Purpose:

¨  To provide time off to employees for military training

Scope:

¨  All CPS employees.

Policy:

I. An unpaid military leave of absence will be granted to any employee who is a member of the U.S. Armed Forces National Guard or Reserves, except those occupying temporary positions, to attend scheduled drills or training or if called to active duty.

Procedures:

A. Requests for military Leave of Absences should be in writing and submitted to CPS Human Resources along with copies of the orders or other documentary evidence. Employees who do not have written orders when informed of training should submit copies to Human Resources upon receipt.

B. Subject to the terms, conditions, and limitations of the applicable plans for which the employee is otherwise eligible, health plan benefits will be provided by CPS until 30 days after military leave begins. At that time, the employee will become responsible for the full costs of these benefits through Cobra continuation if the employee wishes the coverage to continue. When the employee returns from military leave, CPS will again provide benefits according to the applicable plans.

C. Benefit accruals, such as PTO, will be suspended during the leave and will resume upon the employee's return to active employment.

D. Employees on military leave of more than six months must apply for reinstatement of employment in accordance with all applicable state and federal laws.

E. Every reasonable effort will be made to return eligible employees to their previous position or a comparable one. They will be treated as though they were continuously employed for purposes of determining benefits based on length of service, such as the rate of PTO accrual and job seniority rights, if any.

Exceptions:

Any exceptions to this policy may not be made unless they are approved by the employee’s Manager and the Director of Human Resources.

These policies do not create a contract of employment for any length of time, nor does it change the at-will nature of employment. Some of the policies described may require further interpretations. The Company reserves the right to add, modify, or terminate its employee policies, practices and procedures and/or benefits at any time. This on-line policy supersedes all prior policies, including (without limitation, any hard-copy version of this policy previously distributed) and all prior practices and procedures on subjects covered in this policy. Because our on-line policies are updated from time to time, employees should review the on-line policies to be informed of the current policies in effect.
