITH MONMOUTH COUNTY IN CONNECTION WITH SCAT SERVICES
WHEREAS, The Township of Upper Freehold has previously contracted with Monmouth County for services known as Special Citizens Area Transportation System (SCAT); and,
WHEREAS, it is in the best interest of the residents of this Municipality that the Township of Upper Freehold once again enter into an agreement for these services for the Year 2015 at the rate of $78.00 per half day, one half day per week; and,
WHEREAS, funds for this purpose will be provided for in the first three months of 2015 in the 2015 Temporary Budget and funds for the balance of 2015 will be provided for in the Budget for the Year 2015 when finally adopted, and the Chief Financial Officer/Treasurer as so certified in writing.
THEREFORE, BE IT RESOLVED, that the Mayor and Clerk be and are hereby authorized to sign the agreement for SCAT services for the Year 2015.
BE IT FURTHER RESOLVED, that a copy of this resolution be forwarded to the Upper Freehold Township Chief Financial Officer and the Director of Monmouth County Special Citizens Area Transportation.
RESOLUTION 56-15 A RESOLUTION ADOPTING THE INTERNAL CONTROL HANDBOOK FOR 2015 CALENDAR YEAR
WHEREAS, the Township of Upper Freehold does not currently have formal written policies and procedures with regard to the internal control system over financial processing and,
WHEREAS the Township of Upper Freehold auditor, Bowman & Company has recommended that the Township formally document its existing internal control system and,
WHEREAS the Township’s governing body and Chief Financial Officer feel that it is in the best interests of the Township’s residents to approve written internal control procedures to ensure the integrity of its financial system and,
WHEREAS the Chief Financial Officer has prepared a written Internal Control Policy Manual and presented such to the governing body,
NOW, THEREFORE, BE IT RESOLVED, that the Upper Freehold Township governing body does hereby approve the Internal Control Policy Manual and,
NOW, THEREFORE, BE IT FURTHER RESOLVED that such Internal Control Policy Manual be distributed to all employees.
RESOLUITON 57-15 A RESOLUTION SETTING THE MILEAGE REIMBURSEMENT RATE
WHEREAS, the Township of Upper Freehold Personnel Policy states that mileage will be reimbursed at the “prevailing rate”; and,
WHEREAS, beginning January 1, 2015 the Internal Revenue Service has establishes the yearly mileage rate for business miles driven; and,
WHEREAS, The Chief Financial Officer has recommended that Upper Freehold Township change the rate paid to personnel to the “prevailing rate” in accordance with the Upper Freehold Township requirement of the Personnel Policies and Procedures, Section 9-21.2; and,
NOW, THEREFORE, BE IT RESOLVED, by the Township Committee of the Township of Upper Freehold, County of Monmouth, State of New Jersey that the mileage reimbursement rate in accordance with the Personnel Policy and Procedures be adjusted to reflect the “prevailing rate”, effective throughout the year of 2015; and,
BE IT FURTHER RESOLVED, that a certified copy of this resolution be forwarded to the Chief Financial Officer/Treasurer and Business Administrator.
RESOLUTION 58-15 A RESOLUTION AUTHORIZING THE EXECUTION OF A SHARED SERVICES AGREEMENT WITH THE TOWNSHIP OF ROBBINSVILLE IN CONNECTION WITH AUTOMOTIVE REPAIR SERVICES
WHEREAS, The Township of Upper Freehold desires to enter into a shared service agreement with the Township of Robbinsville for the provision of automotive repair services for the UFT’s vehicles and equipment; and,
WHEREAS, the Uniform Shared Services and Consolidation Act, N.J.S.A. 40A:65-1 et seq., permits local units of the State to enter into an agreement with any other local unit for the joint provision within their combined jurisdictions for any service which any party to the agreement is empowered to render within its own jurisdiction.
WHEREAS, it is in the best interests of the residents of this Municipality that the Township of Upper Freehold enter into an agreement for these services for the period January 1, 2015 – December 31, 2015 at the labor rate of $60.00 per man hour and 10% over Township of Robbinsville’s cost for all repair parts and sublet parts. No charge will be made for parts, which are supplied by UpperFreeholdTownship, and,
WHEREAS, funds for this purpose is provided for in the 2015 Budget and funds for the balance of 2015 will be provided for in the Budget for the Year 2015 when finally adopted, and the Chief Financial Officer/Treasurer as so certified in writing.
THEREFORE, BE IT RESOLVED, that the Mayor and Clerk be and are hereby authorized to sign the agreement for automotive repair services for the period of
January 1, 2015 – December 31, 2015.
BE IT FURTHER RESOLVED, that a copy of this resolution be forwarded to the Upper Freehold Township Chief Financial Officer, Purchasing Agent, and the Township of Robbinsville.
RESOLUTION 59-15 A RESOLUTION AUTHORIZING THE CHIEF FINANCIAL OFFER TO REFUND COAH DEVELOPMENT FEES – BLOCK 42.01 LOT 4
WHEREAS, the owners of Block 42.01, Lot 4 paid a COAH Fee in accordance with the Township’s Affordable Housing Ordinance in the amount of $441.00 based on 50% of 1-1/2% of the estimated value of the addition; and,
WHEREAS, upon completion of the addition and prior to a certificate of occupancy being issued, a final equalized value for COAH is determined by the tax assessor; and,
WHEREAS, upon final review it was determined by the tax assessor that the final COAH value of the addition was less than the original estimate.
NOW THEREFORE, BE IT RESOLVED, that the Township Committee of Upper Freehold Township does herby authorize the Chief Financial Officer to refund $294.00 COAH fee to Mr. John Solewin the owner of Block 42.01 Lot 4 in Upper Freehold Township which was computed as follows:
Estimate at permit – paid 08/11/2014 $ 441.00 based on $58,800.00 X 1.5% ÷ 2
Valued at final review – 12/15/2014 $ 147.00 based on $ 9,800.00 X 1.5%
Correct Amount at permit - $9,800.00 x 1.5% ÷ 2 = $ 73.50
Correct Amount at CO - $9,800.00 x 1.5% ÷ 2 = $ 73.50
Total amount $147.00 Less $441.00 paid = $294.00 over payment
RESOLUTION 60-15 A RESOLUTION APPOINTING STAFF TO THE UPPER FREEHOLD TOWNSHIP BUREAU OF FIRE PREVENTION
WHEREAS, it is necessary to appoint and reappoint staff to the Upper Freehold Township Bureau of Fire Prevention; and,
WHEREAS, said appointments are made in accordance with the Revised General Code of Upper Freehold Township Section 14.2.4.

DISCUSSION:
Reed Recreation Wall – Lacrosse is requesting permission to build a throwing wall at the Reed Recreation Area. They will pay for the construction of the wall, it will be approximately 30 feet wide by 15 feet high. The Township Committee is requesting that the wall be painted a color that blends with the area, and the Administrator/CFO will contact the Township’s insurance company to see if there are any restrictions.
The Recycling Coordinator, Sal Fiorenzo is requesting that Upper Freehold Township host another Paper Shred Event June 20, 2015 from 9:00 am. – 1:00 pm which funded by Monmouth County.
There was a motion offered by Dr. Frascella, to have the Paper Shred Event moved and seconded by Mr. Alexander.

The Township Committee will be attending an Elected Officials Seminar on March 5, 2015 at 6:00 pm. Upper Freehold Township
Recreation Ordinance – There was a lengthy discussion regarding the amount charged for participation fees in our current Ordinance, resident vs. non-resident fees. The Township Committee was against raising the fee, as our residents pay 100% to maintain the field in their tax bill; however the New Jersey Department of Green Acres mandates the resident fee cannot be less than half of the non-resident fee. The Township Committee is against raising the fee for the residents.
ORDINANCE 265-15 – INTRODUCTION
The following Ordinance was offered by Dr. Frascella, moved and seconded by Ms. Mount.
AN ORDINANCE AMENDING AND SUPPLEMENTING SUBSECTION 2A-4.6 ENTITLED “FEES FOR USE OF RECREATION FACILITIES” OF CHAPTER 2A ENTITLED “FEES” OF THE CODE OF THE TOWNSHIP OF UPPER FREEHOLD
BE IT ORDAINED by the Mayor and Committee of the Township of Upper Freehold, County of Monmouth, and State of New Jersey that Chapter IIA (Fees) of the General Ordinances of the Township of Upper Freehold is hereby amended or supplemented as follows:
PURPOSE
The purpose of this ordinance is to modify certain provisions to the Township’s recreation fee ordinance for the use of public parks to comply with State regulation on access fees.
Chapter IIA (Fees) of the General Ordinances of the Township of Upper Freehold is hereby amended or supplemented as follows (new text is double underlined, text to be deleted is struck through and notations to the reader and changes in subparagraph designations either with or without changes to content are italicized):
SECTION 1
Chapter IIA (Land Use Regulations) Article 2A-4 (Recreation Programs) Subsection 2A-4.6 (Fees for Use of Recreation Facilities) shall be amended as follows:

There shall be fees charged to the Upper Freehold-Allentown Little League and Upper Freehold/Allentown Softball; the Upper Freehold-Allentown Soccer Association; the Central Redbirds Pop Warner; AUFAA Lacrosse; Travel teams and other organized groups that regularly schedule games and practices on Upper Freehold Township Recreation Fields including but not limited to those sites known as:
Byron Johnson Recreation Area
Mark Harbourt Soccer Fields
Reed Property
All sports organizations using these facilities will pay Upper Freehold Township a fee based on the number of participants registered for the subject organization at the time of use and upon execution of the required use agreement.
