CONTROL MEASURES FOR THE WEED AS PER ORDER 20
Class 4: “The growth and spread of the plant must be controlled according to the measures specified in a management plan published by the local control authority and the plant may not be sold, propagated or knowingly distributed”.
CONTROL REQUIREMENTS FOR THIS WEED IN THE AREA OF OPERATION /
The above local control authorities specify the following measures to control this weed:
For small infestations (20 plants or less) on privately owned land, all plants must be removed / destroyed unless continuously prevented from flowering and fruiting. For large infestations, all plants must be controlled according to a property specific management plan authorised by the local control authority.
On public owned or managed land, the plant will be strategically controlled and reduced according to available resources and within legislative guidelines.
Note:
Council will only issue weed control notices where bushland, public open space and footpaths are affected by the plant. As per the discretion of Council a notice may be issued where other class 4 weeds are present or plants are affecting biodiversity. Council will only issue weed control notices where the plant is growing within 10 metres of bushland as defined by SEPP (Stage Environment Planning Policies) 19 as ‘land on which there is vegetation which is either a remainder of the natural vegetation of the land or, if altered, is still representative of the structure and floristics of the natural vegetation’.
If Council is approached by residents concerned about heath problems that the plant may be causing on adjacent properties not managed by Council, request for removal must be accompanied by a doctor’s certificate stating that it is causing health problems. Otherwise Council will act as an advisory service only and encourage the property owners to obtain advice on removal.
Council will not participate in negotiations or disputes between neighbouring property owners or residents concerning Privet growth. Neighbours in dispute will be encouraged to use the services of the community justice centres to resolve their differences.

Before commencing any chemical control program contact your local council's weeds officer for advice tailored to your situation. All herbicide use should be undertaken with a registered herbicide as specified on the herbicide product label.

PART 3: NOXIOUS WEED CONTROL ON LAND (Noxious Weed Act 1993):
Section 12 - Private occupiers of land must control noxious weeds on land.
Note: If occupier fails to comply with obligations under a weed control order, those obligations may be enforced against the owner of the land as well as the occupier by a weed control notice issued under section 18. Maximum penalty:
Section18 - Local control authority may require owners or occupiers of land (other than local control authorities) to control noxious weeds.
Note: The Act provides that the failure of an occupier to comply with a Section 18 Notice shall be liable to a penalty as prescribed by the Act. The Act provides that any cost and expenses reasonably incurred by the council in the exercise of its powers under Section 18 shall on demand be repaid to the Council by the occupier of the land concerned and may be recovered by the Council as a debt in a court.
