EXTERNAL PLACEMENT AGREEMENT

THIS AGREEMENT IS made this XXday of XX20XX

BETWEEN

EDITH COWAN UNIVERSITY ABN 54 361 485 361 of 270 Joondalup Drive, Joondalup, Western Australia 6027 (“ECU”)

AND

Name of legal entity (ACN/ABN) ofRegistered Address/Address of principal place of business(Placement Organisation)

This agreement shall apply to all the premises(including but not limited to schools, hospitals, health care facilities, laboratories, clinics and pharmacies),or sites (as appropriate) owned or operated by the Placement Organisation. This agreement shall be effective from the date of signature and shall remain in effect until modified by mutual agreement or terminated by either party, upon at least 6 months prior written notice.

1. EXTERNALPLACEMENT EXPERIENCE

1.1Subject to the terms of this agreement, the parties agree that ECU Students (Students)and any ECU staff supervising those Studentsmay access and utilise selected facilities within the Placement Organisation for the purposes of Students gaining external course related clinical or other work placement experience.

1.2The parties agree that on a case by case basis, prior to the commencement of each external placement to be undertaken byStudents at the Placement Organisation during the term of this agreement, the authorised nominees of each party shall liaise and agree the specific details for the placement including the following matters as appropriate:

  • the number of Students to undertake the relevant placement;
  • days and hours of attendance;
  • method of supervision and assessment;
  • any relevant health discipline specific requirements;
  • the nominated representatives of each party for liaison purposes in respect of the relevant placement; and
  • any other placement specific matters.

1.3The parties agree that a Student’s access to a patient or clientat the Placement Organisation’s premises (which may, where the premises is a school, include a staff member or student of the Placement Organisation) is and remains subject to the Placement Organisation’s overriding duty of care to those patients and clients and is conditional upon the relevant patient or client first giving consent to Student access.

1.4It is agreed that Students will practice skills appropriate to their specific course according to their level of learning.

1.5Where the placement relates to research or other projects, these activities will be approved prior to the placement by the appropriate committees of ECU and the Placement Organisation.

2.SPECIFIC RESPONSIBILITIES OF ECU

2.1 ECU agrees to liaise, through its nominated representatives, with the staff of the Placement Organisation regarding the placement and evaluation of Students.

2.2 The ECU nominated representatives for each discipline placing Studentsat the Placement Organisation will explain the ECU program for the relevant discipline to appropriate staff within the Placement Organisation.

2.3 The ECU nominated representatives for each discipline will communicate with the appropriate Placement Organisation staff in areas where Students are placed, on an on-going basis, on such matters as the year level of the Student, the objectives of the placement experience, and organisational matters as appropriate.

2.4 Any ECU staff supervising a placement will do so in cooperation withPlacement Organisation staff who have the responsibility for the administration of and/or quality of patient/client care/intervention.

2.5ECU will require all Studentsparticipating in a placement and any ECU staff supervising a placementto comply with the security screening requirements of the Placement Organisation and notify the Placement Organisation of any adverse findingsarising from the screening.

2.6ECU will use its best endeavours to ensure that Students understand their responsibilities in regard to meeting any travelling and accommodation costs incurred during the placement.

2.7ECU will ensure Students on placement and any ECUstaff supervising a placement are aware that they must comply with the reasonable policies, rules and regulations of the Placement Organisation.

2.8ECU agrees to provide and maintain appropriate public liability, personal accident, professional indemnity and workers’ compensation insurance cover for the ECU staff and Students entering the Placement Organisation’s sites or facilities for the purposes of a placement.

2.9ECU will indemnify the Placement Organisation, its employees and agents against any loss, damage, claim, liability, action, cost or expense incurred or sustained or made or brought against any of those indemnified parties arising from any negligent act or omission by ECU, its employees, or contractorsbut not to the extent that such loss, damage, claim or liability is due to the negligence of the Placement Organisation, its employees or agents.

2.10ECU agrees to provide ongoing educational supportto ECU staffand Placement Organisation Staffwho provide supervision to the Students on placement.

3. SPECIFIC RESPONSIBILITIES OF THE PLACEMENT ORGANISATION

3.1 The Placement Organisation agrees to liaise, through its nominated representatives, with the nominated ECU staff regarding the placement and evaluation of Students.

3.2The Placement Organisation will ensure that any of its staff supervising ECU Students on placement are suitably qualified and meet any requirements of the relevant discipline’s registration or accreditation body for the supervisionof Students on external placement.

3.3The Placement Organisation will ensure that where its staff provide supervision to ECU Students, those staff members will:

3.3.1 have ongoing and regular contact with their allocated Students;

3.3.2 provide oversight and direction of work during their allocated Students’ performance;

3.3.3 implement the educational content of the placement as negotiated with ECU;

3.3.4 assess their allocatedStudents’ performance as required by ECU, including defining and managing the standard of learning;

3.3.5ensure that their allocated Students only participate in the delivery of healthcare or treatment to a patient or client at levels commensurate with theStudents’ stage of preparation and progress in their course at ECU; and

3.3.6ensure that their allocated Student is only given access to a patient or client where that patient or client has provided consent to Student access.

3.4The Placement Organisation will allow, by prior notice and arrangement, the use of the Placement Organisation's available conference room space and facilities for teaching.

3.5The Placement Organisation will explain the nature and objectives of the Placement Organisation to Students prior to their placement and will provide an orientation to Students of the site where the placement will take place. The Placement Organisation will provide an occupational health and safety induction to Students on placement and any ECU staff supervising the placement.

3.6The Placement Organisation will allow Students and relevant ECU staff providing supervision or mentoring reasonable access to relevant clinical information including patient/client records subject to the confidentiality requirements of the Placement Organisation and relevant legislation.

3.7The Placement Organisation will make available to ECUStudents on placement, ECU’s relevant nominated representatives andother relevant ECU staff, its written rules, policies, procedures, regulations and administrative guides prior to the commencement of the placement.

3.8In respect to security screening for ECUStudents and staff, the Placement Organisation willnotify ECU of any change in its screening requirements at least three months prior to the change becoming effective.

3.9 The Placement Organisation will promptly notify ECU of any accident, illness or incidents involving a student.

3.10 The Placement Organisation will indemnify ECU, its employees, agents and Students on placement against any loss, damage, claim, liability, action, cost or expense incurred or sustained or made or brought against any of those indemnified parties arising from any act or omission by the Placement Organisation, its employees, contractors, subcontractors or agents but not to the extent that such loss, damage, claims or liability is due to the negligence of ECU, its employees, agents or Students.

3.11The Placement Organisation agrees to provide and maintain appropriate public liability, personal accident, professional indemnity and workers’ compensation insurance cover for its staff and contractors.Prior to the commencement of this agreement and thereafter when requested by ECU during the term of this agreement, the Placement Organisation will provide evidence of currency of these insurance policies.

3.12The Placement Organisation acknowledges that the contribution of ECU staff and Students is supernumerary for the purposes of determining the staffing establishment of the Placement Organisation.

3.13The Placement Organisationagrees that Students will not be employed by or receive remuneration from the Placement Organisation whilst undertaking a placement at the Placement Organisation’s site.

4.MISCELLANEOUS

4.1Save as otherwise provided for in this agreement, this agreement may not be varied or supplemented, except in writing signed by both parties.

4.2Nothing in this agreement creates a relationship of partnership, employment, joint venture or agency between the Placement Organisation and ECU or its Students.

4.3Any failure by a party to exercise, or delay by a party in exercising, any right against the other party under this agreement cannot be taken as a waiver of the right or as an election not to exercise that right or any other right.

4.4This agreement is governed by the laws in force in the State of Western Australia. Each party submits to the non-exclusive jurisdiction of the Court of Western Australia.
