Special Events and Wedding Venue Contract

This agreement is made effective as of ______, by and between 22650 Vess LLC dba “The Mohicans” and ______Client(s).

The Client(s) named above represent that they desire to hold a special event or wedding/reception on ______(date) at The Grand Barn located at 23164 Vess (22650 Vess LLC dba “The Mohicans”), Glenmont, Ohio 44628.

Therefore, the parties agree as follows:

  1. VENUE RENTAL FEE(S):

(a)The Client(s) or Representative for the Client(s), agree to pay an initial non-refundable 50% VENUE DEPOSIT of______dollars ($______). This payment serves to hold the venue for specified date of event or wedding/reception and is payable at the time of contract signature.

(b)The following are agreed upon VENUE RENTAL FEES, which include the balance remaining for the fee for the event date of ______dollars ($______) and additional on-site supervisory/security staff, est. $128.00, and refundable damage and security deposit, $500.00(to be paid by separate check or money order or credit card placed on file, returnable to the CLIENT(S) up to one week after the event has been held once property has been inspected for any potential damage from the special event or wedding). A walk-through of the VENUE can be arranged prior to entrance and the inspection will be completed the day following the event. The remaining agreed upon VENUE RENTAL FEES, SECURITY GUARD PAYMENT and DAMAGES SECURITY DEPOSIT(call to place damages security deposit on credit card hold)will be due 45 days prior to the date of the event or wedding/reception by personal check, cash or certified check made payable to “The Mohicans”. Due Date is ______.

  1. DATE CHANGES:

In the event the CLIENT(S) is forced to change the date of the event or wedding/reception, every effort will be made by 22650 Vess LLC to transfer reservations to support the new date. The CLIENT(S) agrees that in the event of a date change, any expenses including but not limited to deposits and fees that are non-refundable and non-transferable are the sole responsibility of the CLIENT(S). The CLIENT(S) further understands that last minute changes can impact the quality of the event and 22560 Vess LLC is not responsible for these compromises in quality.

  1. CANCELLATIONS:

In the event of a cancellation of a special event or wedding/reception, all payments made to date are non-refundable and all outstanding payments will be due immediately.

  1. ACCOMMODATIONS:

The CLIENT(S) agrees that accommodations provided by the VENUE for the event require a separate contract (The Mohicans Rental Agreement).

  1. OUTDOOR LOCATION:

The CLIENT(S) understand that they and their invited guests will abide by the rules and regulations of the property and VENUE.

  1. ENTIRE AGREEMENT:

This agreement contains the entire agreement of the parties except as noted in paragraph 4. above, and there is no other promises or conditions in any or other agreement whether oral or written between the parties.

  1. AMENDMENT:

This agreement may be modified or amended if the amendment is made in writing

and is signed by both parties.

  1. INSURANCE:

The CLIENT(S) shall maintain General Liability Insurance in an amount not less than $2,000,000 Combined Single Limit for Bodily Injury and Property Damage. Such insurance shall name 22650 Vess LLCdba “The Mohicans”as additional insured, and a certificate of insurance with an endorsement must be provided thirty (30) days prior to the event. (This insurance is separate from and in addition to insurance provided by the caterer if one is contracted.) Proof of insurance due 30 days prior to Event date.

  1. ON-SITE SECURITY:

A security guard will be present for all events. This service is non-negotiable. The cost of the service will be charged to the Client. (Estimated cost $128) and is due with final VENUE rental payment 45 days prior to the EVENT.

SEVERABILITY:

  1. If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written construed and enforced as so limits.

WAIVER OF CONTRACTUAL RIGHT:

  1. The failure of either party to enforce any provision of this Agreement shall not be construed as a waiver or limitation of that party’s right to subsequently enforce and compel strict compliance with every provision of this Agreement.

APPLICABLE LAW:

  1. The Agreement shall be governed by the laws of the State of Ohio.

Addendum A: Venue Operations Policies and Rules

Venue Policies

  • Events are based on a 13 hour access period (10am-11pm) and a 6 hour “event time” defined as the reception event not including the wedding ceremony, if on-site. “Event day” itinerary (e.g. ceremony, cocktail hour, photos, reception) submitted to Venue 30 days prior to scheduled event. If the event concludes prior to 11pm, Vendor/Client may use the additional time for clean up and strike of equipment if necessary, at no additional charge. Any changes must be approved by the Venue in advance.

All events must conclude by 11pm in order to allow for clean-up and closure of the venue by 12am midnight. Vendor/Client strike and equipment removal concluding by 12am.. If client would like event to end at 12midnight, additional $500 fee applies and must be arranged for in advance. If venue is NOT closed by designated time (11pm or 12midnight if additional hour paid for), client will be charged $50/15 minutes for delayed closing fee.

  • Tables and chairs will be set up in Venue and ready for Client placement.
  • Serving kitchen for use by caterer-available items are only cooler, 3 hole sink and prep area. $150 facility use fee to be paid by caterer 2 weeks prior to event.
  • Fire pit usage must be approved for the event-no fee required. Venue does not provide firewood.
  • Options for on-site wedding ceremony include the pond and the wooded clearing Arrangements must be made in advance to allow for timing of set up.
  • A Rehearsal Dinner Venue Rental Option is available for the night prior to the event, based on availability, at a rate of $500 for a 5 hour event 6pm-11pm if on-site lodging is secured through Mohican Cabins for the night of the rehearsal dinner. Alternate hours may be arranged for in advance. All catering and related policies apply. No access to the Venue in whole or in part will be allowed unless the Venue has been reserved for in advance. Venue reservations for rehearsal dinners should be made as far in advance as possible to ensure availability. Payment due 90 days prior to event.
  • Early Setup Option (for clients with events where there is no event scheduled the day prior-Friday event clients will almost always have this option for Thursday and Saturday event clients will be notified if this is an option no later than 90 days prior to their event date) is offered at a rate of $400 allowing for set up the day prior beginning at 2pm with conclusion by 9pm. This fee is not applicable for clients who have reserved and paid the associated $500 Rehearsal Dinner Fee for the Grand Barn. Payment for early set-up is due 90 days prior to the event All events require a Certificate of General Liability Insurance (see contract for specific limits and details).
  • Any use of candles must be approved by the Venue (photo of container provided to Venue for approval). All candles must be contained or enclosed in glass. The flame must not reach higher than 2 inches from below the height of the glass.
  • Decorations must be approved by the Venue. All decorations must be removed without leaving damages directly following the departure of the last guest, unless special arrangements have been made between the Client and the Venue.
  • No open flames, fires, BBQ’s or sparklers unless approved by the Venue in advance and no “send-off” items of feathers, sparkles, glitter or other non-degradable items.
  • Amplified music must be kept at a reasonable level. The venue is located in a rural area with sound traveling long distances and consideration of neighboring residents and businesses is of utmost importance, Volume control will be at the discretion of the Venue management. Use of outdoor/exterior sound system speakers must conclude no later than 10pm. If sound continues after 10pm, it must be contained indoors and all doors and windows must be closed. All sound must stop by 11pm.
  • Children must be supervised at all times.
  • The Loft

Use of The Loft at The Grand Barn is included in the rental fee. The Loft is designed with two entrances and can be divided to serve as a private Bride and Groom’s lounge the day of the event with access hours of 10am-11pm and includes:

  • Bride’s Room and Lounge
  • (1) Private half bath (sink and toilet) and vanity/mirror area
  • Hooks for hanging
  • Full length mirror
  • Groom’s Room
  • Lounge area and kitchen
  • Outdoor deck
  • Full bath (shower, sink and toilet)

In-House Inventory (included in the rate)

Interior decorations:

  • White twinkle lights wrapped around support trusses, beams and handrails. Client my add additional lights with written permission and removed at end of event by Client or Representative
  • 8 ft. x 30 in. banquet tables (seats 8) (25 available )
  • White resin garden chairs with cushioned seat (170 available)
  • Banquet chairs (maroon) with cushioned seat and back (covers recommended)
  • 24 foot rustic head table/buffet table
  • 8 foot rustic benches for ceremony use (24 available)
  • Crystal chandelier (Grand Barn staff to hand and remove) $40 charge
  • White cantina patio lights
  • White chiffon main entrance curtains

Props-The Grand Barn has a variety of props to use during the event and includes:

Labor

  • All inventories may be used for the event as needed. The Client/Caterer/Representative/Vendor is responsible for setting up and returning to their designated location at the end of the event.

Staffing

  • A daytime manager will be on location the day of your event to answer any questions and address any facility related issues.
  • Nighttime manager will be present for the duration of your event to ensure the building stays in tip-top shape throughout the evening.

Property Guidelines

  • Non-event guests may be present on the property as guests of The Mohicans (e.g. pond, walking paths, driveways, cabins).
  • Golf-carts, Gators, ATV’s are not available for use by guests or vendors.
  • Venue does not have dollies on-site.
  • Venue does not have ladders or lifts on-site, please plan accordingly.
  • No overnight storage is available.
  • No stapling or tacking materials to any walls, posts, or doors.
  • All guests and vendors must adhere to posted Venue boundaries and private area signage.
  • Smoking allowed in designated areas only. (front courtyard only)

Parking Spaces

  • (100) Non-paved dispersed parking spaces are available at The Grand Barn.

Shuttle Service

  • The Grand Barn has shuttle bus service (Mercedes 15 passenger black Sprinter) available for an hourly rate ($150/Hr. with a 4 hour minimum) to provide transportation for guests to and from the facility to local hotels (not all hotels are available for shuttle service but service does include the Mohican State Park Lodge, The Little Brown Inn, Landoll’s Mohican Castle and the Mohican River Inn). This service is to be arranged ahead of time in order to coordinate timing of pickup and drop-offs.

Rentals

Lodging at theWhite Oak Tree House, the Old Pine Tree House and Little Red 2 Guest Tree Houses as well as the Mohican, Walhonding, Kokosing, and Killbuck Cabinsmay be rented at standard rates based on availability for your event. Check-in for wedding event guests is 2pm.
