Youth Justice, ‘How To’ guide for:

Breaching a Court Order from a closed case.

Please note this guide should be read in conjunction with the Youth Justice Community Based Practice Manual – Practice Instructions for ‘Breaches’.

On occasion, a Youth Justice worker is required to ‘breach’ a Court Order that has been completed and is part of a clients ‘closed (or previous) case’. For example; an existing client has been just been placed on a 12 month Court Order. While adding the new case, court appearance and offences, to CRIS, it becomes apparent to the youth justice worker that new offences were committed during the operational period of the completed order. A decision has been made to breach the completed order:

Follow the normal process to complete the Breach screen:

Add the Court Order, by searching, in the Breach Screen - ensuring that the correct Order is chosen. To ensure accuracy check in the previous (closed) case first and note the ORD number. In this case the Court Order in the ‘closed case’ is ORD53239 Probation with Conviction.

Select the symbol, which takes you to the Look up (search) screen.

Select the correct Order.

You can select more than 1 Order if required, using the button.

Commence the Court Appearance Screen, linking the Appearance to the correct ‘Breach ID” using the Breach ID Look up:

You can import the charges from a previous appearance using the Look up:

Once the Offences have been imported, you can add any additional offences, if required.

Complete the information for the rest of the Court Appearance Screen; including the charge outcome, Court Advice, report information and create any new Court Orders.

  • Once this information has been added and updated return to the ‘Breaches’ Screen.

From the Breaches Screen, summary screen, select the Breach/Order that has been completed:

Select the inquiries look up

This will direct you to the Court Order Screen in the ‘closed (previous) case’. Update the Order Outcome and Outcome Comments and SAVE:

Best Practice would indicate an explanatory ‘case note’ in both the closed and current case.

In amending the ‘Breach’ from a closed case process, several other minor enhancements and defect resolutions have occurred.

Access to documents YJ153 Form 9 Notice To Appear before The Court and YJ020 Request For Authority to Return Sentencing Order to Court is now through the Breaches – Community component along with the Breach report.

When you have ‘created’ your Breach and added a Court Order from a closed case in the Breaches-Community screen, the 2 documents Form 9 Notice To Appear before The Court and Request For Authority to Return Sentencing Order to Court, will now reflect the correct information (information/Orders pertaining to the closed case).
