TRANSFER POLICY FOR GROUP ‘B’, ‘C’ AND ‘D’ STAFF WORKING IN THE CUSTOMS AND CETNRAL EXCISE COMMISSIOENRATES, JAIPUR (RAJASTHAN)

(This has been formulated after considering draft transfer policy received from the Association and as per the minutes of the JCM held on 27.11.2007)

I- STATION TENURE: -

For the purpose of Annual General Transfer (AGT) the tenure of posting at a particular station in respect of Supdt. and Inspectors will be as follows: -

  1. Jaipur – 4 to 5 years.
  2. Jodhpur and Udaipur – 3 to 4 years.
  3. All Central Excise Divisions Hqrs except Jaipur – 3 to 4 years.
  4. All Central Excise Ranges/ Sectors situated outstation of the Divisional Hqrs – 2 years.
  5. All Customs Division (except Jodhpur) and Cus. Range Churu – 2 years.
  6. All Customs Ranges (except Churu) and LCS Munabao – One year.

In the case of an officer on promotion continuing at the same station, his tenure at that station in the post previously held by him shall also be taken into account for computing the total tenure at that station. In case of excess availability of officers completing their tenure at a particular station in comparison to the number required for posting out of that station, the officer with longest stay at that station shall be posted out first.

II.ALLOCATION OF COMMISSIONERATE:

The officers will be allocated to Customs for 4 years. The policy of transfer from Central Excise to Customs formations and vice versa after completion of station tenure shall be followed. Two years cooling-off period will be necessary before an officer can be considered again for posting to Customs Commissionerate. The substitute of the officers due from Customs will be provided from the Central Excise after completion of station tenure. The criteria will be the officers Customs tenure in ascending order. In other words the officer who have less Customs tenure will be given preference for Customs. However, officers who have done no Customs posting at the Border will be sent to Customs irrespective of Station tenure and the Commissioner Customs will give cognizance to same while deciding Customs postings.

Further posting in Customs will be decided by Commissioner of Customs based on the following criteria for the border postings:

1.Officers opted/requested for border postings.

2.Officers never done border posting and completed station tenure.

3.Officers never done border posting and not completed station tenure.

4.Officers having minimum border (being taken up to 2 yrs looking at the maximum border tenure) and completed station tenure.

5.Officers having minimum border and not completed station tenure.

The officers who are posted to the Central Excise Ranges situated outstation the Divisional Offices (2 yrs tenure) after completing the tenure of Border will not be again given to Customs for border posting whether they are falling in Minimum border and completion of station tenure criteria.

To compute the 4 years tenure in Customs the total tenure of different stations will be included.

The officers who are due from Customs will be allocated to Central Excise Commissionerate Jaipur-I and Jaipur-II on the basis of their previous posting in Excise and options/requests submitted by them keeping in mind the vacancy position of the Commissionerate.

The options of the officers shall be considered as far as possible.

IIIGeneral:

Annual General Transfer should be effected by the end of academic year and the exercise should be completed by the end of March. The officer supervising the cadre controlling sections, asking for the options from the Superintendents and Inspectors for the AGT, will issue a circular in the January each year.

The cut-off date for the purpose of deciding as to whether a particular officer has completed his station tenure or not will generally be counted from AGT to AGT, irrespective of minor variations in the tenure.

(a)Posting of Group ‘B’ officers in AGT: -

After the options/requests are received by the cadre controlling unit within a specified period, the History of Postings of the Group ‘B’ officers required to be transferred alongwith their options, should be placed before a committee consisting of the following:

I)Commissioner of Central Excise, Jaipur-I

II)Commissioner of Central Excise, Jaipur-II

III)Commissioner of Customs, Jaipur and

IV)Addl./Jt. Commissioner supervising the cadre controlling section.

(b) Posting of Gr. ‘C’ officers in AGT: -

All the options/requests received by the cadre controlling unit alongwith the History of Postings of the officers required to be transferred in a particular year, will be put up to a committee consisting of the following:-

I)Addl./Jt. Commissioner (P&V) of Central Excise, Jaipur-I

II)Addl./Jt. Commissioner (P&V) of Central Excise, Jaipur-II

III)Addl./Jt. Commissioner (P&V) of Customs, Jaipur and

The committees specified at (a) & (b) above will prepare AGT proposals as per the norms fixed by this transfer policy and put up the draft proposal to the cadre controlling authority for final approval. The committees will specifically give a report, with reasons, on the request cases recommended to be accepted or for variations from the transfer policy. The senior most Member of the committees mentioned above will act as the Chairman of the respective committee.

After allocation of staff to the respective Central Excise/ Customs Commissionerates, further specific posting of staff within the Commissionerates/ Divisions will be made by the jurisdictional Commissioner in the light of Ministry DO No. C-50/30/2000-AdII dated 15.07.2002. Respective jurisdictional Commissioners of Customs & Central Excise will also have full authority/ power to transfer an officer on administrative grounds within their jurisdiction. However, special approval of the Chief Commissioner (JZ) will be required for following transfers at AGT and any other time: -

  1. Transfer of officers from one Commissionerate to another Commissionerate.
  2. Transfers regarding change of station within a Commissionerate.
  3. Any midterm transfer.

IVLOCAL ROTATION AT JAIPUR BETWEEN CE JAIPUR-I AND JAIPUR-II.

The local rotation of officers between Central Excise Jaipur-I to Central Excise Jaipur-II and vice versa at Jaipur will be done after completion of four years in a particular Commissionerate.

VSENSITIVE CHARGES:

As per circular No. 1/2000 dated 10.05.2000 issued by the DG (Vig), New Delhi, sensitive charges are required to be identified with reference to Group ‘B’, ‘C’ and ‘D’ officers. The following charges are considerd as sensitive charge:

IN CENTRAL EXCISE (for two years )

  1. All Central Excise Ranges
  2. Preventive/Anti Evasion Sections of Headquarters and Divisions
  3. Refund/Rebate Sections of the Divisions.
  4. Internal Audit Section

IN CUSTOMS

  1. Preventive Section of Jaipur and Jodhpur (for two years)
  2. ICDs (for one year)
  3. ACC (for one year)
  4. FPO (for one year)
  5. International Airport (for two years)

After completing their tenure in a sensitive charge an officer will be required to be rotated to a non-sensitive charge.

On return to the parent cadre from deputation posting of sensitive nature, an officer will be posted to non-sensitive charge for two years as a measure of cooling-off.

Ministerial Cadre

Ministerial officers are also liable to be transferred to anywhere in the jurisdiction of the Zone. However, frequent transfers of Ministerial Officers should be avoided and their local rotation may be considered at the time of AGT by a committee mentioned in para III (b) above, on the following criteria:

a)Local rotation from Excise to Customs & vice versa: on completion of 2 yrs in Customs and having longest tenure in Excise.

b)Local rotation from Excise to Excise at Jaipur on completion of 4 yrs in the Commissionerate.

Group ‘D’

Group ‘D’ officers are also liable to be transferred to anywhere in the jurisdiction of the Zone. However, frequent transfers of Group ‘D’ Officers should be avoided and their local rotation may be considered at the time of AGT by a committee mentioned in para III (b) above, on the following criteria:

c)Local rotation from Excise to Customs & vice versa: on completion of 4 yrs in Customs and having longest tenure in Excise.

d)Local rotation from Excise to Excise at Jaipur on completion of 4 yrs in the Commissionerate.

Miscellaneous :

1.As far as possible officers who are due to retire within two year or so, may be transferred/posted to the places where they propose to settle down after their retirement.

2.Lady officers should be posted, as far as possible, to the stations where their families are residing.

3. As regards, the transfer of office bearers of recognized Union/Associations, the instructions contained in DOPT’s O.M. No. 27/03/69-Estt (D) dated 08.04.69 should be observed as far as possible.

Any deviation based on administrative exigency from the existing guidelines shall be with the approval of the Chief Commissioner.
