The roads shall be grouped in two groups as indicated below. The bidder may quote his/her rates for both group i.e. 1 or 2, mentioned below, separately [if bidder proposes to bid for both groups].

Group-1 South, Najafgarh Zone, West, Karol Bagh, Rohini and Narela Zone.

Group-2 Central, City, Shahdara South, Shahdara North, Sadar Paharganj and Civil Line Zone.

Who Can Apply

The Applicant may be a single entity or a group of entities (hereinafter referred to as Consortium/joint venture), coming together to implement the Project. The term Applicant used hereinafter would therefore apply to both a single entity and/or a Consortium/joint venture.

Experience Criteria:

  • The firm/consortium should have experience in mechanical sweeping on Indian roads during last four financial years. The bidder must own at least three mechanical sweepers used on highways and roads, in his/her name. The bidder shall submit a proof to this effect with the Technical Bid.

Financial & Other Criteria:

  • The firm/consortium should have annual turnover of Rs. 15.00 Crores (each year) in last three financial years preceding to the current financial year.
  • The firm/consortium should have a Net Worth of at least Rs. 3.0 Crores (each year) at the closing of last three Financial Years.

How to apply

Bidding documents can be down loaded from the MCD site / purchased against a payment of cost of tender through net banking or can be purchased against a payment of cost of tender mentioned against item, from 30.12.2008 to 16.01.2009 on all working day, between 10.00 to 17.00 Hrs. The firm/consortium or bidder shall submit the DD/Pay order of Rs. 25000/- towards the tender cost in favour of Commissioner MCD payable at Delhi and Proposal Security Rs. 50,00,000/- [Rs. Fifty Lacs Only] per group, in the form of Demand Draft (drawn in favour of Commissioner MCD payable at New Delhi) or in the form of a bank Guarantee from a Nationalized Bank. Technical bid without Tender Cost and Proposal Security will not be opened.

The firm/consortium or bidder shall submit his bid/sealed tender in the Technical Bid as well as – Financial Bid in two different envelop; separately, placed in a separate envelop

along with required documents in the office of Executive Engineer (DEMS) IV; or on MCD web site by 20.2.09 up to 3.00 PM.

The firm/consortium or bidders who are not registered with the MCD may submit their bid manually in the office of EE(DEMS) IV. However the registered contractor(s) with MCD will continue to submit their tender/quote their rate on MCD web site, only. MCD may, in its absolute discretion but without being under any obligation to do so, update, amend or supplement the information, assessment or assumptions contained in this RFP.

The issue of this RFP does not imply that MCD is bound to select or to appoint the selected Bidder or Contractor, as the case may be, for the Project and MCD reserves the right to reject all or any of the Applications or Bids without assigning any reasons whatsoever.

The Applicant shall bear all its costs associated with or relating to the preparation and submission of its Application including but not limited to preparation, copying, postage, delivery fees, expenses associated with any demonstrations or presentations which may be required by the Authority or any other costs incurred in connection with or relating to its Application. All such costs and expenses will remain with the Applicant and MCD shall not be liable in any manner whatsoever for the same or for any other costs or other expenses incurred by an Applicant in preparation or submission of the Application, regardless of the conduct or outcome of the Bidding Process.

INSTRUCTIONS TO BIDDERS

1.0REQUEST FOR PROPOSALS (RfP)

1.1This RfP for “Sweeping of Roads having Right of Way (ROW) ≥ 100 feet, with in the jurisdiction of MCD, by deploying Mechanical Sweeper(s) of required capacity”, as per schedule “A” .

The Municipal Corporation of Delhi (MCD) intends to provide clean roads on 24 × 7 basis to the residents of Delhi and like to seek private sector efficiency and mechanical sweepers for achieving the above objective.

The mechanical sweeping facility through competent private sector would be provided on roads, having Right of Way (ROW) more than or equal to 100 feet, and as per the technical specifications and performance parameters, provided in Request For Proposal (RFP) document.

1.2PROJECT FRAMEWORK: The Municipal Corporation of Delhi (MCD) intends to outsource the work of “Sweeping of Roads [i/c service lanes etc.] having Right of Way (ROW) ≥ 100 feet, with in the jurisdiction of MCD, by deploying Mechanical Sweeper(s) of required capacity” from the interested parties i.e. a company/firm/proprietorship firm/joint venture, having adequate experience in this field and adequate financial strength.

MCD will enter into a Contract Agreement with the Contractor for 7 Years for “Sweeping of Roads [i/c service lanes etc.] having Right of Way (ROW) ≥ 100 feet, with in the jurisdiction of MCD, by deploying Mechanical Sweeper(s) of required capacity”. During the period the Contractor shall carry out the services as per the technical specifications, performance standards and guidelines given as part of the Contract Agreement. The site(s) shall be handed over to the successful bidder as is where basis.

The preparation period will be 4 months within which the Contractor is expected to complete all requirements i.e. purchase/arrangement of New Mechanical Sweeper(s)/Vehicle(s)/compactor(s) fitted with GPS/wireless/mobile phone system of required technical specifications and standards. If the bidder fails to commence the work, even after the expiry of the implementation period, the performance bank guarantee [security] shall be forfeited by the MCD and work will be taken up at the risk and cost of concessionaire. Also, the infrastructure and equipments etc. developed/ purchased by the concessionaire for undertaking the work shall be taken over by the MCD from concessionaire, at no cost to MCD.

MCD shall appoint Independent Consultant to oversee the implementation of the project. MCD shall also appoint a Nodal Engineer and a Steering Group comprising the Independent Consultant, MCD Engineer(s), to provide a single contact point for the contractor with in MCD to sort out issues in implementation and to monitor the performance of the contractor. The cost of third party i.e. Independent Consultant shall be shared equally by both the parties.

The roads shall be grouped in two groups as indicated below. The bidder may quote his/her rates for both group i.e. 1 or 2, mentioned below, separately [if bidder proposes to bid for both groups].

2.SCOPE OF WORK

Due to the movement of vehicles and pedestrians on road(s), service lane(s), central verge(s) and footpath(s), there is an accumulation of loose materials/debris/rubbish such as i.e. leaves, fallen branches, articles etc. that have fallen from vehicles or from any other source(s) at the extreme left or right side of the carriage way and over the footpath & central verge.

The work shall consist of picking, removal and disposal of loose materials/debris/rubbish deposited on or along the road, service lane, central verge and footpath, cutting of vegetation – maintenance of green area, as necessary by the Contractor, at least once [or more [even during day time], as per requirement of site] in a day.

Here, this is made clear that the Contractor shall operate/ply, mechanical sweeper(s) [the machines] at the extreme left or at the right side of the carriage way, only and not at the middle/centre of the carriage way until unless is being directed to do so, by the Engineer in charge.

The Contractor shall ensure that the water nozzle fitted in the mechanical sweeper(s) remains operational at all working time and there is no dust - cloud formation during the sweeping of road(s), failing which the Contractor shall be fined Rs. 10,000/- [Ten Thousand only] per day, per default.

If the Contractor fails to undertake the mechanical sweeping on any day(s) [subject to the reasons beyond his controls], on a particular road/road(s) in his Contract area; the Contractor shall be fined @ double of amount payable to him/her [if he/she undertake the mechanical sweeping on a day(s) on a particular road/road(s) in his Contract area].

The bidder shall engage sufficient number of manpower [equipped with necessary tool & plants like broom, belcha, wheel barrow etc.] for picking up the littering material(s) from the carriage way of the road/service lane, footpath & central verge [irrespective their width/length], cutting of vegetation – maintenance of green area etc. [as per Annexure 8]. The bidder shall also be responsible for cleaning of all bell mouth(s) and gully grating(s) [irrespective their number(s) [in his/her jurisdiction]], to ensure smooth flow of storm water during rains or otherwise [through out the year]. The bidder shall ensure that none of his/her workman put/pushes the littering material(s)/silt in front or inside the bell mouth(s). If MCD found that at any place; his/her manpower has putted/pushed the littering material(s)/silt in front/inside the bell mouth(s), the bidder shall be fined Rs. 2000/- per bell mouth per day.

3.ELIGIBILITY CRITERIA FOR BIDING:

  • The firm/consortium shall not be permitted to tender for if his near relative is posted as divisional accountant or as an Engineer in any capacity between grades or Director in Chief (DEMS) and Junior Engineer (Both inclusive). He shall also intimate the names of persons who are working with him in any capacity or are subsequently employed by him and who are near relative to divisional accountant or of an Engineer in any capacity between grades or Director in Chief (DEMS) and Junior Engineer (Both inclusive). Any breach of this condition by the Contractor would render him liable to reject his/her bid/contract.
  • The firm/consortiumshould have experience in mechanical sweeping on Indian roads during last four financial years. The bidder must own at least three mechanical sweepers used on highways and roads, in his/her name. The bidder shall submit a proof to this effect with the Technical Bid.
  • The firm/consortiumshould have annual turnover of Rs. 15.00 Crores [each year] in last three financial years preceding to the current financial year.
  • The firm/consortiumshould have a Net Worth of at least Rs. 3.0 Crores [each year] at the closing of last three Financial Years.
  • Any firm/consortiumwho has been barred by the MCD or NDMC or Central/State Government or any other Govt./Semi-Govt., from participating in any project (BOT or otherwise), and the bar subsists as on the date of Application, would not be eligible to submit an Application.
  • The firm/consortiumshould, in the last four years, have neither failed to perform any contract, as evidenced by imposition of a penalty by an arbitral judicial authority or a judicial pronouncement or arbitration award against the applicant, nor been expelled from any project or contract nor have had any contract terminated for breach by such Applicant.

3.1 Eligible Applicants

3.1.1 The Applicant may be a single entity or a group of entities (hereinafter referred to as Consortium/joint venture), coming together to implement the Project. The term Applicant used hereinafter would therefore apply to both a single entity and/or a Consortium/joint venture.

3.1.2 The purchaser of the RfP Document must be the Applicant itself or a member of the Consortium submitting the Application.

3.1.3 The Applicant should submit a Power of Attorney as per the format enclosed with this RfP, authorising the signatory of the Application to commit the Applicant.

3.1.4Applications submitted by a Consortium should comply with the following additional requirements:

Number of members in a consortium would be limited to three (3);
The Application should contain the information required for each member of the Consortium;
The Application should include a description of the roles and responsibilities of individual members;
An individual Applicant cannot at the same time be member of other Consortium applying for this Project. Further, a member of a particular Consortium cannot be member of any other Consortium applying for this Project; an undertaking towards this end needs to be submitted by all members.
Members of the Consortium shall nominate one member as the Lead Member. The nomination(s) shall be supported by a Power of Attorney as per the format enclosed with this RfP, signed by all the members. The Lead Member shall be required to meet the criteria specified in Clause 3.2.2.
Members of the Consortium shall enter into a Memorandum of Understanding (MoU) for the purpose of making the Application and submitting a Proposal in the event of being short-listed. The MoU shall, inter alia, also convey the intent to form a joint venture company, with shareholding commitment(s) in accordance with Clause 3.2.2 of this RfP, which would enter into the Contract Agreement and subsequently carry out all the responsibilities as Contractor in terms of the Contract Agreement, in case the Contract to undertake the Project is awarded to the Consortium. The MoU shall also clearly outline the proposed roles and responsibilities of each member at each stage. A copy of the MoU should be submitted with the Application.

3.1.5 Any entity which has been barred or disqualified by MCD, Central Govt., State Govt. and any other Govt. Department/Semi-Government Department/ Govt. Autonomous bodies from participating in MCD projects (BOT or otherwise) and such disqualification subsists as on the Application date, would not be eligible to submit an Application, either individually or as member of a Consortium.
