Terms and Conditions

Equinox Sailing and the yacht are fully insured against accidents and third party liability and while we operate a duty of care on board, we are unable to take responsibility for each student’s personal actions and effects.

We recommend you to arrange your own insurance cover for cancellation, injury, personal belongings and personal liability.

In the following terms, the word ‘event’ is used to describe all courses, cruises and race participation run by Equinox Sailing.

Booking and Payment

The 25% deposit is non-refundable once a booking form has been received and accepted. The balance of monies shall become payable four weeks before the event commencement date.

All bookings made within four weeks of the event date must be paid in full at the time of booking.

If the balance is not paid on time we may cancel your place on the event and apply the cancellation charges set out below. The event deposit is non-refundable unless we are unable to honour your original booking request.

Payment can be made by cash, cheque or bank transfer using the details listed on the booking form. A completed Booking Form must be signed by the event attendee and must be accompanied by your deposit or full event fee.

We will send you a confirmation with the costs and details of your event. It is your responsibility to check the details on the invoice and to promptly inform us of any discrepancies.

Once a booking form and deposit have been received the booking Terms and Conditions shall become binding.

Cancellation or Amendment
In the event that you need to cancel more than 30 days prior to the event start date, we will be entitled to keep your deposit payment and will refund any further event fees received.

In the instance that you need to cancel less than 30 days prior to the event start date, the full fee is non-refundable.

If we are able to re-book the place on that event, a proportion of the event fee may be refunded at our discretion.

If you wish to amend your event booking for another date, we will make every effort to accommodate this but any changes may be subject to a sum of £25 to cover our administrative costs. If we are unable to amend your booking and you are unable to attend the event on the original date booked, the cancellation fee will become applicable.

If you need to cancel or amend your booking, we ask that you do so in writing.

We withhold the right to cancel an event if there are insufficient bookings. In this instance, all fees received will be repaid. Refunds will be limited to monies already received from you in respect of that event.

Sailing is a weather dependent sport and we cannot be responsible for sailing time lost due to inclement weather. If an event is cancelled due to severe weather an alternative date within 3 month may be booked.
We will be unable to refund fees if a race is cancelled.

Obligations of the Student

Sailing is an activity sport and it is your responsibility to ensure you are fit and healthy to take part. Your booking is accepted on the basis that all details in respect of your health and sailing experience are true and accurate and while illness does not preclude you from taking part, we must have relevant details.

Please check with your GP if you are in any doubt.

All sporting activities carry an element of risk of personal injury and attendees should accept the risks associated with the activity of their choice. To ensure risks are kept to a minimum you must comply with all safety regulations stipulated by your instructor and not take any action which may jeopardise the safety of fellow students, skippers or other vessels.

A zero-tolerance policy will be adopted towards any unacceptable behaviour to fellow crew members or neighbouring vessels. We reserve the right to terminate the offending individual’s place on the event and under such circumstances fees will not be refunded.

It is strongly recommended that all those participating in the sport of sailing should be able to swim. If you are a non-swimmer, it is essential you make your instructor aware and they will ensure you wear a life jacket at all times, on deck or in a dinghy.


Obligations of Equinox Sailing

We will provide a fully qualified instructor to provide the course syllabus as laid down in the RYA G15 log book.

Your event will take place on a yacht in good seaworthy condition and fully compliant with the MCA/RYA regulations. If during the course the yacht becomes damaged or if there is a breakdown in the machinery and the yacht becomes unfit for use, we will endeavour to provide an alternative yacht to enable the event to continue. If a suitable alternative yacht cannot be found, the course may be rescheduled to another date to suit all parties.

We reserve the right to use alternative yacht other than those specified in our literature. In this instance, the vessel will be fully compliant as required.

If due to unforeseen circumstances an alternative yacht cannot be provided, we will refund all course fees in full.

In relation to the RYA courses, certificates are issued in line with the RYA guidelines. If it is the opinion of your instructor that you will not reach the necessary standard during the course, they will work with you to develop an action plan to help you meet the required standard in the future.

From the 1st April 2013, all RYA practical Day Skipper and Coastal Skipper certificates will no longer be issued on paper. All successful students will receive a photo ID certificate and their name and address will be shared with the RYA for the purposes of registering the certificate.

The data will not be shared with any third party for marketing or commercial purposes without first obtaining the students explicit consent.

Please let us know if you would prefer your details are not shared with the RYA.

Should you feel that the course/event may not have met your expectations, or should you have reason to make a complaint, please make it known to your instructor at the earliest opportunity so that we may rectify it as soon as possible. We would like to have the opportunity to deal with any issues at the time they arise so we can rectify them immediately. Should you feel that your complaint was not dealt with in a satisfactory manner, please contact us on 020 7002 7676. All complaints will be recorded to enable us to monitor our performance.
