Instructions

If you believe a Decision-maker is biased, you may make a request a new Decision-maker (as set forth in Student Conduct Code Section 2(5)(g) and Section 3(III)(2)(c)).

This requestform (or an equivalent written request) must be submitted to the Director of Student Conduct as soon as you have reason to believe the designated Decision-maker is biased, and no later than one day prior to the relevant meeting or Administrative Conference.

Please note that any of the following, by themselves, will NOT establish bias.

  • The Decision-maker has previously or is currently investigating other cases involving the same party.
  • The Decision-maker has previously found a party responsible or not-responsible.
  • The Decision-maker investigates the allegations and also makes a final decision in the matter regarding policy violations.

Be as specific as possible and provide information that you believe supports your request. Why do you believe that the current Decision-maker is biased or otherwise unable to be a neutral decision-maker in the underlying matter?

Note: Filing arequest for a new Decision-makeris a University procedure, not a civil or criminal procedure. Briefs containing legal argument will not be accepted as part of your request.

Step 3: Timely Delivery to the Decision-maker

Submit this form to the Decision-maker as soon as you believe there is a need for a new Decision-maker.

The Director of Student Conduct and the Title IX Coordinator will review this request, consult with the Decision-maker, and make a determination. In some instances, the other party’s response may be requested prior to making a determination. The Decision-maker will notify both parties of the decision to accept the request in full, to accept the request with a modified timeline or to deny the request.
