INTERNAL /EXTERNAL TENDER, TOP URGENTLY

Due to top urgency, General Foreign Trade Organization ( GFTO) announces an external / internal tender for second time to purchase /1500/ bales hessian cloth, size 40/10 +/- 25% as per the relevant technical conditions and legal and financial book of conditions as follows:

-Bid Bond:

-External Offer: /Euro 10 000/ for whole quantity.

-Internal Offer: / S.P 900 000/ for whole quantity.

-Bid Bond will be submitted by a legalized cheque to GFTO order or by a bank transfer or by a bank guarantee written therein NO. of the tender, quantity and the material, to be received by GFTO latest 15:00 HRS (Damascus time) on Monday 4 / 3/2013 .

-Government firms & companies are not exempted from providing bid bond.

-Performance bond: 10% of total value of contractual quantity.

-Delay penalties: One per thousand per each day of delay provided not exceeding 20% of total contract value.

-Contractor will bear all taxes and fees incurred on execution of the Contract.

-Bidder should be bound with his offer for two months as from the day following the latest date for submitting the offers.

-Delivery period:

a-External offer:

-Shipment will be within /45/ days as max. from date of receiving the workable L/C and to be effected exclusively through Syriamar or by their approval and in 30 days demurrage free containers.

b-Internal bidder:

-Contractor has to abide by delivering the whole contractual quantity FOT warehouses of the applicant within /60/ days starting from date of his being notified with commencement order issued by GFTO in writing ( by Fax).

-You can obtain the file from GFTO ( General Secretariat) after paying its value amounting S.P /1000/.

- Offers to be submitted as per Unified Contract System issued by law No. 51/2004 and Book of General Conditions of Unified Contract System issued by decree No. 450/2004.

-Offers should be submitted in a big envelope sealed with red wax to “General Secretariat at General Foreign Trade Organization –Damascus– Al-Meissat– Houtin Square – Al-Awkaf Ministry Building" before (15.00 Hrs) Damascus Time, On Monday 4 / 3/ 2013.

-Offers will be unfolded at the head office of GFTO in an open session at 10.00 HRS on Tuesday

SPECIAL FINANCIAL , LEGAL & TECHNICAL CONDITIONS BOOK

INTERNAL /EXTERNAL TENDER, TOP URGENTLY, FOR THE SECOND TIME

Due to top urgency, General Foreign Trade Organization( GFTO) announces for the second time its need to purchase /1500/ bales hessian cloth, size 40/10.

Article 1- Subject Of Contract :

Aim of the contract is to purchase /1500/ bales hessian cloth size 40/10 + 25 pct ina complete accordance with the following special technical conditions:

Technical Specifications:

1-Hessian Cloth Size ( 40 Inch×10 Ozs ):

Quantity of / 1500/ bales, new ordinary bright hessian cloth manufactured from clean, homogenized threads, free from flocculation and knots. the selvedge is firm with a width not less than one centimeter.

-Warp And Weft: (47×47), plain

-Total Length of the cloth: ( 1000 ) liner yards per bale

-Width : /102/cm.

-Contract Mass of the Bale is /284.50/ kg.

-Humidity: 17 % max.

-Content of oil: 6% max.

-Other conditions and specifications, control, sampling, supply and other tests and tolerances are according Syrian StandardSpecifications No. 3466/2009, which are considered as an integral part of this tender.

- Shipment in containers , with (30) days free demurrage period.

-Bales should be free of moistness and not damaged by seawater.

-Bales should be uniform and homogenous, strapped by not less than three iron bands and to be given serial numbers.

-The buyer has the full right to increase / decrease the quantity by max (25pct) of the total contractual value with the same terms and prices mentioned in the contract without any need for concluding a new contract.

Article 2- Place , Date & Method of Bidding:

The required bids should be handed to GFTO (General Secretariat) Hotin square-Mazraa- Al Awkaf Bldg -Damascus ,Syria or sent by the registered express airmail within the fixed period -namely before 15.00 HRS. (Damascus time) on Monday4/3/2013 in a big envelope sealed with red wax addressed to GFTO / the head office and bearing clearly the tender subject and number, the tender closing date and the name and address of the bidder .This big envelope should contain two sealed ones as follows:

First Envelope contains :

The evidential documents mentioned in Article /11/ of the Uniformed Contract System issued per the law No. 51 /2004 :

1-A written declaration by the bidder attesting that he is fully aware of the general conditions book issued per the decree No.450/04, the special conditions (legal , financial and technical) and the lists of the supply items and he accepts all conditions and provisions stated therein without any contradiction or reserves.

2- Adocument evidencing submittance of the Bid Bond as per the item ofBid Bond .

3-The application to participate in the tender,sticking on/1000 SP/ fiscal stamp.

4-Indicating chosen domicile in Syria (clearly mentioning in details name of avenue, street, Building No., No. of apartment and the phone & fax number) . Bidder's chosen domicile will be binding to him even if he moved to another one unless he notifies the first party in writing of his new domicile . Otherwise, all notifications set to his first chosen domicile will be definitely correct.

5-In case Bidder is a company , offer's signatory should provide what confirms his capacity and he is authorized by the company and all legal authorities he enjoys to attend the tender session and conclude the contract with specifying name of the agent and his detailed chosen domicile enclosing a duly legalized copy of the agency entitling him to practice all authorities to conclude the contract with GFTO-if he is so entitled .

6-A declaration by the bidder stating that he is not barred from contracting with the public bodies nor he is under any precautional attachment on his property in favour of the public bodies (nor under any executive one) .

7-A declaration by the external bidder stating that he does not own any factory, establishment or a branch office in Israel. He also does not participate in any establishment or institution therein and not taking share in any contract for production, assembling, patency or a technical aid to any establishment, identity or person in Israel; nor does he practice such activities in Israel-neither in person nor through any intermediary; nor does he contribute to Israel-supporting or to the Israeli war activity .

8-A duly legalized document attesting the bidder is duly registered in one of the chambers of commerce , industry or agriculture .

9- A copy of agency document.

10-All documents relevant to the authorizations and authorities .

11- A declaration by the internal bidder indicating that he is not an employee in the government parties.

12-Internal bidder has to submit a legalized copy of the judicial record proving that he is not convicted for any crime or dishonorable felony unless he is rehabilitated, attached with a copy of his identity card.

13-Technical offer and the required technical specifications without mentioning any price.

-Any offer contradicting the above items (either sent by fax or after the offers closing date) will be neglected .

- Only one offer will be acceptable by every bidder and the offer earliest in registration in the general secretariat of GFTO will be the reliable one. No offer can be taken back , completed or amended after being registered at our General Secretariat.

*The new companies participating in the tender or those with whom we make a contract for the first time should attach with their offer the following documents :

1-Information about the company status, date of establishment, capital, activities, legal status and the parties which they sold to inside or outside Syria duly legalized by chamber of commerce and Syrian embassy in the country of the company .

2-Information about the financial status and obligations, the business activities and the extent of its adherence to fulfill contracts. The documents about these information should be issued by the bank/banks accredited by the company in its country.

*-The bidder should submit the above required documents in the first envelope provided to be duly legalized .If the necessary time forlegalization is not sufficient,a copy of the said documents has to be sent by the express airmailwith undertaking to legalizeand sendthem later on. The bidder should indicate that in his offer.

3-A declaration of adherence to Israel boycotting in the past and in the future.

*-In case of contracting , the L/C will not be opened unless receiving the above required documents duly legalized.

*-In case a new company is awarded for the first time, GFTO has the right to specify the quantity which can be concluded with it in the light of its financial solvency, commercial reputation and the extent of adherence to fulfill its obligations.

Second Envelope contains :

-The financial and commercial offerclearly indicating the financial conditions, unittotal prices - country of origin- port of shipment and name & address ofthe producing factory and should not contain any legal or technical reservations.

- State the word “OFFER” at the top of the offer.

-When he offers products made in Syria, the internal bidder should submit into this envelope the documents stipulated in the Prime Ministry decision No. 162 dated 15/1/2008, duly legalized.

- Validity of the offer is till 7/5/2013inclusive.

-The latest date for receiving envelopes before 15:00 HRS (Damascus time)on

Monday 4/3 / 2012.

-The offers should be submitted as per the Uniform Contract System issued per the law No.51/2004.

Article 3- Openingof the offers :

The tender committee meets at the hour andon the date fixed in the relevant tender announcement, in an open session which can be attended by all bidders .

The tender committee opens the first envelope of each bidder, examines its contents, decides acceptance of the offers which are complying with the conditions required for participating in thetender and excludes the non-complying ones, declaring that to the attendants . The unacceptable offers and the relevant evidential documents will be sent back to the bidders without opening.

The offers will be opened in an open session held in the head office of GFTO/ Damascusat 10:00 HRS (Damascus time) on Tuesday 5/ 3/2013.

Article 4- Guarantees:

a-Bid Bond:

-External Offer: /Euro 10 000/ for whole quantity.

-Internal Offer: / S.P 900 000/ for whole quantity.

-Bid Bond will be submitted to our organization by a bank guarantee or by a legalized cheque to GFTOorder or by a bank transfer all before 15:00 HRS (Damascus time) on Monday4/3/2013 (Otherwise the offer will be rejected). Valid till 7/ 6 / 2013.

-The B/B should mention tender number, the quantity and the material.

-The B/B and P/B should be issued exclusively by the name of bidder. Otherwise the offer will be rejected.

-Government firms & companies are not exempted from providing Bid Bond.Any offer without the Bid Bond will be rejected .

b- Performance Bond :

-The Performance Bond at rate of 10% of total contract value should be presented within 15 days as maximum starting from the date on which the nominated contractor is notified of referring the contract to him .Otherwise, the contract will be executedon his own account; the Bid Bond will be confiscated for GFTO’s account and the bidder will be fined with the announcement expenses and all other fees, costs and penalties without the need for any excuses or notice by GFTO . Valid till 31 / 12 /2013.

-In case offer is awarded,Bid Bond will be released only after the buyer receivesthe Performance Bond covering this order and it should beat 10% of contract's value.

-Bid Bond & Performance Bond are required from all companieswhether private or public.

-Performance bond will be issued by a bank guarantee or by a legalizedcheque to GFTO's order or by a bank transfer . It has to be notified to the buyer within 15 days as latest from date of the order confirmation.

-Seller has to provide the buyer during /15/ days as max. from date of the order confirmation with a proforma invoice stating therein origin of the goods,Port of shipment, quantity, price, total value, packing , correspondent bank, name & address of the manufacturer and the technical specifications.

-GFTO will retain the performance bond submitted by the contractor to secure the good execution of the contract till the final receipt period is over and after presenting the documents required for releasing it.

Article 5- Offer Rejection :

  • Any offer will be rejected in case of :
  • Being submitted in a way contrary to content of this book.
  • Being submitted after the closing date for submitting offers
  • Any shortage in the documents or in the technical specifications required to be presented by the bidder according the provisions of Uniform Contract System referred to herein and to the conditions book. However, the tender committee has the right to give the bidders atime limit to complete the documents missing in their offers except for the bid bond and prices.
  • Being submitted by fax/ email.
  • If the agency document is not presented among the required documents as per the law No./34/ for 2008.
  • Prices should be in the financial offer and final.

Article 6– Delivery Delay Penalty :

-The contractor will be fined with a delay penalty at one per thousand per day of delay of value of the quantities delivered after contractual period provided not to exceed 20 pct (twenty percent) of the total contract value even if no damage caused to GFTO, provided these two correlative conditions should be realized :

1-The other items should be delivered within the stipulated period(s) .

2-The late delivered part should be independent in the ordinary usage from the other delivered parts, taking into consideration provisions of decree No. 450/2004 .

Article 7–Payment Method of Contract Value:

a-For External Offer:

-Payment will be by an irrevocable, untransferable & confirmed documentary L/C payable at sight.

-As soon as shipment is effected, Seller has to send the shipment notice to the Buyer including all the required information such as name, nationality and age of the carrying vessel, actual date of shipment, number & date of B/L, shipped quantity & its details and total value of the shipment. As well, he has to send copies of all documents and charter party to buyer by fax to arrange receiving of the vessel and clearing the cargo.

- The shipping documents should be sent by DHL within /15/ days from date of shipment to Buyer's bank via the correspondent bank. While the second copy of the documents should be sent directly to the buyer to be received by him before arrival of the vessel.

-The original documents including bills of lading should be received by us before arrival of goods to Syrian ports or before expiry of demurrage free period for the containers which is /30/ days from date of arrival of goods to Syrian ports.

-Seller has to send directly to us by DHL an original copy of B/L to be acceptable to private maritime agencies. Receiving & Delivery of the containers after being discharged has to be within the exempting period which should be not less than /30/ days.

-Seller has to undertake that maritime line/ shipping company will permit us to receive the goods directly and immediately upon the vessel arrival to Syrian ports against our undertaking to provide the original B/L later.

-In case the maritime line / shipping company refrains from delivering the goods to us accordingly seller will be full responsible for all charges, penalties, damages and all consequences resulted from delay in discharging and receiving the goods…….etc.

-The L/C will be opened exclusively by the name of bidder who submits the offer, the B/Bond and the P/Bond .

b- Internal Offer:

-Payment will be in Syrian pounds by a bank transfer or a cheque in favour of the seller at soonest possible for the quantities received by Applicant.

Article 8– Contractor Awareness :

- The moment he submits his offer, bidder is considered as having comprehended, understood and accepted all what is stated in this legal, financial and technical book of conditions without any reservation or discrepancy. As well, he will be considered as having noted and accepted all what is stated in the evaluated checkup, the price list,the quantities relevant to this contract and all what has been mentioned in the general conditions book.

Article 9– Stamp Duty As Per Decree No. 44 Dated 6/5/2005 :

- The seller should pay/transfer the stamp duty at (8) per thousand of total contract value to Central Bank Of Syria (Account no. 3541/23) of Directorate Of Finance/Damascus within maximum (30) days from the date of notification of L/C opening or date of commencement order. In case of delay,Seller will be charged with a fine of the double of stamp duty amount.

Likewise , the local administration fee at (5) pct of the relevant stamp duty value should be duly settled to same account .

Article 10– Receipt :

-The Contractorshould provide the materials and execute all works required in this contract accurately and carefully in full conformity with the relevant technical specifications and the instructions of GFTO, complying with the procedures valid for the execution of such works .And the required materials should completely comply with the necessary specifications and properities. As well, both the quantity and quality should conform to the relevant Contractor's offer .

Article 11– Inspection of the Materials:

- Inspection company has to be nominated by Buyer and on Seller's charge.

-GFTO has the full right to appoint any persons and local or international expert houses to supervise and control the contractual materials and works during the procedure of production , preparation and assembling . These delegates have the right to access freely during working hours to the work sites inquiring the contractor and workers about those materials and works in order to get the correct verbal or written information (they would like) and also to carry outall the analyses, laboratory trial and testsrequiredfor every work, if necessary, in the laboratory they opt in order to have full satisfaction. All fees,expenses and costs ofanalyses, tests and trials will be on the contractor account . The contractor should provide the necessary facilities to the delegates whose travel and stay expenses, compensations and salaries will be on the account of GFTO. Theattendance of GFTO delegates to inspect the production & preparation of the materials will not release at all the contractor from his own obligations stipulated in the contract concluded with him –namely those resulting from any shortage , defect and bad manufacture .
