Terms and Conditions for Dysphagia Chef of the Year 2016

Please read these terms and conditionscarefully. You will be legally bound by these terms and conditions from the time you submit an entry for theDysphagia Chef of the Year 2016 competition (the “Promotion”).

  1. The Promotion is only open to UK residents aged 18 years and over who are employees of a UK-based catering company. This Promotion excludes employees and agents of the Promoter and its group companies, the immediate families of such employees, or anyone professionally connected with the Promotion. Eligible individuals who enter the Promotion in accordance with clause 3 (the “Entrants” and each an “Entrant”) are deemed to participate in the Promotion and take up any prize with the full knowledge and consent of their employer. Entrants should therefore seek permission from their employer before entry into this Promotion. Internet access is required.
  1. The Promotion opens at 9am(GMT) on Wednesday 30th September 2015(the “Entry Opening Time”) and submissions for entry made in accordance with clause 3, must received by the Promoter no later than [5pm] on Saturday 16 April 2016 (the “Entry Closing Date”) The period between the Entry Opening Time and the Entry Closing Date is the “Entry Period.”
  1. To enter the Promotion the Entrant must, during the Entry Period either:

(a) text the word: DYSPHAGIA followed by their email address to 82727. (Texts messages will cost the standard rate of your network provider)or;

(b) visit the Premier Foodservice website: enter their full name, email address, catering company and wholesaler information where indicated to do so

If an Entrant enters the Promotion using step 3(a), they will be emailed by the Promoter within 7 working days of the Promoter’s receipt of the text message and will be asked to confirm their full name, catering company and wholesaler information.

Once the Entrant has completed the steps in either 3(a) or 3(b), the Entrant, by no later than 30th April 2016, will be sent a toolkitwhich will includethe judging criteria, an entry sheet and one product selected by the Promoter at its discretion, from one of the brands listed in clause 4 below.Once the Entrant has received the toolkit, they must by no later than 5pm on Friday 17th June 2016, emailtwo recipes that satisfy the criteria set out in clause 4 along with a completed copy of their entry sheet to: (“The Entry”).

  1. The Entrymust:

(a)contain at least one product fromany of the following brands:

  • McDougall’s;
  • Ambrosia;
  • Bird’s;
  • Angel Delight;
  • Homepride and / or;
  • Sharwood’s;

(b) andmeet either C or E descriptors based on current UK standards. [More information can be found at the following website: and

(c) Thecost of the ingredients used for both recipes must not amount to more than £5.

The Entrant may but is not obliged to use the product sent to them in their toolkit by the Promoter in clause 3.

  1. Entrants may enter the Promotion once. Entries made through agents, third parties, organised groups or any entry duplication method will not be accepted.
  1. The Entry shall be the Entrant’s own work. By entering the Promotion, an Entrant warrants that their Entry has not been previously published or exploited in any part and will not infringe any copyright or any other right whatsoever of any third party.
  1. Each Entry must be suitable for display and publication online and should not contain any material which may be considered obscene, indecent, defamatory or offensive either generally or to individuals of a certain race, ethnicity, sexual orientation or socio-economic group or, contain false or misleading information.
  1. The Entrants will ensure they comply with and fulfil any applicable laws and regulations including but not limited to health and safety regulations and any foodsafety regulations.
  1. Entries must not refer to any branded products other than those of the Promoter and must not contain any trademarks or logos of any party, other than of the Promoter.
  1. Five Shortlisted entrants (the “Shortlisted Entrants”) will be selected in accordance with clause 13 from all Entries made in accordance with the terms and conditions. Shortlisted Entrants will be notified that they have been shortlisted by email (using the email address provided by the Entrant in accordance with clause 3) by no later than Friday 8th July 2016. The notification email will invite Shortlisted Entrants to compete in a live final at the Promoter’s address (see clause 25) on 1st September 2016 (“Live Final”)in which they will prepare and cook,one of the recipes (at the Shortlisted Entrant’s option) submitted in their Entry.Entrants who are not shortlisted will not be notified. Shortlisted Entrants must confirm to the Promoter that they are able to participate in the Live Final by replying to the notification email in this clause 10 by no later than Friday 29th July 2016.
  1. Shortlisted Entrants will be responsible purchasing and bringing the ingredients required for their selected recipe to the Live Final. The Promoter will not be liable for the cost of the Shortlisted Entrant’s ingredients or any failure by the Shortlisted Entrant to bring the required ingredients to the Live Final and shall reserve the right to disqualify any Shortlisted Entrant who does not comply with this clause 11.
  1. Once each of the Shortlisted Entrants have prepared and cooked one of recipes submitted in their Entry at the Live Final, a winning entrant (the “Winning Entrant”) will be selected by the Judges, using the selection criteria specified in clause 13. [The Winning Entrant will be notified at the Live Final that they have won]. The Winning Entrant will win £1000 of credit with one bona fide supplier of their choice, subject to the Promoter’s approval, to be spent on kitchen equipment and / or food technology accessories for the Shortlisted Entrant’s catering company (certain items may be subject to availability) (the “Prize”) . The Winning Entrant must spend their Prize by no later than [2 September 2017].
  1. Selection of Shortlisted Entrants: All Entries will be submitted to a panel of Judges, including at least one independent judge and, a culinary advisor of the Promoter (the “Judges”). Judges will select the Shortlisted Entrants using the Judging Criteria set out in this clause. Selection of the Winning Entrant: One Winning Entrant will be chosen by a panel of Judges, including at least one independent judge and, a culinary advisor of the Promoter using the Judging Criteria in this clause. Judging Criteria: when judging Entries and Shortlisted Entrant’s Entries, the Judges will consider how well the recipe meets the needs of the target audience, as well as taste, texture, presentation and innovation.
  1. The Winner shall liaise with the Promoter to use their Prize and to arrange for the purchase of their selected kitchen equipment and / or food technology accessories. The Winner will not at any time be given the Prize in the formof cash. The Promoter will not be liable for any delivery costs, costs of goods or any other costs that exceed the £1000 credit of the Prize. Delivery of the Winner’s selected kitchen equipment and / or food technology accessories will be subject to their selected supplier’s terms and conditions, which are outside of the Promoter’s control.
  1. If the Winning Entrant is unable to accept the Prize for any reason, then the Promoter reserves the right to select an alternative winner, selected from all Entries of the remaining Shortlisted Entrants in accordance with the judging criteria in clause 13. Likewise, if a selected Shortlisted Entrant does not respond to the notification in clause 10 or, cannot attend the Live Final for any reason, the Promoter reserves the right to select an alternative shortlisted entrant in accordance with the judging criteria in clause 13. For the purpose of these terms and conditions, an alternative shortlisted entrant shall be deemed a Shortlisted Entrant and an alternative winner shall be deemed a Winning Entrant.
  1. By entering the Promotion, the Entrant grants the Promoter a perpetual, worldwide, non-exclusive, royalty-free, sub-licensable and transferrable licence to use, reproduce, distribute, and make derivative works of their Entry in any media and through any media channel.
  1. The Promoter accepts no responsibility for entries that are incomplete, delayed, not received, lost, damaged or unreadable, whether due to failure or non-availability of any website or otherwise, the submission of incomplete information or any other reason.
  1. The Promoter reserves the right to disqualify any entry that is not made in accordance with these terms and conditions. Anydecision of the Promoter as to eligibility to take part in the Promotion or the result of the Promotion will be final and no correspondence will be entered into.
  1. There is no cash alternative to the Prize. The Promoter reserves the right to award an alternative Prize, of equal or greater value, should reasons outside of the Promoter's control make this necessary.
  1. The Promoter reserves the right to delay, postpone or cancel the Promotion in the event of circumstances outside its reasonable control, which it considers make it necessary for it to do so.
  1. The Winning Entrant and the Shortlisted Entrantsmay be required to take part in non-paid publicity or advertising relating to the Promotion.The Promoter reserves the right to feature the name, photograph and location of the Winning Entrant and Shortlisted Entrants in any future marketing materials, website publications, promotions and/or prize draws. The Winning Entrant’s and Shortlisted Entrant’s recipes will be printed within a recipe guide and available to download via the Premier Foodservice website and distributed at the NACC Training and Development Forum 2016No remuneration will be received by the Winning Entrant or the Shortlisted Entrants for the feature of their recipes in the recipe guide.

  1. By entering the Promotion, each Entrant agrees to be bound by (i) these Terms and Conditions; (ii) the Premier Foods Group Limited website general terms of use and (iii) the Premier Foods Group Limited website privacy policy (iv) any site rules and procedures at the venue of the Live Final
  1. By entering the Promotion, all Entrants consent to the transfer of their personal data to the Data Controller and its agent Cirkle (Cirkle, Canon House, 27 London Ends, Old Beaconsfield, Bucks, HP9 2HN) for the purposes of the administration of this Promotion.

  1. The Promotion and any dispute or claim arising out of or in connection with it, including contractual and non-contractual disputes or claimsshall be governed by andsubject to the laws of England and Wales. Any disputes must be referred to the English courts.
