A Member Site Visit was requested by the Ward Member (Councillor Rolfe) in order to see the site from both neighbouring properties (no.76 and no.80A) and see the impact of the proposed development on them. A Member Site Visit was carried out on Wednesday 30th November 2016.
Additional representation
One letter of objection received from neighbouring properties (no.76 and no.80A). Additional points of objection:
- Reiterate that development fails to comply with Core Strategy policies
- Applicant/agent has not advised which neighbours have been contacted – no.76 and 80A were not contacted by the applicant or agent
- Clarification sought on a number of issues contained with report
As a point of clarification, Members are advised that whilst the supporting letter from MSC Planning Consultants Ltd states that the application represents a 10% footprint reduction when compared to the previously submitted scheme, it actually represents a 5% reduction.
Page 15 – Para beginning ‘As now proposed…’ should state ‘At its closest the proposed dwelling would be sited 2.65m (not 1.25m as stated within the report) away from the southwest boundary…’
Page 16 – Para beginning ‘As a result…’ should state ‘Whilst a single storeyelement does come within 2.65m (not 1.4m as stated within the report) of the shared boundary…’
Additional condition:
- Scheme for the protection of all retained trees/hedges

Update to ‘Other documents’ section of report
Whilst the Draft Aston Cantlow Parish Plan has been adopted by the Parish Council and forwarded to the District Council for adoption, the District Council has not yet adopted the Parish Plan as a material planning consideration to be considered when determining planning applications due to outstanding issues/queries with its contents. The Parish Council is currently addressing the issues/queries raised and due to the stage of the document, should only be afforded limited weight in decision making.

Revised Recommendation
A revised recommendation is proposed requesting that the application be deferred due to an inaccuracy being identified on the submitted plans that has caused some ambiguity.
It is therefore recommended that the application be deferred to allow a formal re-consultation to take place with all affected parties using plans updated to exclude the incorrect plan.
2 additional letters of objection received from adjacent properties. Comments made;
- Amended plans do not overcome previous reasons for objection.
- New plans appear closer than previously withdrawn scheme.
- Could result in pressure to build garage on opposite side of dwelling.
- Side extension will cause significant harm to neighbouring amenity.
