Update on S.106 Discussions with Applicant
A Financial Viability Appraisal, dated November 2015, was submitted as part of the planning application, the results of which have been verified by independent valuers on behalf of the District Council. As such, and notwithstanding the package outlined within the officer report, the S.106 planning obligation is proposed to onlysecure the matters listed below on the basis that further contributions over and above this would render the development as financially unviable:
  • a suitable clause to ensure that the extra care accommodation proposed is occupied as such;
  • a Libraries contribution of £1,579.00;
  • a clause to enable the financial viability of the development to be reappraised should the scheme be phased with implementation of different phases in the long-term;
  • a clause for the management and maintenance of open space within the development
Update to Recommendation
Additional condition recommended:
29. Prior to the commencement of development, details of the contents of a Sustainable Travel Welcome Pack, to inform, promote and incentivise the use of sustainable modes of travel by future residents of the scheme, and discourage reliance on the motor car, shall be submitted to and approved in writing by the Local Planning Authority. The approved Sustainable Travel Welcome Pack shall be distributed to each of the occupiers of all of the dwellings hereby approved prior to the first occupation of each unit.

Correction to ‘Background’ section of the report on page 48
Removal of the reference to ‘12 caravans – 6 mobile homes and 6 touring caravans’ and replacement with ‘6 caravans - 3 mobile homes and 3 touring caravans’
Correction to title on page 47 of the report
Delete ‘WCC Gypsy and Traveller Service Officer’ and replace with ‘SDC Gypsy and Traveller Policy Officer’.
Additional comment received from the above on 01.03.2016
Has no grounds to object to the cumulative scale of the developments at Rainbow Nurseries.The Core Strategy does refer to the DCLG 2008 Good Practice Guide suggestion of a maximum number of pitches of 15. Although this publication was withdrawn 1st September 2015, it probably still provides a reasonable guideline for size (there doesn’t seem to be any replacement guidance on that specific issue). Can see no reason why 8 pitches would be less desirable than the 5 pitches suggested in the Implementation Options.

The applicant’s agent has requested that Members be advised that the Field House has an extant planning permission to erect a detached garage under planning permission 09/01144/FUL.
Updates to the Officer’s report
The full site description of the application site is updated to ‘Land adjacent to the Field House, Forshaw Heath Road, Earlswood.’
Please note that all references to Tamworth in Arden should be read as Tanworth in Arden.
The application referred to within the report 15/0557/OUT lies within the village of Wood End, Tanworth in Arden.
Members Site Visit
A Member Site Visit was requested by the Ward Member (Councillor Atkinson)in order to understand the context of the application site. A Members Site Visit was carried out on Monday 16th March 2016 attended by Councillor Cargill, Councillor Kerridge, Councillor Atkinson, Mr Povey (applicant) and Case Officer (Erin Weatherstone).
Prior to the site visit plans were viewed and members were advised that the applicant’s agent had requested that Members be updated that a detached garage has extant permission for the Field House (footprint marked on site by the applicant). The visit included visiting the application site, walking along a stretch of Forshaw Heath Road and Tanners Green Lane. The group (excluding the applicant) also drove along Tanners Green Lane and Forshaw Heath Road.

Update to Recommendation
Additional condition recommended:
4. Prior to the commencement of the development hereby permitted details of a balcony screen shall be submitted to and approved in writing by the District Planning Authority. Thereafter the balcony screen shall be constructed and retained in full accordance with the submitted details.
Reason: To protect the amenity of residents of ‘The Ingle’ in accordance with Paragraph 17(5) and 56 of the NPPF, saved Local Plan Policy DEV.1 and emerging policy CS.9.

15/04059/FUL - Harwood House, Penn Lane, Tanworth-in-Arden

Revised Plans and Description
Revised plans have been received and sent out for information which replace the proposed detached garage with a car port of a smaller footprint. The description of the development has therefore been updated to ‘Demolition of the existing dwelling and removal of 2no. storage containers and the erection of a replacement dwelling with detached carport’.
Updates to the Officer’s report.
The Green Belt Calculations have been revised. The proposed dwelling is therefore considered to represent a 57% increase in floor area and 28% increase in volume over and above the existing dwelling on site.
Members Site Visit
A Member Site Visit was requested by the Ward Member (Councillor Atkinson) in order to allow the impact of the development on the Green Belt to be considered. A Members Site Visit was carried out on Monday 16th March attended by Councillor Kerridge, Councillor Cargill, Councillor Atkinson and the Case Officer (Erin Weatherstone).
Prior to the site visit plans were viewed including the revised car port plans. The visit included visiting the application site with Councillors Cargill and Atkinson also visiting the paddock west of the site close to the Public Right of Way and Penn Lane.
