Regarding Negotiation Results between IBEW Local Union 379 and Atlantic Coast Chapter of NECA

Executive Board and Members,

On Tuesday July 24, 2018 a tentative settlement was reached between IBEW Local Union 379 and Atlantic Coast Chapter of NECA and the results are as follows:

Length of Contract September 1, 2018 to September 1, 2021 (3-years)

Other language changed, modified, added, or deleted:

  1. Section 3.04 (b) to be changed to read as follows:If chosen by the Employer, an acceptable method of paying wages shall be by means of electronic transfer directly to the employee’s bank account. If requested by the employee, or when the employee does not have a bank account, wages shall be deposited in an account established by the Employer, at a financial institution of the Employers choosing. Said account will permit funds to be withdrawn by means of an ATM card. No recurring service charges or maintenance fees shall be assessed against the employee in the connection with the account established by the Employer. No fees shall be assessed against the employee for accessing funds at an ATM owned and operated by the financial institution at which the Employer has established the account. If an electronic transfer option is chosen, such transfer shall be made so that the funds are available no later than noon on the Thursday of each workweek. During weeks that contain Bank Holiday, funds shall be made available no later than 9:00 a.m. on Friday. The employer shall be prohibited from debiting the account of the employee.
  2. Section 3.19 to be changed to read as follows: The fabrication and assembly of all materials or equipment other than standard manufactured items, shall be done whenever practical, by workmen employed under the terms of this Agreement.
  3. Section 3.07 to be changed to read as follows: The Employer agrees to withhold Credit Union/Vacation Fund deductions at the employees desired hard dollar amount upon suitable written authorization. Authorization for deductions shall be available to employees at any time; however, changes to such authorizations shall be permitted only on June 1 or December 1 of each year. All such deductions shall be mailed once per month, along with a suitable payroll report showing the deductions for each employee, to reach the Board 63 Collection Account Trust not later than 15 calendars following the end of the month (See Article VI).
  4. Section 2.16 add new sentence: The Steward shall perform the work of a Journeyman Wireman.
  5. New Section 3.23 “Recall Language”: An employer shall have the right to recall for employment any former employee that the employer has laid off, provided that: The former employee is in the highest level Group on the referral list containing applicants available for work, regardless of the individual’s position on the list; or, if the former employee is a CW/CE, he or she is available for assignment regardless of the individual’s position on the list; The recall is made with 120 days from the time of layoff. The former employee has not quit his most recent employer under this agreement within two weeks prior to the recall request; and the former employee is not an apprentice.
  6. Section 2.20 “Tool List”: The tool list has not changed except for the way it was written to avoid and confusion as to what tools are required for JW.

Items that Management wanted but the Union would not give up and cost the Union:
