1.Parkingbuildingsandstructures,buildingsgreaterthan500m²GFAandanylanduseactivityidentifiedinaconceptplan,butnotinthelocationspecifiedonthatplan

a.buildingscale,bulkandlocation

b.trafficgeneration.

2.Anydevelopmentnotinaccordancewithanincorporatedconceptplanandnewbuildingsandalterationsandadditionstobuildings,visiblefromandwithin10mofthestreet

a.buildingscale,bulkandlocation.

4.2Assessmentcriteria

Thecouncilwillconsidertherelevantassessmentcriteriabelowfortherestricteddiscretionaryactivitieslistedabove.

1.Parkingbuildingsandstructures,buildingsgreaterthan500m²GFAandanylanduseactivityidentifiedinaconceptplan,butnotinthelocationspecifiedonthatplan

a.Buildingscale,bulkandlocation

i.Thescale,bulk,locationanddesignoftertiaryeducationbuildingsorstructuresshould:

•minimiseadverseovershadowing,noiseorprivacyeffectsonadjoiningresidentialzonedsitesbylandscaping,screening,and/orseparationdistances

•maintainanyhistoricheritagevaluesassociatedwithanyscheduleditem

•becompatiblewiththeruralandcoastalenvironment,whereapplicable

•maintainthepersonalsafetyoftertiaryeducationfacilityusers

•haveappropriatelandscapingorfencingsothetertiaryeducationfacilitybuildingiscompatiblewithitssurroundingsandtopreserveprivacyofadjoiningandfacingresidentialproperties.

b.Trafficgeneration

i.Trafficgenerationinrelationtoatertiaryeducationactivityshould:

•notsignificantlydetractfromtrafficsafetyandhaveregardstopotentialtrafficconflictandproximitytoanymajortrafficintersection

•ensureactivitieswhichgeneratelargevolumesoftrafficarenotaccessedfromalocal

road.

2.Anydevelopmentnotinaccordancewithanincorporatedconceptplanandnewbuildingsandalterationsandadditionstobuildings,visiblefromandwithin10mofthestreet

5.Assessment­Development controlinfringements

5.1Mattersofdiscretion

1.Inadditiontothegeneralmattersofdiscretioninclause2.3ofthegeneralprovisions,thecouncilwillrestrictitsdiscretiontothemattersbelowforthelisteddevelopmentcontrolinfringement.

a.Buildingheight,heightinrelationtoboundary,maximumbuildingcoverage

effectsofadditionalbuildingscaleonneighbouringsites,streetsandpublicopenspaces(sunlightaccess,dominance,visualamenity)

5.2Assessmentcriteria

1.Inadditiontothegeneralassessmentcriteriainclause2.3ofthegeneralprovisions,thecouncilwillconsidertherelevantcriteriabelowforthelisteddevelopmentcontrolinfringement.

a.Buildingheight,heightinrelationtoboundary,maximumbuildingcoverage

i.Buildingsthatexceedthebuildingheight,heightinrelationtoboundaryandmaximumbuildingcoveragewillneedtodemonstratethattheheight,locationanddesignofthebuildingallowsreasonablesunlightanddaylightaccessto:

•streetsandpublicopenspaces

•adjoiningsites,particularlythosewithresidentialuses

•theproposedbuilding.

b.Yardsandscreening

i.Buildingsthatdonotcomplywiththefrontyardorscreeningcontrolmustdemonstratethatthegroundfloorofabuildingfrontingastreetorpublicopenspaceprovidesinterestforpedestriansandopportunitiesforpassivesurveillanceofthepublicrealm.
