SWAY PARISH COUNCIL PLANNING AND TRANSPORT COMMITTEE
A meeting of the Planning and Transport Committee was held at the Jubilee Field Pavilion, Station Road, Sway on Thursday 14 November 2013.
Present: CouncillorsStephen Tarling (Chair), Kevin Cripps, Peter Dance, Carole Gates and David Golby.
In attendance: Neil Gulliver (Parish Clerk) and John Warden (Transport Representative) together with 9 members of the public.
PT166/13 Apologies
An apology was received from Kevin Langford.
PT167/13 Declarations of Interest
Peter Dance declared a pecuniary interest in Agenda No. 6(2) as Chairman of the Sway Social Club.
PT168/13 Minutes of the Meeting held on the 10 October 2013 and Matters Arising
(1)Minutes
The minutes of the meeting held on the 10 October 2013 were approved and signed by the Chair.
There were no matters arising.
PT169/13 Outcome of Planning Applications Considered at Previous Meetings
The Chair reported that the applications in respect of Kerri Cottage, Barrows Lane; 2 Tebourba Cottages, Station Road; Sway Youth Centre, Station Road and Half Day House, South Sway Lane, Sway had been granted by the NPA’s Officers under their delegated powers. The latest application in respect of The Silver Hind, Station Road, Sway had been referred to referred to the NPA Planning Development Control Committee. The application relating to Paradise Farm, Barrows lane, Sway had been withdrawn.
It was also noted that the Tree Works Application in respect of Meadows Cottage, Arnewood Bridge Road, Sway had been granted.
PT170/13 Trees
1)Preservation Orders (TPO)

2)Applications for Work under Tree Preservation Orders
TPO/13/0834 – 2 Peppercorn, Durnstown, Sway
The Chair commented that both the Parish Council’s Tree Representative and a reputable local Tree Surgeon had provided clear safety reasons why there should be a reduction of the lateral spread and height of this tree. The Committee agreed to accept this advice and inform the NFPA accordingly.
TPO/13/0826 – 1 Highfield Gardens, Sway
The Chair commented that both the Parish Council’s Tree Representative and a reputable local Tree Surgeon had provided clear safety reasons why this tree was in dire need of cutting back. The Committee agreed to accept this advice and inform the NFPA accordingly.
TPO/13/0836 – High Forest, Manchester Road, Sway
David Golby declared a non-pecuniary interest as a neighbour.
In considering this application, the Chair commented that it had been stated that the trees were diseased or might imminently fall. The application required written arboricultural advice or other diagnostic information which had not been provided. He added that “Reasonable Garden Maintenance” was absolutely not a reason to fell trees subject to TPOs. This area was not only inside the New Forest National Park but also within the zone of ecological sensitivity within 400m of the SPA. He suggested that the NFNPA Tree Team should be asked to take a careful look and report back on whether there were any good reasons to fell or prune any of these trees, and then decide on a tree by tree basis the extent of work they would allow. He felt that the Tree Team should also be asked to review both the extent of TPOs on this site and the need for tree protection during building works.
The Chair went on to point out that it had been a consistent policy of the Parish Council that any tree under a TPO that was felled should be replaced, not necessarily at the same place but within the plot, with a sapling that should grow to become a tree of similar quality to that felled. He had no issue with the maintenance work which was required to the other trees.
The Committee then discussed the application in more detail and also heard strong representations from members of the public as to why this application should be refused at the conclusion of which it was unanimously agreed that the Clerk should write to the NPA informing them of the Committee’s strong objections to the application and recommending that it be refused.
PT171/13 New Planning Applications
App No. 13/98933 – Wansbeck, Mount Pleasant Lane, Sway
Cladding to elevations.
After discussion, it was unanimously agreed to support Option 3 - recommend permission with the suggested proviso that the cladding is identical to that usedfor the neighbouring property. (ref 12/97283).
App No. 13/98915 – The Silver Hind, Station Road, Sway
Application to vary Condition 10 of planning permission 12/97636 the front decking may be used between 11.00 and 23.00 hours.
During a lengthy discussion, the Committee noted that the NFDC's Senior Environmental Health Officer had recommended against this application because he felt it inappropriate for a restaurant and the Police hadrecommended a one year trial because they had been called to 3 incidents at the Silver Hind in 2013 so far.
The Chairman reminded the Committee that the Parish Council had always supported local businesses including the Silver Hind whilst having serious concerns over parking, the impact on the neighbours and it being de facto a pub. The Committee had not changed it views and unanimously agreed to support Option 5 -happy to accept the decision reached by the NPA's Officers under their delegated powers with the suggestion that, it the NPA were minded to support the application, it should be for 1 year initially.

PT172/13 Sway Station
The Chair welcomed Majid Nassiri from Osborne, the contractors who were carrying out the platform works at Sway Station and invited him to give a brief update on the works to date. Majid Nassiri highlighted the following points:-
1. Up to 1st November carried out work on 28 possession shifts (i.e.5 weeks) out of which had1 shift cancelled due to heavy storm, 6 shifts of possession cancelled by Network Rail due to emergency/maintenance works required to be carried out by the Network Rail maintenance team, 11 shifts of disrupted possession of lines being altered to accommodate other works in the region such as Brockenhurst and 10 shifts of non-disruptive work.
2. Presently project assessed up to 1st Nov was three weeks behind planned completion date. As work was based on possession works, the night shift period would have to be increased by the same duration. The night shift operation hence based on 1st November’s assessment planned to be completed by January 2014 pending on no further delays to possessions.
3. The disruption had delayed the breaking out operation but planned to commence on the morning of Sunday 17th November pending on possession not being disruptive. The acoustic enclosure to be used for this operation.
4. The noise /vibration monitoring equipment are set up and operating
5. Currently there had been 2 complaints received from publicwith regards to the works which had been dealt with in a positive manner.
The Committee expressed their thanks to Majid Nassiri for his attendance and helpful update.

PT171/13 New Planning Applications (cont’d)
App No. 13/98894 – Elmore House, Durnstown, Sway
Replacement garage; workshop; remove summer house; infill swimming pool.
The Committee unanimously agreed to support Option 1 - recommend permission but would accept the decision reached by the NPA's Officers under their delegated powers.
The Committee recognised that the application met the SVDS requirements but did have concerns that insufficient work had been proposed to deal with the surface water from the development. They also felt that the workshop should be restricted to incidental use.
App No. 13/98905 – Thornhill, Middle Road, Sway
Front and rear dormer windows.
The Committee unanimously agreed to support option 3 –“The Parish Council recommend permission”.
The Committee had no issues with this application.
App No. 13/98950 – Sunsets, Hollies Close, Sway
Raised patio; bay window.
The Committee unanimously agreed to support option 3 –“The Parish Council recommend permission”.
The Committee were happy with the hedge and trellis on the boundary with Monks Revel and did ask the Officers to confirm that the maximum height of the raised patio was no more than at present.
App No. 13/98936 – 6 Oxford Terrace, Manchester Road, Sway
Single storey side extension; rooflights.
After discussion, the Committee unanimously agreed to support Option 4 - recommend refusal.
The Committee felt this application was not in keeping with the SVDS. No consideration had been given to the problem of dealing with rainwater/surface water from the site, lack of access to the garage and insufficient parking areas. The proposed design was ugly and not in keeping with the local area and was an overdevelopment of a small plot.
Action: The Clerk to convey the above responses to the Planners of the New Forest National Park Authority.

PT174/13 Planning Enforcement
In noting the Clerk’s report, the Chair pointed out that, despite 2 cases being closed,3 had been added, so there were now thirteen investigations relating to Sway.
PT175/13 NFNPA Planning Development Control Committee
This item had been dealt with earlier.
PT176/13 Other Planning Issues
The Chair gave a brief update on the Affordable Housing Survey which currently underway and reminded everyone that the deadline for replies was the 28 November. The Clerk was asked to check when the results would be available.
PT177/13 Reviewing New or Amended Policies from External Bodies such as the NFNPA, NFDC, DCLG
The Committee endorsed the draft response to the NFNPA’s consultation on the revised Statement of Community Involvement which had been prepared by the Clerk.
PT178/13 Report by the Parish Council’s Transport Representative
John Warden briefly reported that usage of the CANGO service had been very low over the past week improved slightly over the past few weeks.
PT179/13 Roads, Hedges and Ditches
The Clerk briefly reported that he had just received an updated version of the schedule of current highways issues which he would circulate to the Committee and any members of the public who would like a copy. He added that he proposed to keep the schedule under regular review and to report on progress to the Committee.
The Clerk was asked to raise the issues of fallen leaves accumulating on parts of Station Road with NFDC as they were now becoming a safety issue.
