2.3Minimumsite size

1.Thesitecreatedbythesubdivisionmustbebetween4,000m²­5,000m².

2.Thesitecreatedmustnotbeusedinanyboundaryrelocationsubdivisiontocreatesitesgreaterthan4,000m²­5,000m².

3.Anyboundaryrelocationmustnotresultinthesitecreatedbythesubdivisionhavingasiteareaoflessthan4,000m²orgreaterthan5,000m²andanyreductioninthesizeofanybalancesitecreatedbythesubdivision.

4.Forsitescreatedfortheprotectionofwetlandsthefollowingminimumsitesizeapplies:

a.Wheretheprotectedwetlandistoremainontheparentsitethenewruralresidentialsitemusthave:

2.4Minimumfrontageandaccess

1.Theminimumfrontageofsitesmustbe6mprovidedthatuptofivesitesmaygainfrontageoverajointlyownedaccesssite,rightofwayforthebenefitofsites,oracombinationofboth,notlessthan6m width.

2.Inadditiontothemeetingthecontrolsinclause2.4.1,forsitessubdividedunderclause2.2.2(b)above,theminimumsitefrontageforthebalanceareamustbe6m.

2.5Designof subdivision

1.Forsubdivisioninaccordancewithclause2.1.1(a)thefollowingcontrolsapply:

a.Appropriatelegalmeasuresmustbeputinplacetopreventfurthersubdivisionofanybalancearea.

b.Thesiteshapesmustbevariedsothatsubdivisiondoesnotresultinuniformsettlementpatternsthatarecharacteristicofurbanorsuburbandevelopment.

c.Aconservationsubdivisionplanmustbecompletedinaccordancewiththeclause4.1.1below,andmustincludeadetailedsitedesignplantoaddresstherelevantmattersofdiscretionsetoutinclause3.1.

d.Theconservationsubdivisionplanmustbeusedasthebasisfortheplansofsubdivisionandmustbesubmittedwiththeplanofsubdivision.

e.Theplanofthesubdivisionmustprovideappropriatelegalmechanismstoensuretheavoidanceoftheconstraintsandmitigationand/orpermanentprotectionvaluesidentifiedintheconservationsubdivisionplan.

2.Forsubdivisioninaccordancewithclause2.1.1(b)thefollowingcontrolsapply:

a.Aconservationsubdivisionplanmustbecompletedinaccordancewithclause4.1.1below,andmustbeusedasabasisfortheplanofsubdivision.

b.Theconservationsubdivisionplanmustbesubmittedwithaplanofthesubdivision.

c.Theplanofthesubdivisionmustprovideappropriatelegalmechanismstoensuretheavoidanceoftheconstraintsandmitigationand/orpermanentprotectionvaluesidentifiedintheconservationsubdivisionplan.

2.6Definedbuildingarea

1.Eachdefinedareaforbuildingmustbeidentifiedonthegroundbeforetheproposedplanofsubdivisionissubmittedforapproval,andmustbeshownonallplansofsubdivisionsubmittedforapproval,includingtheplansubmittedfordeposit,anditsexistencemustbenotedonthetitleforeachsitepursuanttoaconsentnoticeunders.221oftheRMAorsimilarmechanism.

2.7Riparianmarginstandards

1.Allstreamandrivermarginsmustbeprotectedinthefollowingmanner:

a.Astockprooffencemustbeerectedthefollowingdistancefromthetopofthebankofthestreamorriver:

i.

ii.

Aminimumof10meachsideofthestream(includingephemeralstreams)wherethestreamisanaveragewidthacrossthepropertyoflessthan3m;or

Aminimumof20meachsideofthestreamwherethestreamisanaveragewidthacrossthepropertyofgreaterthanorequalto3m.

2.Aminimumof10mfromthestreamorrivermustbeplantedinnativevegetationincompliancewiththecontrolsinclause2.9,exceptthatwherethedistancebetweenthestreamorriverandthestockprooffenceislessthan10m,itisonlytheareabetweenthestreamorriverandthestockprooffencethatistobeplantedinnativevegetation.

3.Thenativevegetationmustbeforthepurposeofriparianmarginprotectionandmustnotbeclearfelledorremoved.

4.10%oftherequirednativeplantingmaybesubstitutedwithexoticspecimensprovidedthattheplantingstandardspecifiedinclause2.9isappliedasiftheplantingwere100%native.

5.Acovenantforthepermanentprotectionofthenativevegetationintheplantedareamustbeapplied.

6.Theplantedareamustbekeptfreeofstock.

7.Thecontrolsinclauses2.7.1­2.7.6donotapplywherethelandwithinthe20mofthestreamorriverbankistobevestedasapublicreserveinthesameapplicationforsubdivision.

8.Whereexoticsareincludedinaplantingplanrequiredbyclause4.3,writtenconfirmationmustbeprovidedfromapersonqualifiedandexperiencedinvegetationrestoration,thattheexoticspecieswillnotcompromisethelongtermsustainabilityofthenativeplanting.

9.Willowandpoplarspeciesmustbeavoidedunlesstheirusecanbedemonstratedasbeingnecessarytocontrolactivelyerodingsitesexhibitingsignsofsevereerosion.

Whereastreamorriverformstheboundaryofanothersiteandtheboundaryiscommontotheproposedsiteandtheparentsite,bothsidesofthestreamorrivermustbefencedandplanted,otherwiseonlythatsidewithintheproposedsitemustbefencedandplanted.

Forthepurposesofthiscontrol,anephemeralstreamisachannel(includinggrassedchannels)indicativeofrecurrentwatermovementofreasonablefrequency.

2.8Managementofoverlandflows

1.Allsubdivisionandsubsequentdevelopmentshould:

a.haveregardtoanyrelevantadoptedCatchmentManagementplanand/orComprehensiveDischargeConsent

b.behydrologicallyneutral

c.ensurevolumesandtimeofconcentrationofoverlandflowsfromanareaduringrainfallarethesame,bothbeforeandaftersubdivisionhasoccurred

2.SubdivisionsdrainingdirectlytotheCMAwillbeexemptfromprovidinghydrologicalneutralityreportsforthe100yearreturnperiodstormwherethereisnoexistingorpotentialdownstreamdevelopmentandfloodingisnotanissue.

3.Thedesignprinciplesusedtoachievehydrologicalneutralityare:

a.overlandflowdisposalmustmimicasfaraspossiblethenaturaldrainageprocessofanarea

b.modificationstoexistingdrainagepatternsmustbekepttoaminimum

c.overlandflowsmustnotbedischargeddirectlyintostreamsfromapipedsystem

d.imperviousareasmustbekepttoaminimum

e.appropriatemethodsofstormwaterdetentionmustbeemployedbeforedispersalintowaterways,includingbutnotexclusively:

2.9Nativevegetation planting

1.Theplantingofnativevegetationrequiredbythecontrolssetoutinclause2.7abovemustmeetthefollowingstandards:

a.asurvivalratesuchthatplantingwillbeestablishedtoaminimumof90%oftheoriginaldensityspecifiedbeforetheprojectissignedoffascomplete

b.adensityof1.4mcentres(5,100stemsperha)reducingto1mcentres(10,000stemsperha)inkikuyuandwetlandenvironmentsandriparianmargins

c.astockprooffencemustbeerectedontheperipheryoftheplantingoratthedistancespecifiedinclause2.7above

d.theareamustbepermanentlyprotectedviacovenantfromanyactivitywhichcouldadverselyaffecttheplanting

e.allplantsmustbesourcedfromtheecologicaldistrictandbeappropriateforthesoil,aspect,exposureandtopography

f.eachplantmustbefertilisedinaccordancewiththerecommendationsoftherevegetationreportsubmittedaspartoftheplantingplanassessment

g.plantingundertakenmustreflectthecompositionofformernaturalvegetationlikelytohaveoccupiedthesiteandhaveregardtonaturalprocessesofsuccession

2.Themaintenanceofnativeplantingsmustmeetthefollowingstandards:

a.maintenancemustoccurforaminimumoffiveyearsoruntilcanopyclosurehasrecurredwithinfiveyears

b.maintenancemustincludetheongoingreplacementofplantsthatdonotsurvive

c.allinvasiveweedsmustbeeradicatedfromtheplantingsitebothatthetimeofplantingandonanongoingbasisandplantsreleasedfromkikuyuasnecessarytoensureadequategrowth

d.animalpestcontrolmustoccur

3.Applicantsmustprovideinformationtothecouncilregardingthenativeplantingwhichmeetsclause4.3below

4.Thevegetationmustbeestablishedforthepurposessetoutintheplantingplanassessmentandmustnotbeclearfelledorremoved.

5.Monitoringmustbeundertakenforaminimumoffiveyears(6monthlyforthefirst18monthsthenannually)atwhichpointthecouncilwillreviewtheplanting.

6.Amonitoringreportmustbeprovidedtothecouncilwhichmeetsclause4.3(a)(iii)below.

7.Remedialactionisrequiredwheremonitoringindicatesthatthesecontrols,orthemeasurescontainedintheplantingplanassessmentarenotbeingmet.

2.10Assessmentofwetlands

1.Forthepurposesofdeterminingwhatconstitutesasignificantwetland,theguidelinesentitled“GuidelinesfortheFieldAssessmentofWetlandQualityinRodneyDistrict”setoutinclause4.4mustbeused.Thewetlandmustmeettheacceptancecriteriaintheseguidelines.

2.Allapplicationsbasedonprotectingsignificantwetlandsmustdemonstratethatanassessmentofthewetlandhasbeenundertaken,andthatthewetlandmeetstheacceptancecriteriasetoutintheguidelinesclause4.4.

2.11Locationofprotectedwetland,andsitefordwelling

1.Theareaofthewetlandtobeprotectedcaneither:

a.remainentirelywithintheparentsitefromwhichtheruralresidentialsiteissubdivided;or

b.becontainedwithinthenewruralresidentialsiteprovidedthatthebuildingareaforbuildingandaccess,(1,500m2)doesnotrequireorresultintheremovalordestructionofnativebushandtrees,orcompromiseinanymanneranyotherfeaturetobeprotected.

2.12Protectionofwetlands

1.Everyresourceconsentinvolvingtheprotectionofawetlandmustincludeaconditionorconditionsprovidingfortheeffectiveandpermanentprotectionofthatwetland.

2.Withoutlimitation,suchconditionsmustincludearequirementthatapermanentfence(minimumsevenwirepostandbattenfencewithnogates)capableofpreventingbrowsingorotherdamagebyfarmedanimalsmustbeerected(andmaintained)aroundthewetlandtobeprotected.Anysuchfence

mustbesetbackaminimumdistanceof10metresfromthewetareaofthewetlandininstanceswheretherearenoadjoiningareasofnativebush.Nograzingofanimalsistobepermittedwithinthefencedarea.

3.Theareaofwetlandmustbemadefreeofplantpests,includingotherplantandtreespeciesthataredetrimentaltowetlandsi.e.willows,poplarsandinvasiveterrestrialplantspecies,andmaintainedinthatstate.

4.AnyconditionsfortheprotectionofthewetlandmustbecompliedwithonacontinuingbasisbythesubdividingownersandsubsequentownersandmustbethesubjectofconsentnoticestoberegisteredundertheLandTransferAct1952.

3.Assessment­Restricteddiscretionaryactivities

3.1Mattersofdiscretion

Thecouncilwillreserveitscontroltothemattersbelowfortheactivitieslistedasrestricteddiscretionaryactivitiesintheprecinctactivitytable:

3.2Assessmentcriteria

Thecouncilwillconsidertherelevantassessmentcriteriabelowfortherestricteddiscretionaryactivitylistedabove.

1.Effectsonruralcharacterandruralamenityvalues

a.Thelocationanddesignofthesiteintheproposedsubdivisionshouldnotadverselyimpactontheproductivityormanagementofestablishedhorticulturaloragriculturalactivitiesortheabilityofneighbouringsitestoestablishpermittedactivities.

b.Subdivisionshouldoccurwithoutcreatingadverseeffects,includingcumulativeeffects,ontheruralcharacteranticipatedwithintheparticularzone.

c.Siteboundariesshouldtakeintoaccountthenaturalgeographicfeaturesandbuildingareasshouldbeunobtrusiveandavoidtheneedtoremoveareasofnativetreesandbush.

d.Thelocation,designordensityofthesitesintheproposedsubdivisionshouldnotadverselyimpactontheproductivityormanagementofestablishedruralproductionactivitiesortheabilityofneighbouringsitestoestablishpermittedruralproductionactivities.

2.Ecosystemsandnaturallandscapequality

a.Worksanddevelopmentassociatedwiththesubdivisionshouldnotadverselyimpactonthequalityofanywaterbodies,includingrivers.

b.Thereshouldbeeffectivebuffersandsetbacksbetweendevelopmentandnaturalareasandwildlifehabitats,ordevelopmentshouldbelocatedanadequatedistanceawayfromnaturalareastoavoidsignificantadverseeffectsonecologicalandwildlifevalues.

c.Thesubdivisionandsubsequentdevelopmentshouldnotadverselyaffectanyfloraorfaunaspeciesincludingthreatenedorendangeredspeciesexistingonthesiteorinthesurroundingarea,includingtheareaoflandthatextendsdowntothemeanhighwatermark.

d.Vehicleaccesstoecologicallysensitiveareasshouldbeavoidedandwalkwayaccessshouldbecarefullycontrolledtoensurethatthehumanimpactsofdevelopment,particularlyinrelationtoadverseeffectsonthreatenedorendangeredspeciesareavoided.

3.Vegetationplanting

a.Anyfencingofbushorwetlandareas,ornativeandexoticandrevegetationareasorlandrehabilitationareas,asrequiredaspartofsubdivisionshouldbeofanappropriatestandardtobestockproofaroundtheperimeterofthearea.Wherethisrequirementistobewaived,itshouldbeshownthat:

physicalobstaclessuchascliffsorriversalreadyprovidesufficientprotectionfromstockandanimals

fencingwoulddetrimentallyaffecttheareatobeprotected

b.Anyareaofnaturalsignificance,wetlands,bushandwildlifehabitatshouldbelegallyandphysicallypermanentlyprotectedaspartofthesubdivision.

c.Theriparianprotectionmeasuresproposedshouldbeadequatetoprotecttheriparianmarginspermanently,includingfencingandplanting.

d.Thesubdivisionshouldnotresultinremovalofareasidentifiedforprotectionintheprimaryandsecondaryconservationareasintheconservationsubdivisionplan.

e.Subdivision(takingintoaccountremedialandmitigatoryproposals)should:

b.Thereshouldbeadequatecontributionsofwaterandservicesandreservestooffsetadverseeffectsgeneratedbythesubdivision.

c.Adequateutilitiesshouldbeprovidedforthesubdivision.

d.Theoverlandflowsshouldbehydrologicallyneutral(i.e.retainflowsatpre­developmentlevels).

5.Designandlayoutofsubdivision

a.Thesitesize,shape,contourandaccessshouldbesuitablefortheintendeduse.

b.Thesite(s)shouldbelocatedsothatitdoesnotrequiresubstantialearthworksorlandmodificationtoobtainaccessoranybuildingarea.

c.Thesite(s)shouldbelocatedsothatadwellingcanbeerectedonitwithoutsignificantlydetractingfrom,damagingordestroyinganyfeaturesonthesiterequiredtobeprotected,orfromthevisualamenityvaluespresentinthevicinityofthesite.

d.Thesite(s)shouldbelocatedsothataproliferationofentrancewaysalongapublicroaddoesnotresultandtheadverseeffectsonthesafeandefficientoperationoftheroadingnetworkareavoided.

e.Wherepossible,subdivisionshouldavoiddirectvehicleaccesstoaStateHighwayoraregionalarterialroadbyusingalternativeaccesstoalowerorderroadwheresuchaccessexistsorcanbereadilyobtained.

f.Thesubdivisionlayoutshouldavoidlocatingbuildingplatformsonaprominentridge,knollorskylinewheretheerectionofbuildingswoulddominatethenaturallandscapeordetractfromthevisualamenityvaluesinthearea.

g.Thesubdivisionshouldnotinitiateorexacerbatenaturalhazards,throughearthworksoraccessprovision,orresultinbuildingareasbeingsubjecttonaturalhazards.

h.Thesubdivisionlayoutshouldencouragetheretention,protectionandmanagementofexistingnativevegetation,wildlifehabitats,watercoursesandnaturalfeatures,includingthefencingofperennialwatercoursestopreventaccessbystock.

i.Adequatereservesshouldbeprovidedtomeetrecreationalneedsofresidents.

j.Thelayout,characterandscaleofthesubdivisionshouldbedoneinamannerandatascalethatcomplementsnaturalfeaturesidentifiedinprimaryandsecondaryconservationareasintheconservationsubdivisionplananddoesnotoverwhelmthemorresultinalossoforcompromisetheoften"remote"andnon­urbancharacteroftheunderlyingzones.

k.TheactivityshouldnotadverselyeffecttherelationshipofMaoriandtheircultureandtraditionswiththeirancestrallands,water,sites,waahitapuandothertaonga.

l.Theworksanddevelopmentassociatedwiththesubdivisionshouldnotadverselyimpactonthenaturalqualityofanywaterbodies,includingriversflowingtotheseaandtheseaitself.

m.Thesubdivisionshouldnothaveadversecumulativeeffects,including:

effectsoftheproposedsubdivisionwhichaddto,oracttogetherwiththeeffectsoftheexistingenvironmentand

Adevelopmentsketchplanthatoverlaysthesiteanalysisplanandsupportingstatementsshouldthenbepreparedillustratinghowtheadverseeffectsontheconstraintsandvaluesidentifiedina.andb.abovehavebeenavoided,mitigatedand/orprotected(includingpermanentprotectionbymeansofcovenantand/orstock­prooffencingwherewarranted)andmustalsoidentify:

•proposedhousesites

•accessroads

•walking,horseandbiketrails

•proposedsiteboundariesaroundhousesites.

Thecouncilreservesthediscretiontorequireprofessionalassessmentofecologicalvalues,thepotentialforadverseeffectsfromproposeddevelopmentandanyproposedmeasuresfortheirprotection,restorationandmanagement.

Thesiteanalysisanddevelopmentsketchplansarenotrequiredtobetosurveystandards,butshouldreasonablyaccuratelydepictallofthefeaturesspecifiedabove.

Onemeansofpresentingtheinformationrequiredbythisrulewouldbebywayofaverticalaerialphotographatascaleappropriatetoshowthedetailsrequired.

2.Managementofoverlandflows

a.Applicantsmustclearlyandaccuratelyprovideinformationonthepresentsiteconditionsandtheproposeddevelopmentanditseffectsonstormwater,including,butnotnecessarilyexclusively:

•extentofexistingbushornativevegetationonthesiteanditsspeciescomposition

•distancefromestablishedbushandthestateoftheestablishedbushifthereisnoneonthesite

•anyrestrictionsonplanting,suchassafetyissues,maintenanceofviews,etc.

ii.

Plantingplanassessment

•purposeoftheplanting,includinghillcountryerosioncontrol,streambankerosioncontrol,habitatrestoration,ecologicalcorridorcreation,bufferplantingtoprotectedgesofexistingbush,waterqualityenhancement,retirementofmarginallyeconomicland,removeoramenity/landscapeplanting,riparianmarginandwetlandrestorationandcoastalmarginrestoration.

-successrates,includinggrowthratesandnumberofplantslost(includingananalysisofthedistributionoflosses)

-canopyclosure,beginningsofnaturalecologicalprocesses­naturalregenerationinunderstory,usebynativebirds,etc

-arunningrecordoffertilisation,animalandweedpestcontrolandreplacementofdeadplants

-recommendationsforreplacementofdeadplantsandimplementationoftheserecommendations.Anyremediationactionmustspecifyastartdateandbethesubjectofaprogressreport6monthsfromthatdate(Ifremedialactionisbeyondthefirst18monthsthereportmustbeindependentoftheannualreport)

-stateofthefencingandrecommendationsformaintenancetobeundertaken.
