ADDRESSES/ Matt Golovach who is the Chief of the Cadyville Fire Department addressed the Boardfollowing up on a letter that was sent to the Town of Schuyler Falls and the Town of Plattsburgh regarding the danger at the Kent Falls Bridge. He mentioned that there had been many deaths and injuries due to people jumping off the bridge. He asked if the Town of Schuyler Falls and the Town of Plattsburgh could get together to come up with some kind of resolution to possibly tear the bridge down or to the maybe putting a gate further down across the road to defer the access to the property. It was said that the bridge is owned by the County. The County did install guard rails and posts up to try to keep people from gaining access to that area. It was said that no matter what is done up there, there will always be people that will gain access to the property and jump into the water if that is what they want to do. It was mentioned that the area is a popular place for fishing. Mr. Potiker told Mr. Golovach that he will speak with the Town of Plattsburgh’s Supervisor to check to see what can be done to try to make it a safer area.

COMMUNICATIONS/ Mr. Potiker told the Board members that he received an e-mail from Supervisor Cashman who is from the Town of Plattsburgh informing him that he has been contacted by a number of people who have inquired if the Morrisonville Bridge could be dedicated to Gordie Little. He would like to have Mr. Potiker work with him to advocate for this to happen.

DEPARTMENT REPORTS

Highway/ Mr. Rock reported that his crew has been working on changing culverts. The Town of Plattsburgh’s Highway Department worked with them on the shoulders and the ditching on theFlat Rock Road.

Water/ Donna Hamel told the Board members that she has been working on the water leak report for the Morrisonville Water District. The Town of Plattsburghobtained a radio read from the meters at locations in the district that detected a continuous water leak for over 35 days. Notices will be sent to the residents that are on the list along with a tip sheet on what could possibly be causing the extra usage of water.

Supervisor/ Mr. Potiker reported that he has held two Town Board workshops in the month of June to discuss upcoming projects and any concerns with the Board members.

He has been working on the design and purchase of street flags for the Town.

He has had meetings with NYSEG regarding the potential natural gas project for the Town.

He has been working with WestelCom regarding the possible upgrade/replacement of the current Town office phones.

In July, he will hopefully have more information on the cost of a Comprehensive Plan for the Town as well as more information on a potential dog park for the Town.

RESOLUTION #16-49

WHEREAS, Kelly Donoghue, Assistant Director of Emergency Services notified the Town that Bisson Way, which is officially named a Right-of –Way in the Town of Schuyler Falls by resolution, is no longer needed for addressing in the 9-1-1 MSAG/Road Data Base due to the removal of some trailers within the past, be it therefore

RESOLVED, that the Town Board of the Town of Schuyler Falls authorizes the removal of Bisson Way from the Clinton County 911 list.

RESOLUTION #16-51

NEW YORK STATE ELECTRIC & GAS CORPORATION having, by its written petition dated June 28, 2016, requested the consent of the Town of Schuyler Falls, County of Clinton and State of New York, that it may carry on the gas utility business in the said Town and may occupy the streets and public places in said Town for that purpose and as otherwise provided herein, and a public hearing having been held after due notice thereof having been given as required by the Town Law, and said application having been duly considered by the Board of the Town of Schuyler Falls at a meeting duly held on June 28, 2016.

NOW, THEREFORE, BE IT RESOLVED, that the Town of Schuyler Falls does hereby grant to said New York State Electric & Gas Corporation, its successors and assigns, upon due acceptance in writing, a perpetual franchise to lay, construct, install, maintain and operate conductors, fixtures, pipes and structures for carrying, transmitting, distributing and delivering gas (natural, manufactured or mixed), other fluids, telecommunications equipment and signals, and electricity with the necessary pipes, conduits, ducts, valves, valve pits, regulators, compressors and other conductors, fixtures and structures, in, under, along, across, through and beyond all of the streets, highways, alleys, squares, lanes, parks and public places in the said Town of Schuyler Falls for the purpose of furnishing, selling and distributing gas for light, heat and power purposes, and for providing space and facilities in or near its trenches for other services rendered to the public, including communications services (so long as the interested parties are prepared to share the cost), in said Town and beyond the limits thereof and the doing of such other things as may be necessary and incident to its business as a company which furnishes natural gas service and which provides space and facilities in or near its trenches for other services.

PROVIDED, HOWEVER, that all pipes, conduits, ducts, valves, valve pits, regulators, compressors and other conductors, fixtures and structures shall be placed in such a manner as to cause as little inconvenience to the public in the use of such highways as is practicable and consistent with the safety and efficiency of such pipes, conduits, ducts, valves, valve pits, regulators, compressors and other conductors, fixtures and structures.

PROVIDED FURTHER, that all of said pipes, conduits, ducts, valves, valve pits, regulators, compressors and other conductors, fixtures and structures shall be placed, constructed and maintained in a proper and workmanlike manner so that the same shall in no way endanger the public, and the said Company shall at all times indemnify and save harmless said Town and the members of said Town Board from and against any and all actions, suits, damages, costs, charges and expenses by reason of the location and maintenance of said pipes, conduits, ducts, valves, valve pits, regulators, compressors and other conductors, fixtures and structures through, along and under any of the streets, highways, avenues, lanes and other public places, or by reason of any act done or omitted to be done in the premises by said Company.

PROVIDED FURTHER, whenever said Company shall have occasion to make an opening in the surface of any street, highway or other public place for the purpose of laying or repairing any pipes, conduits, ducts, valves, valve pits, regulators, compressors and other conductors, fixtures and structures, it will first procure any permits necessary under the law or ordinances of said Town (except in an emergency), will conduct such work in a careful and workmanlike manner, will cause as little disturbance of traffic as reasonably possible, and will restore the surface of such street, highway or other public place equal to or better than its former condition, including restoration of pavements where it has been necessary to disturb the same.

PROVIDED FURTHER, that this grant of a franchise is made upon the condition that permission be secured from the Public Service Commission as is required by law.

RESOLVED, that the Town Supervisor and Town Board of the Town of Schuyler Falls be and hereby are authorized and directed to execute and deliver the written consent of the Town as herein provided.

RESOLUTION #16-52

MOTION BY: Mr.Newton

WHEREAS, the Town of Schuyler Falls has been notified by Robert Fuller, who is a member on the Saranac River Trail Greenway Committee, that David Premore, who is currently on the SRTB Board of Directors, would like to step down when his term ends in July, and

WHEREAS, Mr. Fuller has recommended Phil Van Bargen, who is a Town resident, for the position on the Board of Directors as Mr. Fuller indicated that Mr. Von Bargen is willing to take the position for the three year term and certainly has the expertise and passion to do so, be it

RESOLVED, that the Town of Schuyler Falls Town Board hereby appoints Phil Van Bargen to the SRTG Board of Directors for the new three year term (July 2016-July 2019).

RESOLUTION #16-53

RESOLVED that the Town of Schuyler Falls hereby amends the following as standard work days for elected Town Justice and will report the following days worked to the New York State and Local Employees’ Retirement System based on the record of activities maintained and submitted by these officials to the clerk of this body.

RESOLVED, that the Town of Schuyler Falls enter into a contract with the Town of Schuyler Falls Seniors in the amount 1,700.00 for the calendar year of 2016.

WHEREAS, the playground fencing at the Town Hall is in dire need of replacement, and

WHEREAS, as directed by the Procurement Policy, three quotes were received as follows:

  1. Freedom Fence Co. $14, 994.00
  2. JB Carpentry and Fencing, LLC. $14, 266.78
  3. C & E Fencing Co. $ 14, 184.00

WHEREAS, after review of the Town Board, all quotes were within 10 percent of each other (quotes attached), but included in the Freedom Fence quote, all the ground work that would be necessary was included in the quote,

RESOLVED, that the job is awarded to Freedom Fence Co. with the quote being $14,994.00.

RESOLVED, that the Town of Schuyler Falls authorizes the hiring of Alexander Zurlo as a Recreation Attendant for the summer months pending Civil Service Approval with a starting salary of $9.00 an hour.
