TermsofLetting

Supervision

TheHirerwill,duringtheperiodofhire,beaccountableas“ResponsiblePerson”for:

  • The Supervisionofthepremises,
  • The Fabricandthecontents of the facility (care from damage however slight).
  • The Behaviorofallpersonsusingthepremises. (Whatevertheir capacity).

UseofPremises

TheHirershallnotusethepremisesorthecentreforanypurposeotherthanthat describedinthehiringagreement,andshallnotsubhireorusethepremisesor allow thepremisestobeusedforanyunlawfulpurposeorin anyunlawfulway,nordo anything,orbringintothecentreanythingwhichmayendangerthesame,orrenderinvalidanyinsurancepoliciesinrespectthereof.

CareofPremises

Noapplicationwillbeacceptedfromanypersonundertheageof18years.TheHirerwill beresponsibleforanyloss,theftordamageoccasionedtothecentreoranyequipmentduringthetermofhiring,whichwillbepaidforatactualreplacementcost,and/or deductedfromasecuritydepositof£100whichmaybechargedincertaincases.

Liability

TheAssociationwillnotacceptliabilityfordeathorinjurysustainedbytheHirer,his/her guestsor otherpersonsattendingthecentreunless,andonlyif,itisattributabletotheAssociation’snegligence.TheAssociationwillnotacceptresponsibilityorliabilityforany lossor damagetoanyvehicles,goods,articlesorequipmentbroughttoorleftatthe centre,whetherbytheHireroranyotherperson.

AccessbyAssociation

TheHirershallondemand,affordaccesstotheAssociationstaffortheiragents,and conformtoanyreasonableinstructionsthattheymaygive.

ConsumptionofAlcohol

Alcoholand/ortheconsumptionofalcoholisnotpermittedwithinanypartofthe centreasageneralrule.Occasionalconsumptionofbeerandwine(withoutcharge)onspecialoccasionsin theHallandothermeetingroomsisallowed,onlywiththewritten permissionoftheAssociation.ApplicationsforpermissiontoservealcoholataneventmustbemadeinwritingwhentheAssociationwillconsidereachrequestonitsown merits.Inallcases,adepositofnotlessthan£100willberequestedwhichshouldbe lodgedwiththeAssociationnotlessthantwoweeksbeforethehireisdue.

RemovalofProperty

PropertybelongingtotheAssociationmustnotberemovedfromthecentreunderany circumstances.

Parking

There is no on site parking available during school hours in term time. There is limited space available for Blue Badge holders only during these hours, please contact us to discuss your requirements. Hirersareadvisedto askdelegatesto share carswherever possible.Informationabout publictransportanddirectionstotheBradburyCentrecanbe found on our website.

Smoking

TheBradburyCentreisdesignatedasatotallynosmokingbuildingandyouareasked kindlytorefrainfromsmokingwhilstonthepremises.Ifyouwishtosmokeoutsidethe building,theONLYareainthegroundsavailableforthispurposeisinthelefthand cornerofthecarparkasyouexitthebuilding.PLEASEDONOTSMOKEOUTSIDE RECEPTIONORTHESCHOOLGATES.Kindlydisposeofallbuttsin thebinprovidedinthe smokingareaandnotintheflowerbeds.

SafetyPrecautions

Alldoors,gangways,exitnoticesandexitsmustbekeptclearofobstructionsatalltimes.Allfiredoorsmustbekeptclosedwheremarked.Appropriatefireexitdoorsmust notbelockedduringthetermofhiringandthisincludesthepooldoorswhichmust remainunlockedduringuse.Fireprecautionsmustbeobservedand theHirermustundertaketoknowthelocationofallfireextinguishersandexitdoors.

SafetyofElectricalEquipment

ItisarequirementthattheHirerholdsavalidElectricalTestcertificate(PAT)foreachelectricalapplianceorcablebroughtintothe premisesduringthehiringperiod.

Cancellation

IftheHirercancelsabooking,treatmentofanydepositpaidshallbeinaccordancewith thepolicyoftheAssociationinforceonthedatethebookingwasmade.Detailsareavailableuponrequest.

Wewillonly acceptcancellationsinwriting, andat least21daysbefore theevent.Anycancellationoutsidethe21 daysmayincurthe fullinvoicedtotal.Verbal cancellationswill notbeaccepted.

Insurance

HiringratesincludePublicLiabilityInsurancearrangedbytheAssociation.Acopyis availableonrequest.

Animals

TheHirershallensurethatnoanimals,exceptguidedogs,arebroughtintothecentre otherthanatspecialeventswhichhavegainedprioragreementfromtheAssociation. Noanimalsaretoenterthekitchenor hydrotherapypoolatanytime.

Food,HealthHygiene

TheHirershallnotbringfoodforconsumption/saleintothepremiseswithoutprior permissionbeingsought.Ifexternalcaterersareusedacharge of £25 will be made if the premises are not left as found (clean and tidy). Ifpreparing,servingorsellingfood,allrelevantfoodhealthandhygiene legislationandrequirementsmustbeobserved.Thekitchen,wherehired,mustbeleftinacleanandtidyconditionwithall washingupdoneandanyutensilsreplaced.Hirersmustnotuseanyfoodfromcupboards,freezers orfridgesunlessby prior agreement.Ifthekitchenneedstobecleanedaftertheperiodof hire,therewillbeaminimumchargetotheHireroftwohours,(seeendofhire).

AccidentsDangerousOccurrences

TheHirermustreportallaccidentsinvolvinginjurytothepublic,tothestaffondutyas soonaspossible.Anyfailureofequipment,eitherthatbelongingtothecentreor broughtinbytheHirer,mustalsobereportedassoonaspossible.Certaintypes ofaccidentorinjurymustbereportedona specialformtotheHealthSafetyExecutive. TheAssociation’sEstates Managercanadviseandassist.Thisisinaccordance withthe“ReportingofInjuries,Diseasesand DangerousOccurrencesRegulation1995 (RIDDOR)”.

CompliancewithLegislationLicenses

TheHirershall,as“ResponsiblePerson”,ensurethatanyactivitiesforchildrenundereightyearsofagecomplywiththeprovisionsoftheChildrenAct1989andthatonlyfitandproperpersonshaveaccesstothechildren.TheHirermustnotdoanythingthat wouldbreachanylegislationsaffectingthecentreoritsuse.TheAssociationhasa licenseforPublicMusicanddancingwhichhasstricttimeconstraints.

Noise

TheHirershallensurethattheminimumamountofnoiseismadeduringtheperiodof hireandparticularlyonarrivalanddeparture.Discoswillnotuseartificialsmokeasthiswillsetoffthefirealarm,thuspotentiallyterminatingthehire.Useofcandlesisnot permittedwithoutthepermissionoftheAssociation.MUSICMUSTENDAT10PM,THE ROOMCLEAREDANDTIDIEDANDALLPERSONSOFFTHEPREMISES,INCLUDINGCAR PARK,BY10.30PM.Pleasebeawarethattherearechildrenonthepremisesandhirers arerequestedtoleaveasquietlyaspossible.

CorporateHire

Anycompany/grouphiringthepremisesmustidentifya “ResponsiblePerson”onthebookingformtoberesponsibleforensuringtheHirercomplieswiththeseterms.

Filming

TheHirermustnotuseorpermitanycameras,camcordersorotherfilmingequipment tobeusedwithouttheAssociation’swrittenpermission.

Termination

IftheHirerfailstocomplywithanyofthesetermstheAssociationmayimmediatelyend theperiodofhirewithoutbeingrequiredtomakearefundofanyfee.Withoutlimiting theAssociation’srights,it maychargetheHireranyexpensesincurredinputtingrightthebreach.

EndofHire

Attheendofthehireperiod,TheHirermustleavethepremisesinacleanandorderlystate,freeoflitter,andshallremovealltheirpersonalarticlesandequipmenttheyhave broughtin.Pleasenote:TheAssociationwillmakeachargetotheHirerofthehourly rateshouldtheagreedperiodofhirebeexceeded.Additionalcleaningchargesof£10 perhourmayapplyif extracleaningisneededfollowingthehire.Bothofthesefigures willattractVATatthecurrentrate.Thereisalsoasurchargeforoutofhoursbookings, pleaseseecurrentpricelistfordetails.

Data Protection

The RoseRoad Associationwillnotdisclosethis informationtoanyother personororganisation,exceptin connectionwiththeHirer’s use of the facilityand for internal administrationpurposes.

TelephoneandMobilePhones

Youmayuseourbusinesslinesforemergenciesonlyorbypriorarrangementbythe Association.Wewouldpreferifyoucouldturnmobilesoffbutifyouneedtousethem, couldyoupleasedosoonlywithinyourbookedroom,atreceptionoroutsidethe building.

FireEvacuation

Onhearingthefirealarm,pleaseevacuatethebuildingbythenearestemergencyexit(signsaroundthebuildingwillshowyouwheretheseare),andgatherattheFire AssemblyPointswhereaheadcountwillbeconducted.If youhaveattendedatraining sessionforaspecificroomor forthehydrotherapypool,pleasefollowtheinstructions givenduringyourtraining.

Toilets

AlltoiletswithintheAssociation,withtheexceptionofsomestafftoilets,aredesigned fordisableduse.PleasedonotuseanyoftheHoistsunlessyouhavehadtraining.Anyonefoundusinghoistinaninappropriatemannerordamagingthemwillbeliable forthedamagesandmaybeaskedtoleavethebuilding.

Safetyof AssociationChildrenandYoungAdults

Partsofthebuildingareonlyaccessiblebycodepadsforthesafetyandprotectionof ourchildrenandyoungadults.TheHirerandtheirguestsareexpectedtoremainonly withinthevicinityoftheirhiredfacilityandnotwanderaroundthebuilding.Inappropriateusecouldbedangerousandisnotpermitted.

AssessmentofFacilities

Toassistusinevaluatingthequalityandefficiencyoffacilitiesandserviceswithinthe BradburyCentrewevalueyourfeedback.PleasespeaktotheReceptionistondutyif youhaveanysuggestions,complaintsorgeneralfeedback.Weappreciateyour constructivecomments.

NoWarranty

TheAssociationgivesnowarrantythatthepremisesarelegallyorphysicallyfitforany particularpurpose.

DuringtheperiodofhireRoseRoadstaffwillbeonthepremisestoadviseandassist. Theycanbecontactedbyringingextension200fromtheinternalphonesorvisiting Receptiononweekdays.Atweekends,pleaseseethecaretakingstaffonduty.

Acceptance of the Terms of Letting

  • I, the undersigned, have read the Terms of Letting and agree to adhere to them whilst using the facilities.
  • I understand that failure to comply with these terms may result in the termination of any future bookings and a charge being made for any equipment damaged at the actual replacement cost price.
  • I understand that these are guidelines and the safety of those using the facilities is at all times the sole responsibility of the hirer.
  • I know that if I have any queries or problems relating to the use of the rooms I can contact Reception on 023 8072 1234 for help and advice.
