6. Miscellaneous
Possible general terms and conditions of the Customer are hereby expressly excluded. They only become integral part of the contract if and as far as the University expressly confirms the
inclusion in written form.
This Quotation shall be governed by and interpreted with the German laws, without regard to principles of conflicts of law and excluding the UN Convention on Contracts for International Sale of Goods.
As far as legally possible, exclusive place of jurisdiction for any dispute, claim or proceeding between the University and customer arising out in connection with this Quotation shall be Regensburg, Germany.

......*Warranty and Liability:
1. / The University shall carry out the agreed-upon research with their customary diligence and according to the state of science and technology known to the University. THE UNIVERSITY MAKES NO WARRANTY EXPRESS OR IMPLIED, OR ANY REPRESENTATION THAT THE AIM INTENDED OR THE RESULTS EXPECTED WITH THE AGREED-UPON RESEARCH WILL BE ACHIEVED.2. / UNIVERSITY MAKES NO WARRANTY EXPRESS OR IMPLIED, OR ANY REPRESENTATION FOR ECONOMICALLY AND TECHNICALLY APPLICABILITY OR FITNESS OF THE RESULTS ACHIEVED FOR A PARTICULAR PURPOSE OR THAT THE USE OF THE RESULTS DO NOT INFRINGE ANY THIRD PARTY’S PATENT OR OTHER PROPRIETARY RIGHTS. University will inform the Customer about any third party’s patent or proprietary rights that become known to University.
3. / Any use of the results by Customer is at Customer’s own risk and responsibility.
4. / CLAIMS OF THE CUSTOMER DUE TO IMPROPER PERFORMANCE OF THE SERVICES ARE INITIALLY LIMITED TO SUBSEQUENT PERFORMANCE AT THE UNIVERSITY’S PLACE OF BUSINESS. In case of failure of University’s subsequent performance, Customer is entitled to abatement of costs or withdrawal from the contract.
5. / Except as otherwise stated in Section 6 below, University shall not be liable for any claims, demands or loss arising out of or in connection with Customer’s use of the results.
6. / University is liable for any culpable breach of a substantial contractual obligation. In the event of ordinary negligence, University shall only be liable for any foreseeable damage typical for the contract.
7. / In addition, University, including its representatives, agents and officers, shall only be liable for claims caused by gross negligence and/or willful misconduct.
8. / As far as a non-substantial contractual obligation has been breached by University’s agents, University’s liability according to Section 7 is excluded in cases of gross negligence.
9. / The foregoing limitations of liability in Sections 5 to 8 do not apply in cases of bodily injuries or death and for claims according to the Product Liability Act (Produkthaftungsgesetz).
