Eligibility Requirements and Releases

The following eligibility requirements must be met in order to proceed with the application process: By answering the questions set forth in your casting application(s) and submitting your video (your “Video”) to RDF MEDIA USA, INC. (“RDF” or “Producer”), you represent, warrant, and agree as follows:

You are over 21 years of age.

You are a legal U.S. resident.
You are not a candidate for public office and agree not to become one until after one (1) year after the initial broadcast of the programs in which you appear, if selected as a participant.
Neither you nor any member of your immediate family or anyone living in your household is or has been within the last two (2) years employees, officers, directors or agents or any of the following:

(a)The American Broadcasting Company, Inc. (“ABC”), the ABC Television Network (“ABCN”), The Walt Disney Company (“Disney”), RDF or any television station owned and operated by ABC, ABCN, or Disney; or

(b)Any person or entity involved in the development, production, distribution or other exploitation of the reality-based program entitled “Wife Swap” (the “Program”) or any variation thereof.

In addition, Producer reserves the right, to disqualify or render ineligible any person who Producer determines, in its sole discretion, is sufficiently connected with the production, administration, casting, judging, or distribution of the Program such that his or her participation in the Program could create the appearance of impropriety. Such decisions shall be final and are not subject to challenge or appeal.

If selected as a participant, you will execute waivers and release agreements required by Producer, including a contestant agreement and release and other agreement(s) as required by the Producer or ABC, or any of their licensees, successors or assigns.

You are available to travel to locations as determined by Producer in its sole discretion.

You are willing to submit to a background check.

You have read all eligibility questions and have answered them completely, honestly and accurately. If any of the information you provide in any application(s) and/or in your video (“Video”) is found to be false or incomplete, RDF shall have the right to: terminate its review of your application and/or dismiss you from the Program participant selection process and/or dismiss you from the Program episode if selected;

Even if you meet the eligibility requirements (as determined solely by RDF), RDF will have no obligation to interview you and/or select you as a participant;

You shall not be entitled to any compensation whatsoever for completing your application(s), submitting your Video to RDF or for participating in this selection process;

RDF may rely upon the information in your application(s) as it relates to the participant selection process and/or the development of the Program;

You are in excellent mental and physical health;

RDF will have no obligation to use the information in the Video (or any portion thereof), and neither RDF nor any broadcaster will have any obligation to complete, distribute, exhibit or exploit the Program.

In no event will you be entitled to enjoin or restrain the development, production, distribution, advertising or exploitation of the Program.

All decisions by RDF concerning selection of the participants are final and not subject to challenge or appeal.

In addition to your Video, you may be taped, filmed and/or otherwise recorded in connection with the Program ‘selection process or otherwise, and Producer and its successors, licensees, and assigns shall have the irrevocable, perpetual right to use your name, biographical data, picture and other reproductions of your physical likeness and voice (as the same may appear in any still camera photograph and/or motion picture film or tape (including but not limited to your Video)) including, but not limited to, in and in connection with the exhibition of the Program in all media now known or hereafter devised, worldwide in perpetuity, in or in connection with the Program and the advertising, publicity, marketing, and promotion thereof.

You have the right to grant all rights granted in connection herewith without the consent of any third party, and Producer’s exploitation of such rights and use of any materials submitted by you in connection herewith (including but not limited to this application and your Video) as permitted hereunder will not infringe upon the rights of any third party.

RDF has no obligation to return any materials submitted as part of this application, including, without limitation, the Video, whether or not you are selected as a participant.

By submitting this application, to the maximum extent permitted by law, I hereby release Producer, ABC, ABCN, Disney, any television station or channel, cable network, or satellite network that airs the Program, the other participants in the Program, the advertisers connected with the Program, each of their respective parent, subsidiary and affiliated companies, all other persons and entities connected with the Program, and each of their respective officers, directors, agents, representatives, employees, successors, assignees, and licensees (herein the "Released Parties") from any and all claims, actions, damages, liabilities, losses, costs and expenses of any kind (including, without limitation, attorneys' fees) arising out of, resulting from, or by reason of, my participation in or in connection with the Program, including, without limitation, my participation in the contestant selection process of the Program, any exploitation of the Program or my appearance on the Program, the failure of Producer to select me as a participant, the cancellation of the Program, or the exercise by Producer of any rights granted by me with respect to the Program on any legal theory whatsoever (including, but not limited to, personal injury, rights of privacy and publicity, false light, or defamation) (the “Released Claims”). The Released Claims specifically include, without limitation, any and all claims, actions, damages, liabilities, losses, costs and expenses of any kind resulting from the actions of another participant or any other third party at any time, but shall not include claims with respect to my rights pursuant to applicable workers’ compensation laws.

I authorize Producer to investigate, access and collect information about me, about any of the statements made by me in my application, any supporting documents and any other document that I have signed or do sign in connection with my application to be selected as a contestant in the Program, or any other written or oral statements I make in connection therewith, and agree to supply Producer any additional information required to conduct such investigations. I irrevocably authorize Producer to secure information about my experiences from my current and former employers, associates, friends, family members, educational institutions, government agencies, credit reporting agencies, and any references I have provided, and I irrevocably authorize such parties to provide information concerning me. I hereby unconditionally and irrevocably release and forever discharge all such parties and persons from any and all liabilities arising out of or in connection with any such investigation.
