TREES IN CONSERVATION AREAS

Please read the following notes which will explain broadly what you are required by law to do before carrying out any tree work.

The trees which you propose to fell/prune are situated within a Conservation Area.

TREES IN CONSERVATION AREAS: SECTION 211 NOTICES

Trees in conservation areas which are already protected by a tree preservation order (TPO) are subject to the normal TPO controls. But the Town and Country Planning Act 1990 also makes special provision for trees in conservation areas which are not the subject of a TPO. Under section 211 anyone proposing to cut down or carry out work on a tree in a conservation area is required to give the Local Planning Authority (LPA) six weeks’ prior notice in writing (a 'Section 211 notice'). The purpose of this requirement is to give the LPA an opportunity to consider whether a TPO should be made in respect of the tree(s) if we feel it is in the wider public interest to do so.

SUBMITTING A NOTICE TO THE LPA

The notice must be submitted in writing. It must describe accurately the location of the tree(s), species and what work is proposed. The LPA cannot make decisions if your submission is too vague e.g. stating you intend merely to prune or lop your tree(s). It may be helpful for you to engage a tree work specialist to submit the notice on your behalf as notices that do not contain sufficient information will not normally be considered. A list of reputable tree work contractors is available at this office if you wish.

On receipt of your notice the Tree Officer of the LPA will phone or write back to you advising what happens next. In the event of you not receiving a reply within six weeks of the date of your notice you may carry out the work as detailed.

I/We hereby give you six weeks notice of the intention to (describe here as accurately as possible the work intended and include if necessary (though not compulsorily) a simple sketch plan.
