Termination of Lease

TERMINATION OF LEASE

This Termination of Lease is dated as of ______, between [NAME AND ADDRESS OF LESSOR] (“Lessor”) and [NAME AND ADDRESS OF LESSEE] (“Lessee”).

RECITALS:

Reference hereby is made to that certain [identify the lease and any amendments thereto], dated as of ______, a memorandum of which was recorded on ______in Reel ______Page ______demising [a portion of] certain premises commonly known as ______; the leased premises comprise the real property, together with buildings and improvements thereon, described on Schedule A hereto (the “Leased Premises”).

Lessor and Lessee desire to terminate the Lease.

NOW THEREFORE, in consideration of ten dollars and other good and valuable consideration, the receipt and sufficiency whereof is hereby acknowledged, Lessor and Lessee hereby agree as follows:

1. The Lease is hereby terminated and of no further force and effect.

2. Lessee forever quits and surrenders the Leased Premises unto Lessor together with any and all appurtenances and other rights under the Lease.

3. Lessee represents that the Leased Premises presently are vacant.

4. Lessee represents that there exists no subtenant or other occupant or licensee in or of the Leased Premises or any portion thereof and that neither the Lessee nor any person acting by or through Lessee thereto.

5. Lessor and Lessee each hereby releases the other from any liability or obligation with respect to the Lease and the Leased Premises.

The parties hereto hereby consent to the recordation of the Termination of Lease.

Neither party hereto has paid the other any surrender or termination fee for entering into this Termination of Lease.
