RULES AND GUIDELINES

INTRODUCTION

The Board of Directors and committees of Upland North Hills Homeowners Association have prepared this booklet for your convenience and guidance. Inside you will find practical rules and guidelines that are intended to help foster a harmonious, enjoyable and safe environment for all homeowners.

Bear in mind that Our Association, and in turn, each homeowner is governed by (1) Declaration of Covenants, Conditions, and Restrictions (CC&Rs), (2) Articles of Incorporation, and (3) By-Laws. These are legal documents and not very user friendly – hence this booklet. By definition, the rules and guidelines given in this booklet flow from our governing documents are in compliance with them. In some areas these rules are the result of years experience and deliberation of the Board of Directors. For those of you who wish to go to the roots of these subjects, we refer you to these specific sections of the CC&Rs: Article VI, Architectural Control: Article VII, Authority of the Association: and Article VIII, User Restrictions. If you have any questions, please submit them to the Property Management Company for consideration by the Board.

Ownership in Upland North Hills not only includes your residence, but also makes you part owner of the common area of the community of Upland North Hills. You are welcome at the regular meetings of the Board of Directors (elected by the Homeowners annually) held on the third Monday of each month.

Homeowners are responsible for seeing that renters of their property comply with all Upland North Hills policies and rules and regulations. We suggest that this booklet may be helpful to your family, guests and renters.

ARCHITECTURAL RULES

Homeowners MUST have the approval of the Architectural/Landscape committee to build any structure or modify their home or yard in any way. This will be accomplished by submitting a Request for Architectural Approval to the Architectural/Landscape Committee. An Architectural request form may be obtained from Euclid Management Company.

These changes may include, but are not limited to the following:

1.  Construction of patios, patio coverings, decks, porches, sheds, fences, walls, solar panels, atrium coverings and skylights etc.

2.  The repair or replacement of any of the above.

3.  Painting of house, trim or garage door.

4.  Replacement of garage door style.

5.  Replacement of roofs.

6.  Changing general landscaping pattern of the yard. Drainage pattern may not be changed.

7.  Installation of TV or satellite dishes.

8.  Removal of trees.

9.  Construction of any new window, door or opening to existing home. If in doubt that an Architectural Approval is needed, call Euclid Management Company.

Architectural Rules:

1.  Fences/walls may be wrought iron, stucco, block wall, slump stone, board-on board or vinyl.

Any fence/wall needs to be painted consistent with the Upland North Hills approved color chart. No fence/wall higher than six feet.

2.  Color of house paint, garage door and trim must be from Upland North Hills approved color chart.

3.  Roof replacement to be cement tile and brown in color.

4.  Atrium covering to be sunscreen netting, black, green or brown in color.

5.  If changing landscaping patterns, drainage pattern may not be changed.

6.  TV dishes to be installed in as unobtrusive place as possible on the home.

7.  City of Upland building permits must be obtained when required.

8.  The owners or occupants of the dominant tenement shall not construct any type of window or door that will look out on any portion of the servant tenement property or common way.

Some home improvements will require the posting of a $200.00 clean-up bond in the form of a check made to and held by UNH HOA to ensure that the streets and common area are left in a clean condition so as not to incur any clean-up expenses by the Association. The homeowner is responsible for any damages or clean-up required to the common area, streets, sidewalks or curbs caused by workmen on the premises: for example, moving vans breaking curbs, cement trucks dropping cement, paint washed out into gutters, or any other negligent act.

Consideration for changes is based on how the changes are viewed from the common areas. The Architectural/Landscape Committee has the power to apply both subjective and objective criteria when evaluating the merits of a proposed change to a lot. The Architectural/Landscape Committee has the power to exercise its judgment so as to ensure a uniform and seasonably high standard of artistic result and attractiveness in exterior and physical appearance of the property. The use of the words “attractiveness, and artistry” are necessarily subjective and therefore the Architectural/Landscape Committee can use subjective criteria in making their decision.

** Homes with a permanent closure of the atrium prior to the adoption of this rule are exempt.

ASSOCIATION GUIDELINES

1. Vehicle Use

Experience has shown we have limited space in our community for vehicles. This Board is

especially concerned for the safety of pedestrians and for the free flow of emergency vehicles

should they be required. Accordingly:

a.  All San Bernardino County and Upland City ordinances and vehicle codes apply within Upland North Hills.

b.  No parking is allowed wherever a street curb is painted red.

c.  No blocking of any street is allowed.

d.  The speed limit throughout the complex is 15 MPH.

e.  No parking is allowed in any fire lane or on any sidewalk at any time by residents or Guests. Workmen may park for a limited time only.

f.  All residents must use their garages for the parking of two vehicles.

g.  The City of Upland ordinances specify that a vehicle may not be left unmoved on a street for a period in excess of 96 hours (4days). Accordingly, it is expected that a homeowner who utilizes, as approved, a parking space will move that vehicle at regular intervals to meet this requirement. In essence this would suggest that the vehicle is one driven daily to work, etc.

Parking Exceptions

a. The homeowner must demonstrate that the garage is in fact being used for

vehicle parking and storage.

b. The homeowner must demonstrate that the driveway is in fact being used to

its fullest capacity.

c. Upon demonstration of need as described in a. and b. above, the homeowner will be permitted (by Board action at a regular meeting) to utilize another parking space for the additional vehicle. The homeowner will be asked to

provide the license number and make and model of that vehicle.

2. Pool and Spa use

We are proud of our pool and spa and happy that they provide enjoyment to homeowners. But please remember that these facilities come at a considerable expense to maintain and insure. Therefore:

a.  Homeowners are responsible for cleaning up after themselves and their guests and ensuring that all rules are observed at all times.

b.  Each household is allowed a maximum of four guests.

c. No glass, no running, and no pets are allowed in the pool or spa areas.

d.  No “loud” radios or television sets are to be used in the pool or spa areas.

e.  Children under the age of 14 must be accompanied by an adult over the age of

18 in the pool area.

f.  Homeowners must not loan their pool keys to non-residents.

g.  Pool and spa areas are from 8:00 a.m. to 10:00 p.m.

h. The pool is heated seasonally and the spa is heated all year long.

i. The pool may not be used as part of any commercial venture without prior approval by the Board.

j. All persons using the pool area, including the toilet, are required to clean up after themselves. That includes placing your trash in the proper containers.

k. Any person who is incontinent or not fully potty trained must wear appropriate waterproof clothing when entering or being carried into the pool.

3. Trash Receptacles

Trash receptacles are to be placed at curbside late the day before pick-up (Wednesday) or on the

morning of the scheduled trash pick-up (Thursday) and removed that evening to an area not

visible from the street.

Large or bulky items are not collected with the regular trash (i.e. tree stumps, furniture, appliances, and mattresses). Burtec will provide up to four (4) free bulky item curbside collections per year (12 month period). Please call (909) 949-0500 and make arrangements before placing bulky items at the curb.

4. Pet Control

a. The City has a leash law and it applies within Upland North Hills. Dogs must be on a leash at all times when in the common area or if having access to the common area. Loose, unattended dogs without a license or identification tag may be reported to the

local Animal Control for pick up.

b. Should your pet defecate in the common area, or on other homeowners’ property, it

is your responsibility to remove such waste immediately.

c. Continuous or excessive noise (more than ½ hour) from any pet cannot be tolerated.

Although a pet may be kept for purposes of protection, owners must take whatever

steps are necessary to prevent continuous or excessive noise so that we are able to preserve our quiet community.

5. Pest Control

If homeowners have problems with raccoons, roof rats, opossums, or other animals, advice may be

obtained from Euclid Management at (909) 981-4131.

6. Yard Maintenance

We have two kinds of yard maintenance problems that require the cooperation of all homeowners. First, many of our homeowners are gone for extended periods and yards sometimes tend to be neglected. Second, since there are no individual water meters, some homeowners do not realize the extent of our water use. Our water bills constitute about 25% of the Associations annual budget. We desperately need to conserve water.

Accordingly, the following guidelines are provided:

a.  All Private yards must remain landscaped.

b.  All dead trees, shrubs, ground cover, grass, or fallen trees must be removed and/or replaced.

c.  All weeds visible from the common area should be removed.

d.  Shrubs, trees, and ground cover must not extend onto the sidewalks.

e.  Sidewalks, driveways, curbs, and gutter areas must be kept clean and free of vegetation or debris.

7. Outdoor Lighting

Outdoor lighting on our garages, or around the corner from our garages, is the only source of lighting we have on our streets. At least one of the lights must be a sensored light and homeowners must be diligent about replacing burned out bulbs. Motion lights are acceptable but do not qualify as sensored lights.

8. Yard Sale Guidelines

A permit must be obtained from the City of Upland.

9. Holiday Decorations

The acceptable timeframe for winter holiday decorations is from the day after Thanksgiving until

January 10th. All other decorations may be displayed no more than 30 days prior to the day of the holiday, and should be removed within seven (7) days after the holiday.

Homeowner Responsibility to Tenants and Upland North Hills Homeowners Association

1.  Home owners are responsible to the Association and their neighbors for their own conduct, and that of their Tenants and guests under all circumstances.

2.  To reduce the likelihood of problems created by tenants, homeowners who rent their home to others should provide prospective tenants the opportunity to review the CC&Rs and R&Rs before entering into contract; and to determine to the homeowner’s satisfaction the prospective tenant’s ability to comply; so that rental decisions may be made by all parties beforehand.

3.  To reduce the likelihood of problems created by tenants, homeowners must provide copies of the CC&Rs, the current and annual updates of the R&Rs to their tenants; and determine to the homeowner that these have been read and understood by their tenants.\

4.  Homeowners who rent their home to others are responsible for obtaining, completing and returning the Tenant Emergency and General Information form and the Homeowner/Renter Declaration form to the management company within ten (10) days of the beginning of the rental period; and shall provide updates as may be required from time to time by the Association. Rules and Regulations and Tenant forms can be obtained from the Management company or from Upland North Hills website at www.uplandnorthhills.org

5.  Homeowners who rent their home to others are responsible for providing their tenants with all relevant keys (such as pool, mailbox) and information such as location of parking spaces and mailbox.

Landlord and tenant are responsible for all Upland North Hills Rules and Regulations

Landlord is responsible for providing to tenant(s):

·  Immediate notification of any damages and/or needed repairs

POLICY ENFORCEMENT

1. Upon notification of a violation of the CC&Rs, Articles of Incorporation, By-Laws, or these

Rules and guidelines, the Board of Directors will direct the Management Company to send a

letter to the owner of the property where the violation exists, and request that corrective

action is initiated within two weeks after receipt of the letter.

2. Failure to comply with the first letter of request of corrective action will result in a second letter, again requesting corrective action. If the violation is not rectified the owner will be asked to appear before the Board of Directors for a hearing.
