WORK PERMITS

The Governing Board recognizes that part-time jobs can give students needed supplementary income, valuable work experience, and enhanced self-esteem. However, the Board also believes that outside employment should not interfere with students' educational progress nor impair their health. In accordance with law, students must obtain work permits from school authorities before accepting employment.

The Superintendent’s designee or work experience coordinator shall issue work permits only as allowed by law and only to the extent that outside employment does not significantly interfere with the student's schoolwork. Students granted work permits must demonstrate and maintain satisfactory grades and attendance before and after work permits are issued.

1. Students must have at least a 2.0 GPA on the most current grading period (quarter or semester), and no more than 7 absences in any two classes during the last quarter and no more than 15 absences during the last semester, and has not received a failing grade in any class during the last grading period in order to get a valid work permit.

2. If a student has missed more than 15 days, whether verified or unverified, in two or more classes with the exception of those noted school-related absences, the work permit will be revoked. Parents and employers will be notified. Students who have been denied work permits due to attendance must be approved by a school administrator and the Work Experience Coordinator to be reinstated.

3. During summer vacation, all students are eligible for a work permit regardless of their school performance during the preceding school year. Identification and proof of age required.

4. At the beginning of each school year, the previous school year’s spring semester grades and attendance will be used to determine work permit eligibility. A 2.0 GPA, 15 or less absences, and no failing grades shall be required.

5. After the 1st and 3rd quarter grades are issued; work permit eligibility requires a 2.0 GPA, no failing grades, and less than 8 absences (verified and unverified) in any two classes during that quarter.

6. After the 1st semester grades are issued, work permit eligibility requires a 2.0 GPA, no failing grades, and no more than 15 absences (verified and unverified) in any two classes during that semester.

7. Exception to the 2.0 GPA requirement is permitted only to subsidized WE CARE Special Education Students.

WORK PERMITS

Approval/Revocation of Work Permits

1. No work permit shall be issued until the student's parent/guardian, foster parent, or residential shelter services provider has filed a completed B1-1 form with the District/Work Experience Coordinator. (Education Code 49110)

2. To help in determining the extent to which outside employment may be approved, the Superintendent’s designee or Work Experience Coordinator shall inspect the student's records for evidence of satisfactory grades and attendance.

A. Grades:

1. Students must have a 2.0 or better GPA, and no failing grades during the latest grading period to acquire a valid work permit.

2. If a student does not meet the requirements for a valid work permit, the work coordinator may issue a probationary work permit which shall be effective until the beginning of the next grading period, by which time the student must have achieved the necessary minimum requirements for a regular work permit.

A probationary work permit will be issued only if the work experience coordinator or a school administrator is convinced that outside employment will not interfere with the student’s educational process or health, and that the student will achieve the necessary requirements for a work permit by the ed of the next grading period.

3. At the end of that period of time, the Work Experience Coordinator will determine whether the student has met the requirements for a valid regular permit to be issued.

* If the student still does not have a 2.0, the work permit should be revoked with parent/guardian and employer notification.

4. A school administrator or work experience coordinator must approve any exceptions to this regulation.

5. After issuing a work permit the Work Experience Coordinator shall periodically inspect the student’s scholastic records. The regular grading periods at which all students' grades should be checked are first quarter, first semester, and third quarter. Progress reports may be used, however, to place a student on a probationary work permit.

6. Exception to the 2.0 GPA requirement is permitted only to subsidized WE CARE Special Education students.

WORK PERMITS

B. Attendance:

1. Six absences in any two classes create a probationary work permit condition. A probationary work permit will be issued only if the work coordinator is convinced the student will meet all the requirements by the end of the next grading period.

2. If a student misses more than 15 absences in any 2 classes during the semester the work permit can be immediately revoked with parent/guardian and employer notification.

3. After issuing a work permit, the work experience coordinator shall inspect the student's scholastic and attendance records quarterly.

4. The work experience coordinator shall revoke a student's work permit whenever he/she determines that employment is impairing the student's health or education. (Education 49164)

5. A school administrator or work experience coordinator must approve any exceptions to this process.

Permits to Work Part Time When School is in Session

1. A student 16 or 17 years of age who has completed the seventh grade may receive a permit to work outside of school hours for no more than four hours on any day on which the student is required by law to attend school. (Education Code 49112) The maximum hours per week shall be 25 for a student not enrolled in Work Experience or ROP Retail Marketing class (Cooperative Vocational Educational program) and 40 for a student who is enrolled. The following exceptions may apply:

a. The four-hour limit may be exceeded for students 16 or 17 years of age who are employed in a school-approved work experience or cooperative vocational education program or in personnel attendance occupations as defined in Industrial Welfare Commission Minimum Wage Order 1-74. b. A student 16 or 17 years of age may receive a permit to work outside of school hours for no more than eight hours on any day on which the student is required by law to attend school, provided it is a day which immediately precedes a non-school day. (Education Code 49112)

2. While school is in session, a student 14 or 15 years of age who has completed the seventh grade may receive a permit to work outside of school hours for no more than three hours on any school day and no more than 18 hours in any week. (Education Code 49112, 49116)

WORK PERMITS

If enrolled in and employed pursuant to a school-supervised and school-administered work experience and career exploration program, a student 14 or 15 years of age may be employed for up to 23 hours a week, any portion of which may occur during school hours. (Education Code 49116)

Permits to Work Full Time When School is in Session, Students 14 or 15 Years of Age

A permit to work full time may be issued to a minor 14 or 15 years of age who holds an elementary school diploma, provided that the permit expires no later than the end of the current school year and provided that one of the following circumstances exists: (Education Code 49130)

1. The parent/guardian presents a sworn statement that the parent/guardian is incapacitated for labor through illness or injury or that, through the death or desertion of the father or mother, the family is in need of the minor's earnings and that sufficient aid cannot be secured in any other manner.

2. The minor is unable to reside with his/her family and needs his/her earnings for his/her support.

3. The minor is residing with a foster-care provider or a guardian receiving foster-care funds for the minor, provided that:

a. The provider or guardian obtains written authorization from the minor's social worker, probation officer, or child protective services worker acting as an officer of the court, and;

b. The minor's case plan documents that the purpose of the employment is to further the goal of emancipation pursuant to law or to enable the minor to learn necessary skills, habits, and responsibilities related to maintaining employment.

The Work Experience Coordinator shall sign a statement that he/she has investigated the conditions under which the work permit application has been made and has judged that the minor's earnings are necessary for the minor's support and that sufficient aid cannot be secured in another manner. If issuing a work permit subject to circumstance three above, the Work Experience Coordinator shall sign a statement that he/she has received authorization from the minor's social worker, probation officer, or child protective services worker. A minor who applies for a full-time work permit pursuant to the above circumstances shall be duly enrolled in a work experience education program. (Education Code 49130)

WORK PERMITS

Permits to Work Full Time When School is in Session, Students 16 or 17 Years of Age

The Work Experience Teacher-Coordinator approves students for enrollment in Work Experience Education (Education Code 51760)

All work permits for students enrolled in Work Experience Education are issued or verified by the Work Experience Teacher-Coordinator. (Education Code 49110)

A permit to work full time may be granted to a student 16 or 17 years of age when the Work Experience Coordinator has received and approved the following documents: (Education Code 49133)

1. The student's school record, including age, grade, and attendance for the current term, signed by the principal or teacher.

2. Evidence of sufficient age, such as a birth certificate, passport, or affidavit of the student's age, signed by the parent/guardian.

3. A written statement from the prospective employer stating that work is waiting for the student and describing the nature of the work.

The Work Experience Coordinator shall give the name of the student and his/her employer to the continuation school. The student shall then enroll in the continuation school. (Education Code 49135)

Permits To Work When School Is Not In Session

Students 12 through 17 years of age may receive a permit to work on a regular school holiday, during a regular or specified occasional public school vacation, and when the student is exempt from compulsory school attendance because he/she arrived from another state within 10 days before the end of the school term.
