Town of West Bend Town Board Minutes

June 10th, 2015

Chairman Paul Rice called the Town of West Bend Town Board meeting to order.

Paul Rice read the Call of the Meeting.

Roll Call was taken. Present: Chairman Paul Rice, Supervisor Lee Krueger, Supervisor Jim Heipp, DPW Bill Roggenbach and Clerk Rebecca Schuster. Excused: Treasurer Dianne Kramer.

The Pledge of Allegiance was recited.

Approval of Minutes from the May 13th, 2015 Town Board meeting. Jeff Geib made a motion to approve the minutes. Jim Heipp seconded the motion. All in favor. Motion carried.

Approval of Minutes from the May 26th, 2015 Town Board meeting. Jim Heipp made a motion to approve the minutes. Paul Rice seconded the motion. All in favor. Motion carried.

Treasurer's Report: Clerk Rebecca Schuster gave the Treasurer's Report. Jim Heipp made a motion to accept the Treasurer's Report. Paul Rice seconded the motion. All in favor, motion carried.

Review of Bills and Authorization of Payments. Jim Heipp made a motion to Approve the Bills and Authorize Payments. Jeff Geib seconded the motion. All in favor. Motion carried.

Discussion and/or Action re: Presentation on the Town/City Dog Park. Jim White and Craig Hoeppner were present to discuss the issue. We have 80 acres between the two entities. Currently, the Town has a 66 foot easement in order to access our portion of park land. The City would like the Town to consider amending the Easement Agreement giving 30 feet to the City and leaving a 36 foot easement for the Town so the City can extend a fence onto the easement. The City would like to install a small dog park and the extra 30 feet would allow a nicer area for that purpose. Chairman Paul Rice stated he would have a hard time finding fault with this. Supervisor Jim Heipp also had not issues with it. The City will bear any costs of legalities in regards to the easement. Chairman Paul Rice made a motion to go ahead with the legalities in regards to the easement. Supervisor Jeff Geib seconded the motion. All in favor. Motion carried.

Approval of Hafeman CSM - 3597 Grasser Drive, West Bend, WI 53095 Per Plan Commission Recommendation: Chairman Paul Rice made a motion to approve the Hafeman CSM - 3597 Grasser Drive, West Bend, WI 53095 Per Plan Commission

Recommendation. Supervisor Jeff Geib seconded the motion. All in favor. Motion carried.

Approval of Holz CSM - 6169 Nabob Drive, West Bend, WI 53095 Per Plan Commission Recommendation. Chairman Paul Rice made a motion to approve the Holz CSM - 6169 Nabob Drive, West Bend, WI 53095 Per Plan Commission Recommendation. Supervisor Jim Heipp seconded the motion. All in favor. Motion carried.

Authorization for Zoning Administrator to issue a Conditional Use Permit to Padway's, 4919 Hwy 144, Hartford, WI 53027. Chairman Paul Rice made a motion to authorize the Zoning Administrator to issue a Conditional Use Permit to Padway's, 4919 Hwy 144, Hartford, WI 53027. Supervisor Jeff Geib seconded the motion. All in favor. Motion carried.

Discussion re: American Metal and Paper Recycling. Geoff Radloff from American was here to discuss issues they were seeing with the recycling. Please see attached letter in regards to this issue. American would now like to start charging the Town to collect our glass. They will be charging $500.00 per exchange. Chairman Paul Rice stated that he feels the Town needs to give this issue some more thought. We are kind of being hit with this out of the blue and have had not time to do research on this issue. The Town would like to know how much per ton they are getting for the glass. It is hard to believe that the company is not seeing a profit on the glass. This new charge changes the game for us quite a bit. The Town will have to research all of our options in regards to this issue.

Discussion and/or Action re: New Holland Tractor. Bill Roggenbach stated that the tractor had an oil leak and was running with no brakes. Chairman Paul Rice stated that replacing the brakes was very costly but had to be done for safety issues. The tractor has been sitting at St. Lawrence equipment for at least 5 weeks now. The parts had to be ordered to fix it. This tractor has caused us issues from the beginning. However, we have to keep putting money into the repairs as we cannot afford to purchase a new tractor. We just have to go ahead and fix the tractor now but really need to start putting money aside now for a new tractor. Supervisor Jeff Geib questioned what the replacement cost for a new tractor would be. Bill Roggenbach stated that we are looking at minimum $45,000.00 for a used one and $90,000.00 or more for a new one. The tractor will be fixed however, we will keep our eyes open for a good deal and start setting aside some money for a future purchase.

Discussion and/or Action re: Ordinance #2015-01: Amendment to Ordinance #2008-06 to repeal and recreate Section 5.13 of Chapter 5 (Fire Protection) of the Municipal Code relating to False Alarms. This amendment is changing the fee of a false alarm charge from $9400.00 per false alarm to $850.00. The fee change is a result of our new contract with the City of West Bend. Chairman Paul Rice made a motion to adopt Ordinance #2015-01: Amendment to Ordinance #2008-06 to repeal and recreate Section 5.13 of Chapter 5 (Fire Protection) of the Municipal Code relating to False Alarms. Supervisor Jeff Geib seconded the motion. Roll Call Vote: Chairman Paul Rice; aye, Supervisor Jeff Geib; aye, Supervisor Jim Heipp; aye. All in favor. Motion carried.

Granting of Class B Combination Fermented Malt Beverages and Liquor Licenses.

Supervisor Jim Heipp made a motion to grant the Class B Combination Fermented Malt Beverages and Liquor Licenses. Supervisor Jeff Geib seconded the motion. Motion Carried.

Granting of Class A Combination Fermented Malt Beverages and Liquor License.

Supervisor Jim Heipp made a motion to grant the Class A Liquor Licenses. Supervisor Jeff Geib seconded the motion. Motion Carried.

Granting of Bartender Licenses. Supervisor Jeff Geib made a motion to grant the Bartender Licenses. Supervisor Jim Heipp seconded the motion. Motion carried.

Discussion re: Fire Calls. No issues with fire calls this month.

Correspondence received to be discussed at next month's meeting. Chairman Paul Rice questioned if it would be ok to change the meeting date next month from the 8th of July to the 15th of July. Everyone was ok with the date change. July's meeting will be on July 15th, 2015 at 6:30 PM.

Washington County requested the use of our facilities on Wednesday October 21, 2015 from 6-8pm to hold an information meeting on an upcoming project on Hwy NN. The board does not see an issue with them using our facility for this.

Supervisor Jeff Geib made a motion to adjourn. Supervisor Jim Heipp seconded the motion. All in favor. Motion carried. Meeting was adjourned at 8:50 P.M.
