TRANSFER OF UNDERTAKINGS – A PRACTICAL GUIDE

The European Communities (Protection of Employees on Transfer of Undertakings) Regulations 2003; these Regulations reflect strongly the case law of the ECJ since 1977 interpreting the Acquired Rights Directive. In addition to specific provisions relating to bankruptcy and insolvency, the Regulations of 2003 seek to strengthen the protection of employees in a business transfer. In the current economic climate, the Regulations are now assuming greater importance but as both the ECJ and National case-law demonstrate, they are not easy to apply.

At this seminar, a leading authority on both the Irish and English position with an international reputation in the field, will guide delegates through the important issues and highlight the problem areas.

SEMINAR PRESENTER

Dr. John McMullen

Dr. John McMullen is one of the UK’s leading employment law practitioners and is Head of Employment Law at Watson Burton LLP. With over 25 years’ experience in employment law, he is an internationally recognised authority on transfer of undertakings and has been involved in some of the UK’s largest transactions and cases in the area in recent years.

Dr. McMullen has written extensively in the field of employment law and his publications include the definitive loose-leaf, Business Transfers and Employee Rights, which incorporates discussion of Irish case-law, Butterworth’s Employment Law Guide. He is also an editor of Sweet & Maxwell’s Encyclopaedia of Employment Law, and Editor of the Oxford University Press Employment Practitioner Series.

Dr. McMullen is a founder member of the UK Employment Lawyers Association and in May 2004 was appointed by the UK Secretary of State for Trade and Industry to be a member of the Advisory Conciliation and Arbitration Service (ACAS).

Dr. McMullen is a part-time Professor of Labour Law at the University of Leeds.
