Welcome to Twin Creek’s Fall Junior Programs. Our programs will continue to develop your child’s tennis skills in a fun, inventive style, and encouraging way!

Please remember the following so that your children have fun and remain safe:

Please be sure your children wear sunscreen, hats, light clothing (no jeans), and tennis shoes. The juniors will be given plenty of water breaks, and your child’s safety is always our top priority. Please put names on your child’s racquets and other equipment.

Be sure to pick them up on time, since our staff will have other obligations at that time.

JUNIOR TENNIS PROGRAM RELEASE AND INDEMNITY AGREEMENT

THIS RELEASE AND INDEMNITY AGREEMENT (“Release”) is made by the undersigned adult (the “Participant”), to release and indemnify Twin Creeks Club., a Texas corporation, its parent company, affiliated or subsidiary companies, and all their respective officers, directors, agents, contractors, employees, heirs, successors, and assigns (collectively, the “Club”), as set forth below.

Activity. Representative, on Participant’s own behalf and on behalf of the other members of Participant’s family, including Participant’s spouse, parents, children, heirs, and assigns, (singularly and collectively referred to as “Participant”) hereby grants to the Club this full release and indemnification as consideration in exchange for permitting Participant to participate in the following athletic or physical activity which may utilize Club premises and/or equipment (The “Activity”): Twin Creeks Junior Fall Programs and Special Privileges.

Representative, on Participant’s behalf, is entering into this Release after (i) having reviewed or having had the opportunity to review Club premises and/or equipment; (ii) if there is are instructors, having reviewed or having had the opportunity to review the instructor’s qualifications; (iii) having been explained the scope of the services to be offered to Participant and the risks associated therewith; and (iv) having had an opportunity to ask questions regarding the services and/or risks associated with the Activity.

Release and Indemnity.

REPRESENTATIVE PERMITS PARTICIPANT TO PARTICIPATE IN THE ACTIVITY WIITH FULL KNOWLEDGE, UNDERSTANDING AND APPRECIATION OF THE RISKS OF INJURY INHERENT IN ANY PHYSICAL EXERCISE PROGRAM, PHYSICAL ACTIVITY OR ATHLETIC ACTIVITY AND EXPRESSLY ASSUMES ALL RISKES OF INJURY AND EVERN DEATH WHICH COULD OCCUR BY REASON OF PARTICIPANT’S PARTICIPATION.

REPRESENTATIVE RELEASES CLUB FROM ANY LIABILITY AND AGREES NOT TO SUE CLUB WITH RESPECT TO ANY CAUSE OF ACTION FOR BADILY INJURY, PROPERTY DAMAGE, OR DEATH OCCURRING TO PARTICIPANT AS A RESULT OF PARTICIPATING IN THE ACTIVITY.

REPRESENTATIVE HEREBY ASSUMES FULL RESPONSIBILITY FOR RISK OF BODILY INJURY, PROPERTY DAMAGEOR DEATH TO PARTICIPANT DUE TO THE ORDINARY NEGLIGENCE OF THE CLUB AND THE ORDINARY NEGLIGENCE, GROSS NEGLIGENCE, OR WILLFUL MISCONDUCT OF ANY THIRD PARTY INCLUDING OTHERS PARTICIPATING IN THE ACTIVITY.

REPRESENTATIVE AGREES TO INDEMNIFY, DEFEND, AND HOLD HARMLESS, AT REPRESENTATIVE’S SOLE COST, THE CLUB FROM ANY AND ALL CLAIMS ARISING OUT OF PARTICIPANT’S PARTICIPATION IN THE ACTIVITY.

ALL PERSONAL, PROPERTY BROUGHT TO THE ACTIVITY, IS BROUGHT AT THE SOLE RISK OF PARTICIPANT AS TO ITS THEFT, DAMAGE, OR LOSS.

Medical. Representative, on participant’s behalf, consents to emergency medical care and transportation in order to obtain treatment in the event of injury to Participant as the Club may deem appropriate. This Release extends to any damage or loss arising out of the medical treatment and transportation provided in the event of an emergency.

Severability. If any provision or portion of this Release found to be invalid by a court of competent jurisdiction, the remaining portions and provisions of this Release shall remain effective and shall be construed as if the invalid portion or provisions had not been contained herein.

Representative releases club from any liability and agrees not to sue club with respect to any cause of action for injury or illness, related to the special requirements, (medication or other special requirements), caused by negligence or willful misconduct, given to participant at Twin Creeks Club.
