1.Forthepurposesofthisrule,thecalculationofsubdivisionsitedensitymustnotincludeaccesssitesandanysitecreatedforutilityorcommunalpurposesforwhichconsenthasbeengranted,andthatdoesnotallowfortheestablishmentofafuturedwellings,butincludestheareaoccupiedbythosesites.

2.ThisruleappliesonlyuntilsuchtimeasthenumberofdwellingsintheWhitfordAandBsub­precinctsdonotexceedatotalof925dwellings.Thiswillbecalculatedbycombiningapprovedsitesallowingtheconstructionofdwellings,existingdwellings,anddwellingsforwhichtherearelanduseconsents,CertificatesofComplianceandbuildingconsentsthathavenotlapsed.

3.Thecalculationofmaximumpermittedsitedensitywillexcludefromtheareaoftheexistingsiteanyareaofplantingpreviouslylegallyprotectedorpreviouslyrequiredtobelegallyprotectedpursuanttothesesubdivision.

4.2Sites

1.Theexistingsite:

a.Forthepurposesofthisrule,existingsitemeansallthelandheldinaseparatecertificateoftitledated8July2005.ThiswasthedateforpublicnotificationoftheWhitfordruralplanchange.

2.Subdivisionmaybecarriedoutinstagesbymakingreferencebacktotheparentsiteexistingasat8July2005providedthetotalnumberofsitesdoesnotexceedthemaximumsitedensity.

3.Whereanapplicationforsubdivisionconsentincorporatestwoormoreadjoiningexistingsites,thetotalareaofthelandsubjecttotheapplicationmaybetreatedasonesiteforthesolepurposeofconfiguringanddesigningthesubdivision.Thenumberandsizeofproposedsitesintheapplicationmustnotexceedthetotalnumberandsizeofsitesthatwouldotherwisebecreatedasarestricteddiscretionaryactivityforeachoftheindividualexistingsites.

4.Inrespectofanysitewithinasubdivisioncapableoffurthersubdivisionundertheserules,nofurthersubdivisionofthatsitemaybedoneifitwouldresultinthetotalpermitteddensitybeingexceededwithrespecttotheexistingsite.Thisrequirementistobesecuredbyasuitablelegalinstrumentwhichmustberegisteredoncertificatesoftitletoensureongoingcompliancewiththisrule.

5.Whereanapplicationforsubdivisionconsentisforanexistingsiteheldinaseparatecertificateoftitleon8July2005andcontainslandbothinsideandoutsidetheWhitfordprecinct,theareaoflandcontainedwithintheprecinctmustbeconsideredtheexistingsiteorparentsiteundertheserules.LandoutsidetheWhitfordprecinctmustnotbeusedinthecalculationoftheaveragesitesizeforsubdivision.

6.WhereanapplicationforsubdivisionconsentincludesproposedsitesthatcrosstheWhitfordAandBsub­precinctsboundaries,nolessthan50percentofthenetsiteareaofaproposedsiteshallbe

locatedwithintheWhitfordAsub­precincttoqualifyasasitemeetingtheminimumsitearearequirementundertheserules.

4.3Riparianmanagementindicative constraintsarea

1.PrecinctPlan1:LocationofpermanentstreamsandslopeindicativeconstraintsareasandPrecinctPlan2:Locationofpermanentstreamsandnativevegetationindicativeconstraintsareas,clause8below,illustratetheindicativelocationofpermanentstreams.WherethereisconflictbetweenthelocationofapermanentstreammappedinPrecinctPlans1and2andthephysicallocationofthepermanentstreamonthesite,thephysicallocationofthepermanentstreamonthesiteapplies.

2.Aminimum10mstripmustbeplantedinaccordancewiththeprecinctrulesandfencedofffromeachbankofallpermanentstreamsandwillconstitutetheriparianmanagementindicativeconstraintsarea,providedcouncilmayapproveanalternativemeansofexcludinglivestock.Thisconstraintsareamustalsoincludeanywetlandareasassociatedwithpermanentstreamsonthesite.Wherethereisnoobviousstreambank,atwo­yearARIeventwaterlevelasdeterminedbyasuitablyqualifiedandexperiencedpersonwillbeusedtodeterminethestreambank.

3.Allbuildingsandstructuresexcludingfencingmustbesetbackaminimumof5mfromtheconstraintsarea.

4.Wheretheplantingandrevegetationrequiredwillbecontiguousovermorethanthreesites,amanagementstructureorongoingarrangementmustbeestablishedtoensuretheongoingintegratedmanagementandmaintenanceofthisplantingandrevegetation.

5.Wherethereisproductionforestrythatwasinexistenceat8thJuly2005andislocatedwithintheriparianmanagementindicativeconstraintsarea,thecouncilmayconsenttoapostponementoftheplantingrequiredunderthisclause.Thispostponementcanbenolongerthan12monthsaftertheclearfellingharvestofthetrees.

6.SeeAppendix11.6.4Whitfordguidelinesfornativerevegetationplantingsfortherequiredplantingandmanagementmeasuresthatrelatetothisclause.

4.4Wastewaterdisposal

1.Eachsitemustcontainanareaofatleast2500m2exclusiveofanyaccessareasandmustcontainaspecifiedbuildingareaalongwithsufficientlandforeffluentdisposalfields.Thelandidentifiedforeffluentdisposalmustincludeprovisionforanominatedwastewaterdisposalmethodappropriatetothesitecharacteristics.Thedesignandassessmentmustincludeanappropriateengineeringandgeotechnical assessment.

2.Rule1abovewillnotapplywhenasuitablepackagetreatmentplantsharedbetweentwoormoresitesisconstructedandoperated.Thetreatmentandlandapplicationdisposalsystemmustbeapprovedbycouncil.Theminimumsitesizeforasiteservicedbyapackagetreatmentplantis1000m2.

3.Anywastewaterdisposalsystemmustbemaintainedonanongoingbasis.Maintenancerecordsmustberetainedandmadeavailableoneachsiteforinspectionbycouncilofficersortheiragents.

4.Eachwastewaterdisposalsystemmustbelocatedonthesamesiteasanydwellingitservicesunlessabindingagreementisenteredintobetweenanyindependentsiteandthedwellingservedbythatwastewaterdisposalsystem,confirminganongoingarrangementexistsforthewastewaterdisposalsystemtocontinuetotakeandtreatthewastewaterfromthosedwellingsunits.

4.5Stormwatermanagement

1.TheAuckland­wideearthworksrules,clause4.2apply.

2.Stormwatermanagementmeasuresmustbeinplacepriortoanyimpervioussurfacesbeingformedonthesiteandmayneedtobeconstructedatthetimeofsubdivisiontotheedgeofthespecifiedbuildingarea.Thefollowingdesignprinciplesmustbeincorporatedintothelayoutanddesignofsubdivisionsandroads:

a.thepermanent,intermittentandephemeralstreampatternsmustberetained

b.theremustbenodirectpipingofstormwaterdischargestopermanentstreams

c.modificationstopermanentstreamsmustbeavoided

d.appropriatemethodsofstormwaterdetentionmustbeundertakenbeforestormwaterisdispersedintopermanentstreams.Thesemayincludethefollowingmethodswhereappropriate:waterreuse,swalesanddepressionlandscaping,dispersionintovegetativefilters,dispersaltrenches,detentionponds,detentiontanksandvegetationplanting.

4.6Environmentalmitigationandenhancement

1.ThepermanentprotectionofallareasofexistingnativevegetationshownonPrecinctPlan2:Locationofpermanentstreamsandnativevegetationindicativeconstraintsareas,clause8below,istobesecuredbyasuitablelegalinstrumentwhichmustberegisteredoncertificatesoftitleandbindingonsuccessorsintitle,andistoprovideforthefollowing:

a.arequirementnottodestroyordamageexistingareasofnativevegetationshownonPrecinctPlan2,theexactdimensionstobeconfirmedatthestageofsubdivision

b.alllegallyprotectedareasmustbefencedunlessthecouncilapprovesanalternativefencinglayoutwhicheffectivelyexcludesalllivestockfromsuchareas.

2.Wheretheareaofexistingvegetationrequiredtobeprotectedin1aboveislessthan1haforeachadditionalsitecreated,additionalnativevegetationplantingwillberequiredtoprovideaminimumof1hainWhitfordAsub­precinctand5000m2inWhitfordBsub­precinctforeachadditionalsite.

3.Theminimumrequirementin2abovecaninclude:

a.theplantingrequirementfortheriparianmanagementindicativeconstraintsareainclause4.3above;and/or

b.theplantingrequiredforslopesgreaterthan15degreesinclause4.7below;and/or

c.areasofnativevegetationshowntohavebeenspecificallyplantedforenhancingormitigatingprovidedthisdoesnotincludeanyareaplantedasaconditionofanypreviousresourceconsent,orthroughpublicfunding.

4.TheplantingrequirementmustbelocatedwithintheWhitfordprecinctandmustbeconfinedtoareaswhereplantingwillprovide:

a.valuableecologicallinkages;and/or

b.significantbenefitsandimprovementstowaterqualityandlandstabilitywithintheWhitfordprecinct;and/or

c.enhancementofexistingwatercoursesandanywetlandareastoensuretheirlongtermhealthandviability;and/or

d.asignificantandsustainableforestinitsownright.

5.Wheretheplantingandrevegetationrequiredunderthisrulewillbecontiguousovermorethanthreesites,amanagementstructureorotherappropriateongoingarrangementmustbeestablishedtoensureongoingintegratedmanagementandmaintenanceofthisplantingandrevegetation.

6.TheplantingplanforthisclausearecontainedinAppendix11.6.4Whitfordguidelinesfornativerevegetationplanting.

7.Exception.Whereproductionforestrywasinexistenceasat8July2005andislocatedwithintheconstraintsareaortheslopesindicativeconstraintsarea,councilmayconsenttoapostponementoftherequiredplanting.Thispostponementmaybenolongerthan12monthsaftertheclearfellingharvestoftreeswithineithertheriparianconstraintareaortheslopesconstraintsarea.Aconditionof

subdivisionconsenttothiseffectwillbeimposedtoensurecontinuingcompliancebythesubdividingownerandsubsequentowners.Aconsentnoticewillalsobeissuedunders.221oftheRMAspecifyinganysuchcondition.TheconsentnoticewillberegisteredagainsttheCertificatesofTitletotherelevantsitesandwillbindallsubsequentownersoftheland.

4.7Slopes indicativeconstraintsarea

1.Forsitescontainingslopessteeperthan15degreesshowninPrecinctPlan1:Locationofpermanentstreamsandslopeindicativeconstraintsareas,clause8,areportmustbepreparedbyasuitablyqualifiedandexperiencedpersonidentifying:

a.slopessteeperthan21degrees

b.anyslopesthatexhibitsignsofinstabilityorpasterosion

c.anyslopessubjecttoerosioninviewoftheirsoilandslopecharacteristics.

2.Alllandidentifiedinclause4.7.1.aabovemustbeplantedinaccordancewithclause4.10providedtheplantingwillnotapplyonslopessteeperthan21degreesifareportpreparedbyasuitablyqualifiedandexperiencedpersonconfirmsthereisnoneedasthoseslopesdonotexhibitsignsofinstabilityorpasterosion,orarenotsubjecttoerosioninviewoftheirsoilandslopecharacteristicse.g.rockycliff,and:

a.stockistobepermanentlyexcludedfromthoseslopes

b.theareaistobemaintainedinaccordancewithamanagementplanthatcontrolsweedsandpests.

Whereaproductionforestwasinexistenceon8July2005andislocatedwithintheconstraintarea,thecouncilmayconsenttopostponingtherequiredplantingunderthisrule.Thispostponementmaybenolongerthan12monthsaftertheclearfellingharvestoftreeswithintheconstraintareaatwhichtimetherequiredplantingwill

bedone.

Aconditionofsubdivisionconsenttothiseffectwillbeimposedtoensurecontinuingcompliancebythesubdividingownerandsubsequentowners.AconsentnoticewillalsobeissuedundertheRMAspecifyinganysuchcondition.Theconsentnoticewillberegisteredagainstthecertificatesoftitletotherelevantsitesandwillbindallsubsequentownersoftheland.

4.8Recreationaltrails

1.WherelandwithrecreationaltrailsasshownonPrecinctPlan3:Locationofcoastalandscenic amenityindicativeconstraintsareas,clause8,issubdividedordeveloped,orwherethefirstofanyoneormoreofthesiteslegallydescribedasallotments57,58or59ParishofMaraetaiissubdividedordeveloped,thenprovisionforthetrailsmustbemadeasfollows:

a.thetrailroutemustbegenerallyinaccordancewiththatindicatedonPrecinctPlan3exceptthatatrailbetweenpointsAandBistobeestablishedonlandownedbythecouncilunlessanalternativerouteisestablishedbyagreementbetweenthecouncilandtheowner(s)ofthelandthroughwhichthealternativeroutewouldpass

b.thetrailshouldprovideaccesstoscenic,historicandecologicalfeaturesinthelocality

c.thetrailshouldbeindependentoftheroad

d.whereitisnecessaryforthetrailtobeprovidedinconjunctionwitharoad,thecouncilmayrequirewidenedbermsandotheramenityfeaturesalongthetrailroute

e.whereitisnecessarytocrossamajortrafficroute,councilwillconsiderthepracticalityofrequiringtrafficcontroldevicestohelptrailuserscrosssafely

f.thetrailrouteshouldbesitedclearofthe1percentAEPfloodpathofanynaturalstreamsystem

g.wherethetrailrouteisprovidedbymeansofapedestrianaccessway,thelegalwidthoftheaccesswayatanypointmustbenolessthan6munlesscouncilbelievesareducedwidthcanprovidetherequiredlevelofaccess

h.thetrailmustbevestedincouncil.

2.Wherearecreationaltrailisrequiredasaconditionofapprovalforaresourceconsent,includingsubdivision,thefollowingdesignstandardsmustapply:

a.recreationaltrailsindependentofroads

i.

ii.

minimumwidthbetweenboundariesof5mandminimummetalledformationwidthof3mwatertablesandculvertsmustbeprovidedwhenrequiredforstormwatercontrol.

b.Recreationaltrailsalongroadberms:

i.minimumwidthof3mandaminimummetalledwidthof2m.

c.provisionmustbemadeinthesubdivisionplanforanyrecreationaltrailshownontheplanningmapsthattraversesthesitetobevestedincouncil.Thetrailmustbelocatedatapracticablealignmentandgrade.

4.9Additionalsubdivisionforsignificantenhancementplanting

Thecouncilmaygrantconsenttothesubdivisionoflandforthepurposesofenablingsignificantenhancementplantingareaswherethefollowingstandardsaremet:

1.Numberofsites:

Sitesmaybecreated,additionaltothenumberthatwouldotherwisebepossiblepursuanttorule4.1,providedthat:

a.4haofnativevegetationisplantedforeachadditionalsiteinaccordancewithrule4.10.

b.themaximumnumberofsitescreatedfromanyexistingsitemustnotexceedthatprovidedforinthefollowingtable.

4.10Minimumstandardsforplanting

1.Thisruleappliestoplantingrequiredorproposedpursuanttorules4.3­Plantingintheriparianmanagementindicativeconstraintarea,4.6­Plantingforenvironmentalmitigationandenhancement,and4.7­Plantingintheslopesindicativeconstraintsarea.

2.Are­vegetationplanandprogrammecoveringthefollowingmattersisrequired:

a.pre­plantingsiteassessment

b.plantingplanassessment

c.annualmonitoringprogramme.

3.Plantingmustbeataminimumdensityof1.4mcentres­5100stems/ha.Agreaterdensitymayberequiredinsomesituations,forexamplewherethereisasignificantweedinfestationortheplantingisclosetostreamsorwetlands.

4.Permanentprotectionofplantingandrevegetationareasistobesecuredbyasuitablelegalinstrumentwhichmustberegisteredagainstthecertificatesoftitleforrelevantsitesbeforecouncilissuesthes.224(c)certificateundertheRMA,andmustincluderequirements:

a.nottodestroyordamageprotectedvegetation

b.forprotectedvegetationtoremainundisturbedandweedsandpeststobeadequatelycontrolled
