The 232nd Meeting of the Northern Regional Committee (NRC), National Council for Teacher Education (NCTE) (1st Sitting) was held on 2nd to 6th February, 2015 at NRC, NCTE, Jaipur.

AGENDA ITEM NO. 232.1 / CONFIRMATION OF MINUTES OF 231st MEETING / The minutes of 231st meeting were confirmed with the following modifications:-
The decision mentioned against agenda item No. 231.12.11 (file No. NRCAPP-3181 be read as “copy of the complaint of Gram Pradhan, Sultanpur, Keda, Raibareilly and copy of the Building Completion Certificate received from the institution duly certified by competent authority be sent to Districtg Collector for verification”.
The decision mentioned against agenda item no. 231.19.15 (file no. NRCAPP6330) be read as “to issue Letter of Intent under clause 7(13) of the NCTE Regulations, 2014 prior to grant of formal recognition and compliance of the provisions as envisaged in NCTE Regulations, 2014 as well as guidelines issued by the NCTE Hqrs. thereof.
The decision mentioned against agenda item no. 231.21.6 (file no. NRCAPP6446 be read as “to issue Letter of Intent under clause 7(13) of the NCTE Regulations, 2014 prior to grant of formal recognition and compliance of the provisions as envisaged in NCTE Regulations, 2014 as well as guidelines issued by the NCTE Hqrs. thereof.
The decision mentioned against agenda item No. 231.33.1 (File No NRCAPP-3358) should be read as “to issue Letter of Intent under clause 7(13) of the NCTE Regulations, 2014 prior to grant of formal recognition and compliance of the provisions as envisaged in NCTE Regulations, 2014 as well as guidelines issued by the NCTE Hqrs. thereof.”
The decision mentioned against agenda item 231.38.1 be read as “ Request of the university for change of affiliating university from MD University, Rohtak, Haryana to their own University i.e. Al-Falah University (Govt. Gazette Notification dt. May 2, 2014) is accepted. Necessary orders be issued accordingly.
The decision mentioned against agenda item 231.39.2 (NRCAPP1209) be read as “ Joint FDRs of Rs. 4 lakhs not submitted”.
AGENDA ITEM NO. 232.2 / ACTION TAKEN REPORT OF 231st MEETING / The Action Taken Report was noted by the Committee.

232.3The clarification received from NCTE Hqrs. vide letter No. 51-4/2014/NCTE/N&S dt. 6th February 2014 regarding faculty in respect of B.Ed. and D.El.Ed. courses for one unit as per the provisions of the NCTE Regulations 2014; submission of faculty list in reply to letter of intent in cases where the list has already been submitted by the institution; and processing of applications of stand-alone institutions, was placed before the Committee. The Committee took note of the clarifications sent by the NCTE Hqrs. and decided to consider the applications for decisions in view of the clarifications so sent by the NCTE Hqrs.

232.4The Committee perused the agenda note with regard to advice given by Shri Arjun Harkauli, Legal Counsel, High Court of Delhi on the order passed by the Hon’ble High Court of Delhi on 24.11.2014 in the bunch of Writ Petitions i.e. W.P. No. 2889/2013 to W.P. No. 1651/2014. The Committee noted that many more institutions have also obtained similar orders. The institutions on the basis of the orders of the Hon’ble High Court have submitted their applications alongwith documents for consideration by the NRC, which applications were returned to them due to the negative recommendations of the State Govt. of Haryana for B.Ed. and D.El.Ed. courses.

The Committee noted that Hon’ble Court disposed the writ petitions in view of the judgements of the Madhya Pradesh and Punjab & Haryana High Courts as well as order dated 10th September, 2013 passed by Supreme Court in SLP No. 4247-4248/2009, with a direction that the petitioner shall apply afresh in accordance with new regulations if required and the same shall be considered by the NCTE/NRC for the year 2015-16 in accordance with new regulations which are to be notified in compliance with the directions of the Supreme Court.

The Committee also noted that the legal counsel has informed vide his E-mail that the applications of the Writ Petitioners were disposed applications and not pending applications. Hence the benefit of the High Court judgement shall be available to them only after they re-apply under the new regulations.

Hence, the Committee decided that the applications of the institutions be returned to them with the directions that they may apply afresh as per provisions of the NCTE Regulations, 2014 when the applications are invited by the NCTE provided there is no ban imposed by their state government.

232.5The agenda note placed in 231st meeting regarding, processing of applications from the State of Punjab received for D.El.Ed. course for the academic session 2013-2014, which was deferred, was perused by the Committee. The Committee noted that the State Govt. did not convey any recommendation after their letter dt. 27.8.2013 for grant of recognition for D.El.Ed. course. The letter dt. 27.8.2013 conveyed that no recognition be granted by the NCTE to new/more colleges till the submission of report by the Committee so constituted is given. The Committee noted that a letter was written to the State Government again in view of the decision taken by the NRC but no response was received from the State Government. Hence the Committee decided that the applications received for D.El.Ed. course be processed as per Regulations.

232.6Dr. Jagdeep Singh, Additional Director, D/o Higher Education, Government of Punjab pointed out that the Note “Any other stipulation prescribed by the UGC/Affiliating Body/State Government from time to time” has not been given regarding faculty for B.Ed. course in the NCTE Regulations 2014. The Committee decided that a letter be written to NCTE Hqrs. drawing their attention to this aspect for necessary addition by way of addemdum.
