Subject: DISCLOSURE OF VEHICLE MODIFICATION, USE OR SALE OF NON-GM PARTS & ACCESSORIES AND SALE OF NON-GM SERVICE CONTRACTS.

NOTE: APPLIES TO ALL GENERAL MOTORS DEALERSHIPS,

REGARDLESS OF DIVISION

This bulletin is to remind dealers of the importance to ensure that all retail, fleet and commercial customers who purchase the following products or services, are fully informed when any or all are not supplied, authorized, marketed, or warranted by GM:

  • Non-GM Parts and Accessories (Part II)
  • Non-GM Service Contracts (Part III)
  • Non-GM Vehicle Alterations and Modifications (Part IV)

According to the Dealer Sales and Service Agreement (Article 5.1.1):

“If dealer modifies or sells a modified new motor vehicle, or installs any equipment, accessory, recycled part or part notsupplied by General Motors, or sells any non-General Motors servicecontract for a motor vehicle, dealer will disclose this fact on the purchase order and bill of sale,indicating that themodification, equipment, accessory or part is not warranted by General Motorsor, in the case of a service contract, the coverage is not provided by General Motors or an affiliate.”

The dealer is required to disclose to the customer any modifications made, or parts and/or accessories installed on the vehicle that are not GM approved as well as any Non-GM service contract/agreement. To comply with these obligations, the dealer can reproduce locally the form provided in this bulletin to properly disclose any of the above situations. This disclosure form must be presented to the customer during the sales or service process, signed, and a copy must be kept in the customer’s sale and service file along with copies of the purchase order and bill of sale.

In those cases where the vehicle modifications, non-GM parts and/or accessories are warranted by the installer, manufacturer, or upfitter, a copy of the third party warranty must be presented to the customer at the time of vehicle sale or with the invoice or repair order.

DISCLOSURE OF NON-GM PRODUCTS FORM

INSTRUCTIONS TO COMPLETE FORM

PLEASE NOTE: THIS FORM IS NOT REQUIRED IF THE CUSTOMER IS PURCHASING APPROVED GM PRODUCTS, GM ACCESSORIES, OR SERVICES.

Part I – Customer disclosure portion is required for any type of sale of Non-GM products or services and this box is pre-checked for all applications.

Part II – For use if the customer is purchasing Non-GM Products or Non-GM Accessories at the time of sale or service. This would include all over-the-counter products permanently attached to the vehicle. Please describe the item(s) and provide the name of the manufacturer of the product(s) in the space provided. In those cases where the vehicle modifications, non-GM parts and/or accessories are warranted by the installer, manufacturer, or upfitter, it is recommended that a copy of the third party warranty be presented to the customer at the time of vehicle sale, with the invoice, or repair order. This part is also for use of any Non-GM Recommended Services sold.

Part III – For use if the customer is purchasing Non-GM Service Contract or Service Agreement. Please provide the name of the Provider and Contract number in the space provided.

Part IV – For use if the customer is purchasing Non-GM Vehicle Options and Modifications, and the vehicle has been modified from its original build as produced by General Motors by a Specialty Vehicle Manufacturer (SVM), dealership, or independent business. Examples include, but not limited to:

  • Incomplete/Chassis Cab Commercial Vehicles
  • Upfitted Cargo Vans Bins/Racks
  • Upfitted Custom Vans
  • Upfitted Custom Trucks, SUVs, and Passenger Cars
  • Non-GM Content as described in Table “Vehicle Content”.

Part V – Buyer Notice provides additional customer information regarding vehicle modifications and vehicle performance. This box is pre-checked for all applications.

Vehicle and Customer Information: Please provide the full vehicle VIN, customer, sales or service representative names, signatures, and date, in the space provided.

The disclosure form should be presented to the customer during the sales or service process, signed, and a copy must be kept in the customer’s sale or service file.

In those cases where the vehicle modifications, non-GM parts and/or accessories are warranted by the installer, manufacturer, or upfitter, it is recommended that a copy of the third party warranty be presented to the customer at the time of vehicle sale or with the invoice or repair order.

DISCLOSURE OF NON-GM PRODUCTS FORM

This FORM is to be used for DISCLOSURE OF VEHICLE MODIFICATIONS, USE OF NON-GM PARTS & ACCESSORIES, and the SALE OF NON-GM SERVICE CONTRACTS. A copy of this signed FORM must be kept in the customer’s sale and service file.

Part I - Consumer and selling dealership acknowledge that this disclosure of information is required in any situation where the consumer, is purchasing or leasing a GM vehicle and the GM dealer or the customer has purchased or had installed:

1.A modified motor vehicle - a new or used motor vehicle which has been modified from its original build by General Motors by any up-fitter, servicing entity/business or dealer regardless of the extent of the modification;

2.Any accessory, product or part not produced, marketed or warranted by General Motors; or

3.Any Service Contract, or extended repair policy not specifically provided by General Motors.

The consumer (buyer/lessee) acknowledges that:

  • General Motors will not be responsible for any vehicle modifications not developed by General Motors, for any non-GM accessories or equipment installed on the vehicle nor will General Motors warranty or otherwise cover (a) damages to these modifications or accessories, or (b) damages these modifications or accessories cause to other parts or systems of the vehicle.
  • For non-GM Service Contracts or extended service policies sold by the dealer, that those contract(s) may or may not be accepted by other GM dealerships and that GM will in no way be responsible for such non-GM contracts.

Part IV– VEHICLE ALTERATION/MODIFICATION- This vehicle has been modified from its original build as produced by General Motors through a vehicle up-fitter identified below and may have non-GM components on the vehicle that will not be covered under the GM New Vehicle Limited Warranty. It is the responsibility of the upfitter, and not GM, to ensure that any vehicle modifications or alterations are installed in compliance with any applicable federal, state or local laws. Furthermore, General Motors takes no responsibility for these alterations of modifications, or for any impact these modifications may have on the safety, performance or durability of the vehicle. It is not GM’s responsibility to provide any applicable warranty on these components.

Part V- Notice to Buyer on Vehicle Modifications

Modifications to your may have an adverse affect on engine operation, vehicle performance, vehicle operation, vehicle stopping distances, proper operation of the braking systems, transmission operation and/or fuel mileage. Vehicle operational conditions or failures caused by non-GM modifications or alterations are not covered under the terms of the GM New Vehicle Limited Warranty. Items including but not limited to:

  • Installation of aftermarket lighting systems, audio,camera video systems or alarm systems which cause interference with or failure of GM electrical systems or vehicle components,
  • Installation of wheel/tire combinations not certified by General Motors or for which a GM provided vehicle calibration is not available directly from General Motors,
  • Addition of aftermarket power enhancements including but not limited to introduced calibrations not provided by General Motors are not condoned by General Motors and may result in engine, transmission, driveline, rear or front differential, transfer case, fuel system or emission/performance warranty coverage being voided,
  • Installation of nitrous oxide induction, propane induction, non-GM engineered/supplied superchargers, blowers, turbo chargers, after coolers, engine headers, camshafts, rocker arms, air induction systems, non-GM approved fuel injectors, over-drive or under-drive accessory drive systems, aftermarket drive pulleys or harmonic balancers, flywheel, clutch assemblies, or non-GM certified engine or transmission calibrations may result in engine, transmission, driveline, rear or front differential, driveline and/or transfer case, fuel system or emission warranty coverage on the affected components being voided or repairs declined under the GM New Vehicle Limited warranty and subsequent performance and/or emission warranties.

IMPORTANT: Installation and operation of NON-GM PRODUCTS may cause extensive damage to the vehicle, compromise its safety, interfere with the vehicle’s operation, or affect the validity of the GM New Vehicle Limited Warranty. See your GM Dealer for additional information.
